HomeMy WebLinkAboutResolution No. 74020 • RESOLUTION NO. 7402 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR THE AMENDMENT TO SECTION 19.56.060(1) OF AZUSA MUNICIPAL CODE WHEREAS, an initial study of environmental impact and a negative declaration have been prepared for the proposed amendment to Azusa Municipal Code Section 19.56.060(1) and said initial study and negative declaration were prepared in accordance with the provision of the California Environmental Quality Act and the State Guidelines; WHEREAS, a duly noticed public hearing was held for the Planning Commission for the City of Azusa on December 7, 1983 and before the City Council of the City of Azusa on January 3, 1984 at which time evidence was heard on the proposed amendment and the negative declaration; WHEREAS, prior to approving the project, the City Council of the City of Azusa considered the negative declaration together with any comments received during the public review process; WHEREAS, the City Council of the City of Azusa hereby finds and determines that on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect upon the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa that the negative declaration for the amendment to Section 19.56.060(1) of the Azusa Municipal Code is hereby certified and approved and determines that this negative declaration shall be filed with the County Clerk of the County of Los Angeles. SECTION 1. The City Clerk shall certify to the adoption of this resolution. 1984. APPROVED AND ADOPTED THIS 3rd day of January , I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Azusa, at a regular meeting thereof, held on the 3rd day of January , 1984, by the following vote of the Council: AYES: COUNCILMEMBERS: CRUZ, COOK, CAMARENA, LATTA, MOSES NOES: COUNCILMEMBERS: ABSENT: COUNCILMEMBERS: NONE NONE 11.4ZVJ ITY CLERK 0 to CITY OF AZUSA NEGATIVE DECLARATION REGARDING THE AMENDMENT TO SECTION 19.56.060(1) OF THE AZUSA MUNICIPAL CODE, AMENDMENT NO. 139 PROJECT Azusa Municipal Code Section 19.56.060(1) requires a precise plan permit to be issued by the Planning Department with five (5) days of initial filing. The purpose of the precise plan is to allow all concerned city departments to review the development plan and to establish conditions of approval. The standard turnaround time from filing a precise plan to approval generally runs from one (1) day to two (2) weeks depending on size and complexity of the development. In order to bring the code into comformance with the procedures, it is necessary to change the five (5) day requirement to fifteen (15) days. ENVIRONMENTAL IMPACT STATEMENT An initial study was conducted by the City of Azus Planning Department to evaluate the potential effect of this project upon the environment. The initial study concludes that the project will not have a significant effect on the environ- ment because the proposed code amendment is strictly a procedural change from a five (5) day review period to a fifteen (15) day review period to allow conformity with standard procedures. Based upon the findings contained in the initial study, it is determined that the project will not have a significant effect upon the environment. The initial study of environmental impact is attached hereto for reference. No mitigating measures are proposed nor required in light of the findings. This negative declaration was prepared by the Planning Department of the City of Azusa in accordance with a California Environmental Quality Act and the State CEQA Guidelines. Comments from the public on the projects may be made, in writing, to the respective department directors or at the public hearings for the projects. Project Description: The purpose of this amendment is to allow conformity in the Precise Plan Review Period. At present the standard turn around time from filing a precise plan generally runs anywhere from one day (for patio covers and room additions) to two weeks (for major developments). At present the code calls out for a five-day review period. The proposed Amendment No. 139 changes that review period to fifteen (15) days.
