HomeMy WebLinkAboutResolution No. 7584RESOLUTION NO. 7584 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE FINDING OF NO SIGNIFICANT IMPACT FOR THE ACQUISITION AND CONSTRUCTION OF A 14,000 SQUARE FOOT SENIOR CITIZENS CENTER AT THE INTERSECTION OF EIGHTH STREET AND DALTON AVENUE WHEREAS, an Environmental Assessment was prepared for the proposed Senior Citizen Center Project under the National Environmental Policy Act (NEPA) and is attached hereto as Exhibit "A"; and WHEREAS, the County of Los Angeles Board of Supervisors as the lead agency under NEPA approved the Finding of No Significant Impact (FONSI) and published said Finding; and WHEREAS, Article 14 of the California Environmental Quality Act (CEQA) guidelines permits the use of NEPA Findings of No Significant Impact under two conditons: (1) that an EIS or Finding of No Significant Impact will be prepared before an EIR or Negative Declaration would otherwise be completed for the Project; and (2) that the EIS or Finding of No Significant Impact complies with the provisions of the CEQA guidelines; and WHEREAS, these conditions have been met for the Senior Citizen Project, and the City Council believes that the Finding of No Significant Impact meets the requirements of CEQA; and WHEREAS, the City Council gave public notice on October 3, 1984, that it intended to use the federal document (FONSI) in place of a Negative Declaration. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa as follows: Section 1. The City Council hereby adopts and certifies the Finding of No Significant Impact, attached hereto as Exhibit "A", in place of a Negative Declaration. Pursuant to Article 14 of the CEQA guidelines, the City Council finds that this Finding of No Significant Impact meets the requirements of CEQA and fulfills the City's responsibilities as lead agency. Section 2. A Notice of Determination shall be filed with the County Clerk of the County of Los Angeles. Section 3. The City Clerk shall certify the adoption of this Resolution. Background On May 24, 1984, your Board adopted the Tenth Year (1984-85) Community Development Block Grant (CDBG) application. The projects identified herein are consistent with the Cammmity Development objectives and Projected Use of Funds set forth in the CDFG application. It is requested that your Board return a Finding of No Significant Impact on the Environment and instruct the Executive Director of the CDC to order publication of the attached public notice in accord with NEPA regulations. CEQA: Adoption and publication of the attached Finding of No Significant Impact Prepared in compliance with NEPA regulations for these projects will satisfy applicable CEQA requirements as stated in Article At Section 15221. No further action is requested. County Counsel has reviewed the attachment. It has been determined that such request for release of funds will not constitute actions significantly affecting the quality of the human environment and accordingly the County of Los Angeles has decided not to prepare Environmental Impact Statements (EIS's) under the National Environmental Policy Act (NEPA) of 1969 (PL91-190) or to prepare Environmental Impact Reports (EIR's) under the California Environmental Quality Act of 1970, as amended. The reasons for the decision not to prepare EIS's or EIR's are as follows: The projects are not categorized as major actions significantly affecting the quality of the human environment, by reason of limited scope, and temporary nature of the limited, minor disruptions to be caused by construction activity. The projects are consistent with local policies and long-range plans; will affect no unique or significant natural features, animal, fish or plant life, archaeo- logical, cultural, historical, recreational or scenic sites; will not detrimentally affect air or water quality or ambient noise; public services beyond those presently available or proposed in the near future; will not have significant growth inducing impact; will not result in considerable cumulative impacts; will not achieve short term to the disadvantage of long term environmental goals; and have not generated major controversy. Environmental Review Records have been made, which document the environmental review of the projects and more fully set forth the reasons why EIS's and EIR's are not required. The Environmental Review Records are on file at the above address and are available for public examination and copying upon request between the hours of 8:00 a.m. and 5:00 p.m. No further environmental review of the projects are proposed to be conducted prior to the request for release of Federal funds. 11, 0( 0( All Interested Agencies, Groups and Persons Page 4 COMMENTS TO GRANT RECIPIENT All interested agencies, groups or individuals disagreeing with either of the two proposed actions arp. invited to submit written comments for consideration. Such comments must be received at the above address on or before October 11, 1984. All written comments received will be considered by the County of Los Angeles prior to forwarding the request for release of Federal funds to HUD. No action will be taken on the project prior to HUD's written authorization to use those funds. It is requested that those forwarding comments specify which of the proposed actions is being addressed. OBJECTIONS TO HUD The County of Los Angeles will undertake the projects described above with Block Grant funds from HUD under Title I of the HCDA of 1974, as amended. The County of Los Angeles is certifying to HUD that the County of Los Angeles and the Executive Officer, Clerk of the Board, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to project environmental review, decision-making and action, and that these responsibilities have been satisfied. The legal effect of the certification is that, upon its approval, Block Grant funds may be used and HUD will have satisfied its responsibilities under the NEPA of 1969. HUD will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases: (a) That the certification was not in fact executed by the Certifying Officer or other officer of the applicant approved by HUD; or (h) That applicant's environ- mental review record for the project indicates omission of a required decision, finding or step applicable to the project in the environ- mental review process. Objections must be prepared and submitted in accordance with the required procedures under 24CFR Part 58.75 of the Interim Regulations found in the Federal Register dated April 12, 1982. These regulations are available in the above named office of the County of Los Angeles. Objections may be addressed to: Environmental Clearance Officer, U.S. Department of Housing and Urban Development, 2500 Wilshire Boulevard, Los Angeles, California 90057. Objections to HUD on the release of funds on bases other than those stated in the previous paragraph will not be considered by HUD.
