HomeMy WebLinkAboutResolution No. 722876T676T- PS 3-80 r• . 1 2 3 4 5 6 7 8 9 10 ill 121 131 14 15 16 17 18 191 20 21 22 23 24 25 26 27 28 • RESOLUTION NO. 7228 • JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AND ACCEPTING EXCHANGE OF PROPERTY TAX REVENUES RESULTING FROM ANNEXATION AND INCLUSION OF THE CITY OF AZUSA TO THE CONSOLI- DATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change, the governing bodies of all agencies whose service areas or service re- sponsibilities would be altered by such change must determine the amount of property tax revenue to be exchanged between the affected agencies and approve and accept the exchange of property tax revenues by resolution, but if the affected agency is a special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the annexation and inclusion of the City of Azusa to the Consolidated Fire Protection District of Los Angeles County affects only the County of Los Angeles, the Consolidated Fire Pro- tection District, and the City of Azusa; and WHEREAS, this resolution pertains only to the annexation and inclusion of those areas of the City of Azusa that are not now in the Consolidated Fire Protection District; and WHEREAS, the Board of Supervisors of the County of Los Angeles and the City Council of the City of Azusa have determined that the amount of property tax revenue to be exchanged as a result -1- 76T576T-SPS 3-90 • • • 1 of the annexation of the City of Azusa to the Consolidated Fire Pro- t tection District is as set forth below. 3 4 5 NOW, THEREFORE, BE IT RESOLVED as follows: 6 7 1. The negotiated exchange of property tax revenues 8 resulting from the annexation of the City of Azusa to the Consoli- 9 dated Fire Protection District is approved and accepted. 10 11 2. For fiscal years commencing on and after July 1, 1983, 12 or after the effective date of this jurisdictional change, which - 13 ever is later, no property tax revenue is ordered transferred to 14 the Consolidated Fire Protection District from the County of Los 15 Angeles or the City of Azusa. In addition, for each fiscal year 16 commencing on and after July 1, 1983, no portion of the incremental 17 tax growth attributable to this annexation shall be transferred 18 from the County of Los Angeles or the City of Azusa to the 19 Consolidated Fire Protection District. 20 21 3. Funding to the Consolidated Fire Protection District 22 for this annexation is agreed upon in a separate agreement entitled 23 "Annexation - City of Azusa, Consolidated Fire Protection District" 24 executed on /i� , � 9 [J i oa- 25 26 4. Pursuant to Government Code Section 935.4, the City Council may, by.resolution, authorize an employee of the City to perform the function of the City Council with respect to the California Tort Claims Act, Government Code Sections 990, et seq., except for the allowance, compromise or settlement of a claim in excess of Twenty Thousand Dollars ($20,000). SECTION 2. The City Council hereby authorizes the City, Administrator to:,perfornr.all functions of the City Council required by the California Tort'Claims Act, Government Code Sections 900, et seq., except for the allowance, compromise or settlement of a claim in excess of Three Thousand Dollars ($3,000). SECTION 3. The City Clerk shall certify to the adoption of this Resolution. 1983.
