HomeMy WebLinkAboutResolution No. 74480 0 RESOLUTION NO. 7448 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR THE GENERAL PLAN AMENDMENT FOR CERTAIN PROPERTIES LOCATED ON AZUSA AVENUE BETWEEN NINTH AND TENTH STREETS (GENERAL PLAN AMENDMENT 83-3) WHEREAS, an Initial Study of Environmental Impact and a Negative Declaration have been prepared for the proposed amendment to the General Plan of the City of Azusa for the properties on Azusa Avenue between Ninth and Tenth Streets and said initial Study and Negative Declaration were prepared in accordance with the provisions of the California Environmental Quality Act and the State CEQA Guidelines; WHEREAS, a duly noticed public hearing was held by the Planning Commission for the City of Azusa on January 18, 1984 and before the City Council on February 21, 1984 at which time evidence was heard on the proposed amendment and the Negative Declaration; WHEREAS, prior to approving the amendment, the City Council of the City of Azusa considered the Negative Declaration together with any comments received during the public review process; WHEREAS, the City Council of the City of Azusa hereby finds and determines that on the basis of the Initial Study and any comments received in the public review process that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa that the Negative Declaration for the amendment to the Azusa General Plan for the property located on Azusa Avenue between Ninth and Tenth Streets is hereby certified and approved and determined that this Negative Declaration shall filed with the County Clerk of the County of Los Angeles. SECTION 1. The City Clerk shall certify to the adoption of this resolution. 1984. APPROVED AND ADOPTED THIS5th day of March , I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Azusa, at a regular meeting thereof, held on the 5th day of March , 1984, by the following vote of the Council: AYES: COUNCILMEMBERS: CRUZ, COOK, CA11ABENA, LATTA, MOSEW NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE 6tqTY-CLERX-" L P CITY OF AZUSA NEGATIVE DECLARATION REGARDING THE GENERAL PLAN AMENDMENT DESIGNATING CERTAIN PROPERTIES ON AZUSA AVENUE BETWEEN NINTH AND TENTH STREETS AS GENERAL COMMERCIAL OR HIGH DENSITY RESIDENTIAL PROJECT The properties which are the subject of this general plan amendment are located on both sides of Azusa Avenue between Ninth and Tenth Streets. The properties designated as 940, 932, 930, 933, 918, 916, 914, 941, 937, 935, 929, 925, 917-1/2, 913, and 909 Azusa Avenue are to be designated high density residential and the remaining properties between Ninth and Tenth Streets on Azusa Avenue are to be designated general commercial. The purpose of this General Plan amendment was to accompany zone change case Z-228 in order to have conformity between the general plan and current zoning. ENVIRONMENTAL IMPACT STATEMENT An Initial Study was conducted by the City of Azusa Planning Department to evaluate the potential effect of this project upon the environment. The Initial Study concludes that the project will not have a significant effect on the environment. The purpose of this general plan amendment is to accompany zone change case Z-228 in order to have conformity between the general plan and current zoning. The general plan and zone amendments will reflect the current land uses and land use intensity of the area and will make no changes therein. Based upon the findings contained in the initial Study, it is determined that the project will not have a significant effect upon the environment. The Initial Study of Environmental Impact is attached hereto for reference. No mitigating measures are proposed nor required in light of the findings other than the fact that with approval of the zone change amendment the restrictions of the zone will be applicable to the subject properties and any development of those properties must be consistent with the zone requirements and would require additional environmental review. The Initial Study is attached hereto and incorporated herein by reference as though set forth in full. LEAD AGENCY This Negative Declaration was prepared by the Planning Department of the City of Azusa in accordance with the California Environmental Quality Act, and the State CEQA Guide- lines. A copy of the initial Study for Planning Department projects will be in the Planning Department and the Public Library. Comments from the public on the projects may be made, in writing, to the respective department directors or at the public hearings for the projects. Project Description: Subject site is located on both sides of Azusa Avenue betwe< 9th and 10th Streets (right side 940, 932, 930, 933, 918, 916 & 914 - left side 941, 937, 935, 929, 925, 917„ 913 & 909). Concurrently Zone Change Case No. Z-228 is being requested. Purpose of this General Plan Amendment is to accompany the zone change case in order to have conformity between the General Plan and current zoning.
