RESOLU'T'ION NO. 7267
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA, CALIFORNIA, CALLING AND GIVING NOTICE
OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION
TO BE HELD IN SAID CITY ON TUESDAY, SEPTEMBER 13,
1983, FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS OF SAID CITY THE QUESTION OF THE RECALL
OF CERTAIN OFFICERS OF SAID CITY AND THE QUESTION
OF FILLING THE VACANCIES IF THE RECALL PREVAILS.
WHEREAS, under the provisions of the law relating to
cities in the State of California, recall petitions were filed
demanding the recall of Willard R. Decker, Councilman, and June
Hart, Councilwoman, and
WHEREAS, said petitions were signed by more than 20% of
the qualified voters of the City of Azusa, and
WHEREAS, the question of filling the vacancies by
appointment or by special election if the recall prevails shall
also appear on the recall ballot;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to the requirements of the
laws of the State of California relating to cities within said
State, there shall be and is hereby called and ordered held in the
City of Azusa, County of Los Angeles, State of California, on
Tuesday, September 13, 1983, a special municipal election of the
qualified electors of said City, for the purpose of submitting the
question of the recall of Willard R. Decker, Councilman, and
June Hart, Councilwoman, and the question of filling the vacancies
by appointment or by special election if the recall prevails.
SECTION 2. That on the ballots to be used at said
election, in addition to any other matters required by law, there
shall be printed substantially the following:
INSTRUCTIONS TO VOTERS: To vote on any measure
relating to the recall of any officer, stamp a
cross (+) in the voting square after the word
"Yes" or after the word "No". To vote on the
measure relating to the filling of the vacancy,
or vacancies if the recall prevails, stamp a
cross (+) in the voting square after the words
"By Appointment" or after the words "By Special
Election".
In addition, on the ballots to be used at said
election there shall be printed substantially the following:

BY APPOINTMENT _
BY SPECIAL ELECTION
SECTION 3. A cross (+) placed in the voting square
after the word "YES" in the manner hereinbefore provided shall be
counted in favor of the recall of the officer. A cross (+) placed
in the voting square after the word "NO" in the manner hereinbefore
provided shall be counted against the recall of the officer. A
corss (+) placed in the voting sqaure after the words "BY APPOINMENT"
in the manner hereinbefore provided shall be counted for filling the
vacancy or vacancies by appointment and a cross (+) placed in the
voting square after the words "BY SPECIAL ELECTION" in the manner
hereinbefore provided shall be counted for filling the vacancy or
vacancies by special election.
SECTION 4. The City Clerk of the City of Azusa is
hereby authorized, instructed and directed to procure and furnish
any and all official ballots, notices, printed matter and all
supplies and equipment that may be necessary in order to properly
and lawfully conduct said election.
SECTION 5, That the polls for said election shall be
open at seven o'clock a.m. of the day of said election and shall
remain open continuously from said time until seven o'clock p.m.
of the same day, when said polls shall be closed, except as provided
in Section 14301 of the Elections Code of the State of California.
SECTION 6. That in all particulars not recited in
this Resolution, said election shall be held and conducted as provided
by law for holding municipal elections in said City.
SECTION 7. That notice of the time and place of
holding said election is hereby given and the City Clerk is hereby
authorized, instructed and directed to give such further or additional
notice of said election in time, form and manner as required by law.
SECTION 8. That the City Clerk shall certify to the
passage and adoption of this Resolution; shall enter the same in
the book of original Resolutions of said City; and shall make a
minute of the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of the
meeting at which the same is passed and adopted.

SECTION 9. That this Resolution shall take effect
immediately.
PASSED, APPROVED AND ADOPTED on the 6th day of June,
1983.
