HomeMy WebLinkAboutResolution No. 74470 0 RESOLUTION NO. 7447 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR THE AMENDMENT TO SECTION 19.26.020 AND THE ADDITION OF SECTION 19.26.070 TO THE AZUSA MUNICIPAL CODE, ZONE CHANGE AMENDMENT NO. 140 WHEREAS, an Initial Study of Environmental Impact and a Negative Declaration have been prepared for the proposed amendment to Section 19.26.020 and the addition of Section 19.26.070 to the Azusa Municipal Code and said Initial Study and Negative Declaration were prepared in accordance with the provi- sions of the California Environmental Quality Act and the State CEQA Guidelines; and WHEREAS, a duly -noticed public hearing was held before the Planning Commission of the City of Azusa on January 18, 1984 and before the City Council of the City of Azusa on February 21, 1984 at which time evidence was heard on the proposed amendment and the Negative Declaration; and WHEREAS, prior to approving the amendment, the City Council of the City of Azusa considered the Negative Declaration together with any comments received during the public review process; and WHEREAS, the City Council of the City of Azusa hereby finds and determines that on the basis of the Initial Study and any comments received that there is no substantial evidence that the proposed amendment will have a significant effect upon the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa that the Negative Declaration for the amend- ment to Section 19.26.020 and the addition of Section 19.26.070 to the Azusa Municipal Code, Zone Amendment No. 140, is hereby certified and approved and determined that this Negative Declara- tion shall be filed with the County Clerk of the County of Los Angeles. This amendment would amend various subsections of this section so as to require that auto -body and fender shops, auto painting shops, auto sales facilities, auto trailer sales facilities, auto repair shops, muffler shops and used -car sales facilities would be permitted in the zone only with a conditional use per- mit, and further requiring that all repairs, maintenance and reconditioning work are prohibited on the site unless completely within an enclosed building. It is also proposed that Section 19.26.070 be added to the Azusa Municipal Code so as to permit outdoor storage only in areas completely screened from view by either a six-foot high block wall or a chain link fence with slats. ENVIRONMENTAL IMPACT STATEMENT An Initial Study of Environmental Impact was conducted by the City of Azusa Planning Department to evaluate the poten- tial effect of this project upon the environment. The initial study concludes that the project will not have a significant effect upon the environment. The proposed code amendment will affect all properties zoned C-3 within the City of Azusa. The purpose of this code amendment is to help eliminate certain problems related to auto- mobile related uses and outdoor storage. To foster control, this amendment will allow the City of Azusa discretionary control of said uses. The granting of this code amendment will not change the uses ordinarily permitted in this zone, nor will it permit the use of any greater intensity of what is ordinarily permitted in this zone. It will, however, provide the City with discretionary control of automobile related uses and require screening for all outdoor storage. Based upon the findings contained in the Initial Study, it is determined that the project will not have a significant effect upon the environment. The Initial Study of Environmental Impact is attached hereto for reference. No mitigating measures are proposed in light of the text of the amendment requiring a conditional use permit which would, in itself, require mitiga- tion measures for a particular project if warranted. An Environmental Impact Statement will be submitted on approximate date By: K/Ki `ham PLANNING DIRECTOR By: DIRECTOR OF PUBLIC WORKS CITY OF AZUSA NEGATIVE DECLARATION REGARDING THE ZONE CHANGE CLASSIFICATION FOR CERTAIN PROPERTIES ON NORTH AZUSA AVENUE BETWEEN NINTH AND TENTH STREETS, CITY OF AZUSA PROJECT The subject properties are located on both sides of Azusa Avenue and consist of properties on the east side designated 940, 932, 930, 922, 918, 916, and 914 North Azusa Avenue and properties on the west side of the street are designated 941, 937, 936, 929. 925, 917-1/2, 913, and 909 North Azusa Avenue. The existing zoning is C-2, restricted commercial, and the proposed zoning change would result in the properties being changed to the R -3c, multiple family, zone. ENVIRONMENTAL IMPACT STATEMENT An Initial Study was conducted by the City of Azusa Planning Department to evaluate the potential effect of the zone change amendment upon the environment. The Initial Study concludes that the project will not have a significant effect on the environment because the change in zone will conform -to -the existing uses and intensity of the subject properties. The existing sites are currently being utilized as multiple family as a non -conforming status. The proposed zone change would reflect the current need for residential use and allow the best use of the adjacent site. The granting of the zone change will not change nor will it intensify the resultant uses of property. Whether the zone change is granted or denied the use and intensity thereof will remain the same since the multiple family use is thereby right of nonconforming status. Based on the findings contained in the Initial Study, it is determined that the project will not have a significant effect upon the environment. The Initial Study of Environmental Impact is attached hereto for reference. No mitigation measures are proposed nor required in light of the findings, the require- ments of the proposed zone, and the fact that each individual_ project under the new zone would be subject to environmental review process.
