HomeMy WebLinkAboutResolution No. 74360 9 RESOLUTION NO. 7436 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR THE ORDINANCE ADDING SECTION 19.32.020(d) TO THE AZUSA MUNICIPAL CODE, PERMITTING CHURCHES IN THE M-1 ZONE. WHEREAS, An Initial Study of Environmental Impact and a Negative Declaration have been prepared for the proposed addition of Section 19.32.020(d) to the Azusa Municipal Code and said Initial Study and Negative Declara- tion were prepared in accordance with the provisions of the California Environmental Quality Act and the State CEQA Guidelines; WHEREAS, A duly noticed public hearing was held before the City Council of the City of Azusa on February 6, 1984, at which time evidence was heard on the proposed amendment to the Zoning Ordinance, the Negative Declaration of Environmental Impact and the effect, if any, that the proposed Ordinance would have upon the environment; WHEREAS, Prior to the introductory reading of the Ordinance and prior to approving the project, the City Council of the City of Azusa considered the Negative Declara- tion, together with any comments received during the public review process; WHEREAS, The City Council of the City of Azusa hereby finds and determines that on the basis of the Amended Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect upon the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa, that the Initial Study of Environmen- tal Impact for the Amendment to the Zoning Ordinance adding Section 19.32.020(d) is amended to revise the project description to indicate that the proposed amendment would allow churches in the M-1 zone provided that clinics and counselling centers are prohibited and that the parking regulations of Section 19.48.030(5) be met on the site and the requirement of a conditional -use permit he deleted therefrom and that in all other respects the City Council upholds the conclusions reached in the Initial Study with respect to the amended project description; and BE IT FURTHER RESOLVED, by the City Council of the City of Azusa that the Negative Declaration for the Ordinance adding Section 19.32.020(d) to the Azusa Municipal Code is hereby certified and approved and determines that this Negative Declaration, attached hereto as Exhibit "A" shall be filed with the County Clerk of the County of Los Angeles. The City Clerk shall certify to the adoption of this resolution. 1984. PROJECT Azusa Municipal Code Section 19.32.03U sets forth permitted uses that are allowed in the M-1 zone. The Proposed Amendment would add to this section subsection (d) which would permit churches in the M-1 zone, provided that the accessory uses of clinics or counselling centers in conjunction therewith would be prohibited. The parking requirements of Azusa Municipal Code Section 19.48.030(5) would be required to be met on site and that the use must be within 100 feet of a residential zone or park. ENVIRONMENTAL IMPACT STATEMENT An Initial Study of an Environmental Impact was conducted by the City of Azusa Planning Department to evaluate the potential effect of this project upon the environment. The Initial Study, as amended, concludes that the project will not have a significant effect upon the environment. Based upon the findings contained in the Initial Study, it it determined that the project will not have a significant effect upon the environment because of the mitigating measures which are included as conditions of the permitted use by the Ordinance. The Initial Study of Environmental Impact is attached hereto for reference. This Negative Declaration was prepared by the Planning Department of the City of Azusa in accordance with the California Environmental Quality Act and the State CEQA Guidelines. Code Amendment No. 138 A copy of the Initial Study for Public Works projects will be available to the public in the Azusa Public Works Department. A copy of the initial Study for Planning Department projects will be In the Planning Department and the Public Library. Comments from the public on the projects may be made, in writing, to the respective department directors or at the public hearings for the projects. Project Description: The purpose of this code amendment is to allow churches in the M-1 zone within 100 feet of a residential zone or park boundary, and be permitted only upon approval of a conditional use permit. This code amendment would affect all those areas in Azusa that would qualify under this new ruling. Answer the following questions by placing a check in the appropriate space: YES NO 1.
