HomeMy WebLinkAboutResolution No. 74350 0 RESOLUTION NO. 7435 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CIVIL SERVICE SYSTEM RULES 20.03, 21.02, 21.05, 21.06 AND ADDING RULE 21.05 d. WHEREAS, the City Council referred to the Personnel Board a proposed amendment to the Civil Service Rules to conform with the 1983-1984 Memoranda of Understanding; and WHEREAS, the Personnel Board conducted a hearing relative to the proposed amendments and thereafter recommended that the amendments to the Rules of the Civil Service be adopted. THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. Rule 20.03 (Payment for Overtime Will be Made as Follows); Rule 21.02 (Sick Leave); Rule 21.05 (Holidays); and Rule 21.06 (Vacations) of the Rules of the Civil Service System, City of Azusa, are hereby amended to read as each Rule is set forth in Exhibit A. which is attached hereto and incorporated herein by reference as though setforth in full. SECTION 2. Rule 21.05 d (Holidays) of the Rules of the Civil Service System, City of Azusa, is hereby amended to read as set forth in Exhibit B, which is attached hereto and incorporated herein by reference as though set forth in full. SECTION 2. This Resolution and the amendments to the Pules of the Civil Service designated herein are effective upon adoption of this Resolution.. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. ADOPTED AND APPROVED THIS 21st day of February, 1984. Employees above the first level of supervision will not receive cash *payment or compensatory time off for overtime worked without recommendation of the depart- ment head and approval of the City Administrator. All employees subject to receive payment for overtime shall receive overtime payment at the rate of one and one-half times the hourly rate of the employee for all hours worked in excess of 40 hours in any work period. (1) Employees represented by the International Brotherhood of Electrical Workers Union, Local 18, shall receive double-time pay for all con- tiguous hours worked after working sixteen consecutive hours. (Res. 7152, 7-6-82; effective per Council 7-20-81.) c. Holiday hours, sick leave hours and vacation hours shall be considered hours worked for purposes of computing overtime pay. d. All affected classified personnel shall receive callout and standby pay in accordance with appropriate prevailing Memoranda of Understanding. e. Each department head shall maintain a daily record of all overtime worked by employees in his department. f. Compensatory time off may be accrued by an employee in lieu of cash payment for overtime. Employee must indicate, at time of working overtime, option of cash payment or compensatory time off. Compensatory time may be accrued to a maximum of 160 hours. g. Cash payment for accrued compensatory time off due an employee at separation from City employment shall be at the hourly rate prevailing at the time the overtime was worked. The employee must request such payment of the City Administrator, after approval of the department head. Pro'octioncry Period Sick leave may be taken during the probctioncry period, but only in such amount cs on employee would have earned if on permanent status. if the employee does not become permanent, all paid sick leave must be reimbursed to the City at the time of termination of employment. In the event no sick leave is taken during the probctioncry period, a credit of six days leave or more as accrued, will be credited to the employee ct the time he/she attains permanent status. Res. Accrual and Use • 21-2 Sick leave with pay shall accrue to full time employees at the rate of one working day for each calendar month of paid employment, with unlimited accumulation. Sick leave shall not be taken in units of less than one-half hour. City holidays occurring during sick leave shall not be counted as a day of sick leave, except for sworn members of the Police Department assigned to shift work. d. Payment for Accumulated Sick Leave (1) An employee shall be entitled to payment at his/her current rate of salary upon death or retirement for fifty percent (50%) of accumulated sick leave provided: (Res. 6770, 3-13-79) (a) In case of retirement for disability arising out of and in the course of his/her employment, the employee shall have been employed by the City for at least five years. (b) In case of voluntary retirement for any other cause, such employee shall have been employed by the City for at least ten years. (c) In case of death, the employee had attained permanent status. (2) An employee upon terminating City employment for reasons other than death or retirement shall be entitled to payment at his/her current rate of salary for 50 percent (50%) of accrued sick leave in excess of 320 hours, up to and including 800 hours, not to exceed in any case a maximum of 30 days' pay. (3) An employee with 320 hours of accrued sick leave, may be paid at his/her current salary rate, for 50 percent (50%) of all unused sick leave accrued during the preceding calendar year in excess of 48 hours. e. Advance Sick Leave Permanent employees may be allowed sick leave in advance of accrual up to a maximum of 12 working days on approval of the department head. Probationary employees serving in entry level positions may be allowed sick leave in advance of accrual up to a maximum of six working days on approval of the department head. f. Sick Leave During Vacation Sick leave may be substituted for vacation leave, should an employee become seriously ill or injured while on approved vacation. g. Sick Leave on Layoff An employee reappointed after layoff retains any unused sick leave accumulated at the time of layoff. Res. 6504 2/22/77 0 h. Sick Leave on Reinstatement • 21-3 An employee reinstated following resignation shall not retain the sick leave accumulated prior to resignation. i. Sick Leave During Disability Leave An employee on disability leave may use vacation leave in the amount necessary to bring compensation received up to the amount of his full wage. If an employee's vacation allowance is exhausted while he/she is on disability leave, additional compensation may be approved by the City Council. J. Sick Leave During Industrial Injury Leave A permanent employee who is disabled through a work -incurred injury shall continue to receive full pay without the use of sick leave but less the worker's compensa- tion benefits for a period of 90 calendar days. Paid leave may be continued subject to review by the City Council at the end of such 90 calendar day period to a maximum of one calendar year. Supporting medical documentation must accompany such request for leave and be submitted 30 days prior to expiration date. An employee on industrial injury leave may continue to accrue all benefits while on such leave, including salary adjustments, sick leave, vacation and seniority. Police Officers disabled through work -incurred injury shall receive full salary with no charge against accumulated sick leave, in accordance with State Labor Code, Section 4850. k. Reasons for Sick Leave Sick leave shall be granted for the following reasons: (1) Personal illness or physical incapacity resulting from causes beyond the employee's control. (2) The illness of a member of the employee's immediate family (father, mother, sister, or brother) or members of the employee's houshold (husband, wife, and children) that requires the employee's personal care and attention. (3) Enforced quarantine of the employee in accordance with the Health Department regulations. (4) The death of a member of the employee's immediate family (mother, father, brother, sister, husband, wife, child, mother-in-law, father-in-law) or relative living within the employee's household (limited to a maximum of five days in each instance.) In the event of the death of a relative beyond the aforementioned relation- ships, accrued sick leave not to exceed three days may be granted for cause by the department head, subject to the approval of -- and appealable to -- the City Administrator. Res. 6504 2/22/77 C7 0 21-4 (5) Medical, dental, and optical appointments. (6) Personal business not to exceed a maximum of 24 hours during any one year. As used in this subparagraph, "Personal Business" means those items of personal business that can only be taken care of during regular working hours of the employee. Personal business leave shall be approved by the department head only in case of necessity. 1. Restrictions on Sick Leave An employee shall not be granted sick leave for the following reasons; (1) Disability arising from any sickness or injury purposely self-inflicted, or caused by his/her own wilful misconduct. (2) Sickness or disability sustained while on leave of absence, other than regular vacation leave. (3) Disability or illness arising from compensated employment other than with the City. Part-time, emergency, seasonal, relief, temporary, or hourly employees are not entitled to paid sick leave. M. Revocation of Sick Leave The department head shall revoke sick leave if the employee is found to have misrepresented the reason for the requested sick leave. 21.03 Military Leave Military leave with pay shall be granted in accordance with Section 395 of the Military and Veteran's Code. An employee who has been in the City employment for a period of not less than one year, upon being called for temporary military duty, shall receive full salary for a period not to exceed 30 calendar days in a calendar year. Time spent in military service shall be considered City employment for computation of seniority, salary adjustments, etc. 21.04 Jury Duty An employee accepted for jury duty shall immediately notify his supervisor or department head. No deductions shall be made from the salary of such employee provided he/she waives or remits to the City the fee, exclusive of mileage paid for jury duty. If he/she does not waive or remit to the City the fee, he/she shall be paid only for the time actually worked in his/her regular position. Res. 6504 2/22/77 • • 21-5 21.05 Holidays a. Employees shall receive time off or be compensated for a minimum of eleven holidays per year. Classified employees shall not be eligible for holiday pay until after completion of thirty calendar days of service. b. When a holiday falls on a Saturday or Sunday, it shall be observed on the following Monday. C. Reference: Rule 21.06 for information relative to vacation in lieu of holidays for Public Safety Personnel. d. Sworn shift personnel shall receive an additional 4.4 hours pay for each holiday, whether holiday worked or not. 21.06 Vacations The time at which an employee may take his/her vacation shall be determined by the department head with due regard for the wishes of the employee and the needs of the service. Accrual rate follows: a. Classified City employees shall accrue vacation leave as stated hereinafter: 1st through 5th year of service 7.33 hrs./mo. 11 days/yr. 6th year of service 10.00 hrs./mo. 15 days/yr. 7th through 15th year of service .667 hrs./mo. 1 day/yr. (shall be added each year to a maximum annual accrual of 192 hours (24) days after 15 years of service.) Sworn shift personnel shall accrue an additional 40 hours per year in lieu of holidays. b. Sworn personnel shall receive an annual vacation of not less than 15 consecutive days, which 15 consecutive days vacation shall consist of not more than 88 hours of paid time. C. Accrued vacation time shall be credited to each employee's account on January 1 of each year. An employee who has been in City employment for a period of less than one year on January 1 shall receive accrued vaca- tion time in the amount of his accrual rate times the number of months worked prior to January 1. Vacation leave for new employees will be granted either on or after January 1, or six months after the date of employment, whichever is the later date. The following January 1, the employee will be eligible for a regular vacation. e. In determining the amount of vacation earned, an employee beginning on the 16th of the month, or later, shall not include the period from then until the end of the month as earned vacation credit. An employee begin- ning between the first and 15th, inclusive, shall be credited with the whole month as earned vacation credit. g. An employee may accrue vacation time up to a maximum of one and one-half times the vacation credit earned in the previous calendar year. Employees who are laid off, terminated, or resign shall be compensated for vacation time accrued at the date of separation up to the maximum amount of 42 working days. If the employee owes the City for unearned vacation time, the actual time shall be deducted from final pay. 21.07 Part-time, etc., Employees Part-time, emergency, seasonal, relief or temporary employees shall not be entitled to paid vacation, sick leave or holiday pay, except to the extent required under any state or federally -funded program, or except to the extent that such benefits are funded through non -City sources. 21.08 Absent Without Leave Failure on the part of an employee, absent without leave, to return to duty within 24 hours after notice to return shall be cause for immediate discharge, and such employee automatically waives all rights under the Personnel Ordinance and Rules. 21.09 Compensation of Employees for Time Spent Participating in City Examinations. An employee shall be paid at straight time for time taken from regular duties for the purpose of participating in a promotional or equivalent -pay classifi- cation examination for which she/he is qualified. An employee shall not be compensated for time spent on a promotional/equivalent examination which occurs outside his/her regularly scheduled work hours; e.g., lunch break; before 8 a. m. or after 5 p.m, or on weekends (for employees working on "eight -to -five" schedule); or off-duty time (for shift employees). Only actual time taken from his/her regular work schedule will be compensated for. The employee shall notify his/her supervisor of the examination title, time, date, and place immediately upon receipt of that information.
