RESOLUTION NO. 7445
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A CONDITIONAL USE
PERMIT FOR PROPERTY LOCATED AT 174 NORTH
SAN GABRIEL AVENUE, AZUSA (CONDITIONAL USE
PERMIT CASE C-307, JONES INTERCABLE, INC.)
WHEREAS, Jones Intercable, Inc., has applied for a
Conditional Use Permit with respect to the real property de-
scribed as 174 North San Gabriel Avenue, City of Azusa, and
legally described as Lots 70, 71, 72, 73 and 75 of Tract
No. 14069, Map of Azusa; and
WHEREAS, said application requests a Conditional Use
Permit permitting three satellite antennae in addition to a
nonconforming structure/use pursuant to the provisions of
Section 19.060.030 of the Azusa Municipal Code; and
WHEREAS, a duly -noticed public hearing was held on
said application by the Planning Commission on December 21,
1983, and the Planning Commission approved the granting of
the Conditional Use Permit pursuant to certain conditions by
Planning Commission Resolution No. 1977; and
WHEREAS, the matter was appealed to the City Council
by action of the City Council on January 3, 1984; and
WHEREAS, a duly -noticed public hearing was held
by the City Council on said appeal on February 6, 1984, and
was continued by the Council to February 21, 1984, at which
times all persons were given the opportunity to speak on the
proposed Conditional Use Permit; and
WHEREAS, the Conditional Use Permit is categorically
exempt from the California Environmental Quality Act as a
Class 1(b) categorical exemption pursuant to Section 15301
of the State CEQA Guidelines;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF AZUSA AS FOLLOWS:
SECTION 1. After due notice and public hearing and
in consideration of all oral and written evidence presented
at said public hearings, the City Council finds and determines
that:
A. The aggregate value of the alterations
sought by said application do not exceed
150 percent of the current assessed value
of the structures or improvements on the
said property according to the County
Assessor;
B. The conditions attached to the granting
of this Conditional Use Permit are neces-
sary to preserve the health, safety and
welfare of the people.
SECTION 2. Based on the foregoing findings, the
appeal of Conditional Use Permit Case No. C-307 is hereby
granted and Conditional Use Permit No. C-307 is hereby approved
subject to the following conditions:
A. Construction shall comply with the plot
plan submitted;
B. All necessary permits shall be obtained;
C. Any and all applicable Building Department
and Fire Department requirements shall be
met at all times;
D. The applicant shall construct a 5 -foot masonry
block wall around the perimeter of the area
in which the equipment is in use to the approval
of the Director of Planning and Community
Services;
E. All the yard area outside the wall shall be
landscaped with an irrigation system and
maintained at all times to the approval of
the Director of Planning and Community Services;
F. The applicant shall provide at least seven (7)
offstreet parking spaces in accordance with
the City standards;
G. This Conditional Use Permit (C-307) shall be
null and void when the use of the subject proper-
ty is changed;
H. The applicant shall obtain a precise plan of
design permit;
I. No outdoor storage of any kind shall be
permitted;
J. All existing cable facilities on City -owned
land shall be removed to the approval of the
City Engineer;
K. The permit hereby allowed is conditional upon
the privileges being utilized within six (6)
months after the effective date of this
Resolution; and if they are not utilized or
construction work is not begun within said
time and carried on diligently in accordance
with the conditions imposed by this Resolution,
this Conditional Use Permit shall become
void, and any privilege granted hereby shall
be deemed to be null and void.
SECTION 3. The City Clerk shall certify to the
adoption of this Resolution.
