HomeMy WebLinkAboutResolution No. 7469RESOLUTION NO. 7469 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR ZONING CODE ORDINANCE AMENDMENT NO. 141, MECHANICAL AND ELECTRONIC GAMES THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: WHEREAS, the Director of Planning and Community Development has prepared an Initial Study of Environmental Impact and a Negative Declaration on the proposed ordinance; and WHEREAS, said Negative Declaration and proposed ordinance were considered at a public hearing held before the Planning Commission of the City of Azusa on February 22, 1984 and a public hearing held before the City Council of the City of Azusa on March 19, 1984; and WHEREAS, as a result of said meetings the City Council requested revisions in the proposed ordinance and as a result of said revisions the Director of Planning and Community Develop- ment prepared a revised Initial Study of Environmental Impact and Negative Declaration which, along with the revised ordinance, was presented to the Planning Commission at its meeting of March 21, 1984, and to the City Council at a continued public hearing held on April 2, 1984; and WHEREAS, the revised Initial Study of Environmental Impact and Negative Declaration were prepared in accordance with the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, the City Council has carefully considered the Initial Study of Environmental Impact and the Negative Declaration and all the evidence and comments received thereon; and WHEREAS, the City Council finds and determines that no substantial evidence indicates that the proposed Zoning Ordinance Amendment No. 141 would have an effect on the environ- ment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AZUSA THAT: SECTION 1. The Negative Declaration of Environmental Impact for the proposed Zoning Ordinance Amendment No. 141, Mechanical or Electronic Games, attached hereto as Exhibit "A," is hereby certified and approved. SECTION 2. The City Clerk shall certify the adoption of this resolution. Description of Project and Address: Will affect all arcade type use within the boundaries of the City of Azusa. 5. Identification of Environmental Setting: Within the boundaries of the City of Azusa, County of Los Angeles. -1- • CITY OF AZUSA • (Code Amendment No. 141 Revisions to Arcade ASSESSMENT OF ENVIRONMENTAL IMPACT REPORT Ordinance) INITIAL STUDY A copy of the Initial Study for Public Works projects will be available to the public in the Azusa Public Works Department. A copy of the initial study for the Planning Department projects will be in the Planning Department and the Public Library. Comments from the public on the projects may be made, in writing, to the respective department directors or at the public hearings for the projects. Project Description: The proposed code amendment is a result of an extensive investigation into the question of arcades, where permitted, definition, and regulations of same. Basically the code amendment will require locations of arcades no closer than 1,000' from adult businesses. Also requires existing businesses 90 days to obtain necessary permit (if three machines or fewer) or obtain a conditional use permit (if four or more machines). Copy of said amendment is on file with the Planning Department and may be reviewed during the regular business day. II. ENVIRONMENTAL IMPACTS (Explanations of all "yes" and "maybe" answers are required on attached sheets.) 1. Earth Will the project result in: YES MAYBE NO a. DISCUSSION OF ENVIRONMENTAL EVALUATION This proposed code amendment to the Azusa Municipal Code will not change the uses ordinarily permitted in the given zone, but will assist in the regulation of certain nuisances this type of use presently permits. IV. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None Proposed. V. DETERMINATION (To be completed by the Lead Agency) On the basis of this initial evaluation: X I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared, and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
