HomeMy WebLinkAboutResolution No. 74150 0 RESOLUTION N0. 7415 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR THE AMENDMENT TO THE DEVELOPMENT AGREEMENT BETWEEN AZUSA PACIFIC UNIVERSITY AND THE CITY OF AZUSA RELATING TO THE REVISED MASTER PLAN WHEREAS, the City Council finds and determines that an initial study environmental impact and negative declaration was prepared by the Planning Department of the City of Azusa in connection with the revision of the land development agree- ment between the City of Azusa and Azusa Pacific University and that said initial study and negative declaration have been prepared in accordance with the California Environmental Quality Act and the State CEQA Guidelines; WHEREAS, a duly noticed public hearing was held on the proposed amendment and the negative declaration before the Planning Commission on December 7, 1983 and before the City Council on January 3, 1984 at which time evidence was heard and considered in connection with the amendment and the negative declaration; WHEREAS, prior to approval of the amendment, the City Council of the City of Azusa considered the negative declaration together with any comments received during the public review process; WHEREAS, the City Council of the City of Azusa finds and determines on the basis of the initial study any comments received during the public review process that there is no substantial evidence that the project will have a significant effect upon the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa that the negative declaration attached hereto is hereby certified and shall be filed with the County Clerk of the County of Los Angeles. SECTION 1. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED THIS 16th day of January � 1984. I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Azusa, at a regular meeting thereof, held on the 16thday of January , 1984, by the following vote of the Council: AYES: COUNCILMEMBERS: CRUZ, COOK, CAMARENA, LATTA, MOSES NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NOP CITY OF AZUSA NEGATIVE DECLARATION FOR REVISION OF LAND DEVELOPMENT AGREEMENT BETWEEN CITY OF AZUSA AND AZUSA PACIFIC UNIVERSITY DESCRIPTION OF PROJECT The subject property is located at 921 East Alosta Avenue and is currently developed with the Azusa Pacific University. The University has many current structures plus certain structures that were included in their master plan for the development agreement with the City of Azusa which was approved by the City on July 18, 1983. It was agreed by both parties as part of that agreement that any time a change in the master plan was suggested that both parties be advised and requires that the master plan and the development agreement be amended. In order to comply with the regulations and restrictions of the agreement, Azusa Pacific University is proposing a change in the master plan that effects future housing structures. Azusa Pacific University proposes to revise this master plan and the development agreement by adding a student housing complex on the east side of Citrus Avenue and to the north of the Science Building. The revision is shown on the "revised master plan for Azusa Pacific University - Exhibit "B", October, 1983 which will be attached to the development agreement as Exhibit "B" and is attached hereto and incorporated herein as though set forth in full. ENVIRONMENTAL IMPACT STATEMENT An initial study was conducted by the City of Azusa Planning Department to evaluate the potential effect of the project on the environment. The Department concluded that the project would not have a significant effect upon the environment because the request will not change the uses ordinarily permitted in the zone nor will it permit the use of any greater intensity of what is ordinarily permitted in the zone. This is only a request for modification of an existing land development agree- ment between the City of Azusa and Azusa Pacific University. Based upon the findings contained in the initial study, it is determined that the project would not have a significant environmental impact and that no mitigating measures are required because of this finding. The results of the initial study are attached for reference. This negative declaration was prepared by the City of Azusa Planning Department according to the California Environmental Quality Act and the State CEQA Guidelines. Copies may be obtained at the Azusa City Hall, Planning Department, 213 East Foothill Boulevard, Azusa, California. A copy of the Initial Study for Planning Department projects will be In the Planning Department and the Public Library. Comments from the public on the projects may be made. In writing, to the respective department directors or at the public hearings for the projects.
