HomeMy WebLinkAboutResolution No. 71240 • RESOLUTION NO. 7124 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A CONDITIONAL USE PERMIT (CONDITIONAL USE PERMIT CASE NO. C-271 SIEGFRIED SPECKERT) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that there was filed with the Planning Commission the application of Siegfried Speckert (Conditional Use Permit Case No. C-271) requesting a Conditional Use Permit to allow a privately owned bicycle moto-cross, bicycle track or course in a C-3 Zone located at 1777 San Gabriel Canyon Road; that a duly noticed public hearing was held on said Application by the Planning Commission and that the Planning Commission granted the said Conditional Use Permit; that the matter was appealed to the City Council by an opponent - and a duly noticed public hearing was held by the City Council on said appeal. SECTION 2. After due notice and public hearing the City Council finds: A. The subject property is located at 1777 San Gabriel Canyon Road, Azusa and is zoned C-3. B. The Applicant is seeking to establish a privately owned bicycle moto-cross, bicycle track or course in a C-3 Zone. C. The property is presently partially developed with the Moose Lodge. The Lodge will remain and the proposed facility will be built around the Lodge. Surrounding uses include vacant (Consolidated Rock) to the west, vacant to the north, Foothill Dairy to the east across San Gabriel Canyon Road, and commercial recreational facility to the south. D. The general plan designates this area as Agricultural. E. The Applicant has submitted a plot plan which indicates 250 parking spaces. SECTION 3. Based upon the evidence submitted in the case, Conditional Use Permit Case No. C-271 is hereby granted subject to the following conditions: 1. This facility shall be utilized only for the operation of a.bicycle moto-cross track; the operation of any motarized vehicle on same is absolutely prohibited. 2. Provisionshall be made to keep dust from the proposed operation to a minimum. Z 3. Hours of operation shall be limited to the hours of 8:OO a.m. to 10:00 p.m. 4. Development shall comply with the plot plan as submitted. 5. All necessary permits and approvals shall be obtained. 6. The City of Azusa retains the right to review and assess the entire operation any time after the moto-cross has been in operation for 90 days. After such review and assessment additional conditions and/or limitations may be placed on the conditional use permit. Any conditions or limitations placed as a result of these reviews shall be as binding as any set forth in the initial approval of said conditional use permit. 7. This conditional use permit shall expire two years from the date of approval. 8. Adequate liability insurance shall be maintained at all times and, if deemed necessary by the City Attorney, said insurance shall cover the City of Azusa. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. 1982.
