RESOLUTION NO. 7164
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA CALIFORNIA, CALLING AND GIVING NOTICE
OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION
TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER
2, 1982, FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS OF SAID CITY PROPOSED ORDINANCES RELATING
TO AMENDMENTS' TO THE.-AZUSA MUNICIPAL CODE.
WHEREAS, the City Council of the City of Azusa desires to
submit to the qualified electors of said City at a Special Municipal
Election proposed ordinances relating to amendments to the Azusa
Municipal Code; and
WHEREAS, the City Council of said city is thereupon
authorized and directed by statute to submit the Ordinances to the
qualified voters;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, DOES HEREBY RESOLVE,_ DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to the requirements of the laws
of the State of California relating to General Law Cities within
said State, there shall be, and there is hereby called and ordered
held in the City of Azusa, County of Los Angeles, State of California,
on Tuesday, November 2, 1982, a Special Municipal Election of the
qualified electors of said City for the purpose of submitting the
following proposed ordinances, to wit:

SECTION 2. The proposed ordinances submitted to the
voters shall be as set forth in Exhibitis marked "A", "B", and "C".

SECTION 3. That the ballots to be used at said election
shall be, both as to form and matter contained therein, such as may
be required by law to be used thereat.
SECTION 4. That the polls for said election shall be
open at seven o'clock a.m. of the day of said election and shall
remain open continuously from said time until eight o'clock p.m. of
the same day when said polls shall be closed, except as provided in
Section 14301 of the Elections Code of the State of California.
SECTION 5. That in all.particulars not recited in this
Resolution, saidelection-shall be held and conducted as provided
by law for holding municipal elections in said City.
SECTION 6. That notice of the time and place of holding
said election is hereby given and the City Clerk is hereby authorized,
instructed and directed to give such further or additional notice of
said election in time, form and manner as required by law.
SECTION 7. That. the City Clerk shall certify to the
passage and adoption of this Resolution; shall enterthesame in the
book of original Resolutions of said City; and shall make a minute
of the passage and adoption thereof in the records of the proceedings
of the City Council of said City, in the minutes of the meeting at
which the same is :ppased and adopted.
SECTION 8. That this Resolution shall take effect immediately.

AN ORDINANCE AMENDING THE CIVIL SERVICE
ORDINANCE AS PASSED BY THE QUALIFIED
ELECTORS OF THE CITY OF AZUSA AT GENERAL
MUNICIPAL ELECTION ON APRIL 11, 1950, AND
AMENDED AT GENERAL MUNICIPAL ELECTIONS ON
APRIL 13, 1954, APRIL 10, 1956, APRIL 14,
1970, AND APRIL 18, 1972 AND SPECIAL
MUNICIPAL ELECTION ON NOVEMBER 6, 1979,
RELATING TO APPOINTMENTS UNDER THE CIVIL
SERVICE SYSTEM.
THE PEOPLE OF THE CITY OF AZUSA DO ORDAIN
AS FOLLOWS:
SECTION 1. That the Civil Service Ordinance
of the City of Azusa at Section 2.32.020 be amended to
read as follows:
112.32.020 APPOINTMENTS - GENERALLY.
Appointments to vacant positions in
the competitive service shall be made
by the City Council or by department
heads, subject to the approval of the
City Council, in accordance with the
rules established hereunder and from
employment lists resulting from open
competitive examination, promotional
examination, lateral transfer, inter-
departmental transfer, demotion or
reinstatement.
"For purposes of this Chapter the term
'lateral transfer' shall mean that an
applicant for employment would be
eligible to take the oral examination
without completing a written examination
if said applicant met the minimum
standards for the position sought and
is currently employed in an equal position
and has been so employed for a period
of at least one year in another public
agency.
"For the purpose of this Chapter an 'employee
trainee' shall mean a class within the
classified service composed of persons who
accept employment for a limited period of
time, as established -in the position's job
specifications, during which they shall be
in training for a higher class position.
Persons accepted into the 'employee trainee'
class shall meet all of the minimum
requirements, except age, of the class for
which they will be in training, and shall be
appointed to the 'employee trainee' class
subsequent to passing an open competitive
examination comparable to one given for the
position for which they will be in training.
EXHIBIT "A"
"'Employee trainees' will be promoted into
the class for which they are training with-
out any further examination process as
openings are available. Appointments to
the higher class shall be made by the
department head based on the rule of three
which shall be any one of the three senior,
qualified 'employee trainees'. Should
there be less than three qualified 'employee
trainees', the'department head may appoint
any qualified 'employee trainee'. 'Employee
trainees' shall be subject to termination
upon reaching the maximum age or when the
job duration period, as set forth in the
job specifications, has expired.
"If appointment is to be made from
employment or promotional lists, the
names of persons willing to accept
appointments shall be certified by the
Personnel Clerk in the order in which
they, appear on the lists. The number
of names certified to the City Council
shall not exceed by two the number
of vacancies to be filled."
SECTION 2. This Ordinance being submitted to a
vote of the people at the Special Municipal Election
scheduled for November 2, 1982, shall become valid and
binding if a majority of the voters voting thereon vote in
its favor at said election, shall be considered adopted on
the date that the vote is declared by the City Council and
shall go into effect ten days after adoption.

ORDINANCE NO.
AN ORDINANCE AMENDING THE CIVIL SERVICE
ORDINANCE AS PASSED BY THE QUALIFIED.
ELECTORS OF THE CITY OF AZUSA AT GENERAL
MUNICIPAL ELECTION ON APRIL 11, 1950, AND
AMENDED AT GENERAL MUNICIPAL ELECTIONS ON
APRIL 13, 1954, APRIL 10, 1956, APRIL 14,
1970, AND APRIL 18, 1972 AND SPECIAL
MUNICIPAL ELECTION ON NOVEMBER 6, 1979'
RELATING TO CHANGING THE DESIGNATION OF
PERSONNEL CLERK TO PERSONNEL OFFICER.
THE PEOPLE OF THE CITY OF AZUSA DO ORDAIN AS
FOLLOWS:. .
SECTION 1. That the Civil Service Ordinance of
the City of Azusa at Sections 2.28.010, 2.28.060, and
2.28.070 be amended to read as follows:
"2.28.010 APPOINTMENT.
There is created a Department of
Personnel which shall consist of a
Personnel Board and Personnel Officer.
The Personnel Board shall consist of
five members to be selected as follows:
Two shall be appointed by the City
Council; two shall be elected by the
classified employees at elections held
under the rules of the Personnel Board;
one shall be appointed by the other
four."
"2.28.060 PERSONNEL OFFICER - GENERALLY.
The Board shall appoint a Personnel Officer
from an eligible list established from a
competitive examination. The competitive
examination may be advised and conducted and
weights given to parts thereof, as the Board
shall determine. The provisions of Section
2.32.060 may be exercised by the Board. The
salary of the Personnel Officer shall be set
by the Council upon recommendation of the
Board. The Board may determine that the office
of Personnel Officer can be combined with
those of any other office, in event the work
involved does not warrant full time service
and/or compensation or salary. Likewise the
Board may determine that the office of
Personnel Officer shall be full time and
compensated or paid full time. In event the
Personnel Officer is part time or combined
with another office, he may be removed from
office as Personnel Officer only, by a
majority vote of the Personnel Board for cause,
inefficiency or misconduct. In event the '
Personnel Officer is a full time employee he
may be removed from office by the Board for
cause,.inefficiency or misconduct in the same
manner and with the same safeguards as any
other classified employee. Provided however,
that the Personnel Officer, when such office
is a full time position, has the right of
appeal to the City Council. The decision of
the City Council shall be final and conclusive."

"2.28.070 PERSONNEL OFFICER - DUTIES.
The Personnel Officer shall:
"(1) Be the custodian of all
personnel records and shall be the
official upon or with whom all notices,
requests for hearings, complaint and
other official documents shall be
served and filed;
"(2) Attend all meetings of the
Personnel Board;
"(3) Administer all provisions of this
Chapter and the rules established here-
under, not specifically reserved to the
City Council or the Personnel Board;
"(4) Under the direction of the Personnel
Board, to prepare rules and amendments
thereof, for the consideration of the
Personnel Board;
"(5) Under the direction of the Personnel
Board, to prepare a position classification
plan and class specifications and revisions
thereof, for the consideration of the
Personnel Board."
SECTION 2. This Ordinance being submitted to a
vote of the people at the Special Municipal Election
scheduled for November 2, 1982, shall become valid and
binding if a majority of the voters voting thereon vote in
its favor at said election, shall be considered adopted on
the date that the vote is declared by the City Council and
shall go into effect ten days after adoption.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 5.12 OF
TITLE 5 BUSINESS LICENSES AND REGULATIONS,
SECTION 5.12.110 OF THE AZUSA MUNICIPAL
CODE RELATING TO ROCK, SAND, AND GRAVEL
EXTRACTION.
THE PEOPLE OF THE CITY OF AZUSA DO ORDAIN AS
FOLLOWS:
SECTION 1. That Title 5, Chapter 5.12, Section
5.12.110 of the Azusa Municipal Code be amended to read as
follows:
"5.12.110 ROCK, SAND, GRAVEL EXTRACTION.
Every person who engages in the business of
extracting and/or processing of rock, sand,
or gravel of [or] similar material
(hereinafter referred to as 'material'),
from any real property located within the
City, for the purpose of commercial use
thereof, in fill, construction, or similar
operations, other than on the property
where so excavated or processed, shall pay
a license tax of six cents.per ton of
material extracted or processed for use above
described; provided however, in the event
portions of any real property from which
material is being extracted or processed
is located in one or more other cities or
in the unincorporated territory of the
County the business license tax shall be
.three cents per ton of material extracted
or processed."
SECTION 2. This Ordinance being submitted to a vote
of the people at the Special Municipal Election scheduled
for November 2, 1982, shall become valid and binding if a two-
thirds majority'of the voters voting thereon vote in its favor
at said election, shall be considered adopted on the date that
the vote is declared by the City Council and shall go into
effect ten days after adoption.
