HomeMy WebLinkAboutResolution No. 75830 6 RESOLUTION NO. 7583 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ADOPTING POLICIES INDICATING THE STEPS THAT WILL BE TAKEN, CONSISTENT WITH OTHER GOALS AND OBJECTIVES OF THE CDBG PROGRAM, TO MINIMIZE DISPLACEMENT OF PERSONS FROM THEIR HOMES AND NEIGHBORHOODS AND TO MITIGATE THE ADVERSE EFFECTS OF ANY SUCH DISPLACEMENT ON LOW- AND MODERATE -INCOME PERSONS WHEREAS, the City of Azusa has approved a Tenth Year CDBG Program; and WHEREAS, current federal regulations require the City to develop, adopt, and make public a statement of local policy indicating the steps to be taken, consistent with other goals of the CDBG Program, to minimize displacement of persons from their homes and neighborhoods and to mitigate the adverse effects of any such displacement on low- and moderate -income persons. WHEREAS, the City has developed a policy for addressing potential displacement of residences and businesses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa as follows: Section 1: The City Council hereby adopts the Displacement and Relocation Assistance Policy for the Community Development Block Grant Program attached hereto as "Exhibit All. Section 2: CDBG staff are hereby directed to make this policy available to the public, and in particular, to those persons or businesses being displaced. Section 3: The City Clerk shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this Bhday of October , 1984. I hereby certify that the foregoing Resolution was duly adopted by the City Council of the City of Azusa, at a regular meeting thereof, held on they day of October, 1984, by the following vote of the Council: AYES: COUNCILMEMBER: CRUZ, COOK, CAMARENA, LATTA, MOSES NOES: COUNCILMEMBER: NONE ABSENT: COUNCILMEMBER: N In the implementation of its CDBG Program, the City of Azusa makes every effort to minimize displacement of residences and businesses by acquiring vacant land and/or structures. In the event displacement is unavoidable, and determined to be necessary and appropriate to carry out community development activities, the City will comply with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (Uniform Act). This policy also establishes benefits to be provided to displacees not covered under the Uniform Act. Applicability This Displacement Policy applies to individuals, families, businesses, non-profit organizations and farm operations permanently displaced, as a result of CDBG-assisted activities. Such activities may include acquisition, demolition, substantial rehabilitation, or code enforcement (for residential displacement only). Relocation benefits will be provided when activities carried out by the City of Azusa or any other public or private sub -recipient of CDBG funds result in permanent and involuntary displacement. Notification Displacees shall receive ample written notice of the types and amounts of relocation assistance for which they may be eligible. The notice shall also indicate the basic conditions of eligibility and the procedures for obtaining payments. Relocation Assistance In the event that displacement occurs, the City will meet its relocation responsibilities through the use of its staff and consultants, supplemented by assistance from local realtors, social agencies, and civic organizations. Relocation assistance shall be made available to all displaced households in accordance with provisions of the non-discrimination and equal opportunity requirements of Federal Fair Housing Laws. It is -the City's objective that all displaced homeowners and tenants be relocated with a minimum of hardship in accommodations which are decent, safe, sanitary, and suitable to their individual needs; located in areas not less desirable than their current location in regard to public utilities and public and commercial facilities; and reasonably accessible to their places of employment; and priced within their financial means. The CIty anticipates few relocations, and will handle those which result from implementation of this program in an individual, ease -by -case manner. Services provided to eligible displacees shall include, but not be limited to: - Providing information on project' activities, rights, benefits, and options open to them. Families will be advised of their individual rights under the Federal Fair Housing Laws and provided with fact sheets on Equal Housing opportunities. - Maintaining liaison between displacees and agencies or firms with resources to assist them. - Locating, inspection, and evaluating accommodations for displacees. Residential owners and tenants will be provided with information on minimum housing quality standards under the Section 8 Existing Program, guidelines on inspecting units in meeting these standards, occupancy standards and Fair Market Rent limitations. - Assisting displacees in obtaining financing. - Assisting displacees in securing priority consideration for Section 8, public housing, or other housing assistance programs. - Making referrals to appropriate social, community, and welfare agencies. - Assisting eligible displacees to prepare claims for all relocation assistance payments to which they may be entitled. -2- Keeping records, maintaining files, and coordinating all relocation activities. Providing displacees with written) notice of this policy, the types of services available to them,and the amount of relocation assistance benefits for which they may be eligible. Payments will be those established by State and Federal guidelines. The current benefits are cited below under Relocation Compensation. City staff and consultants will be available to answer questions and provide information, and by their early involvement see that relocation proceeds with a minimum of hardship. Relocation Compensation for Displaced Households Under present law, the following relocation benefits may be available to homeowners and residential tenants displaced from their neighborhoods: Residential Owner Occupants: 1) Replacement housing payment, not to exceed $15,000. 2) Compensation for moving expenses - a maximum of $500 or actual expenses, whichever is less. Displacees must have owned and occupied residences for 180 days prior to involuntary displacement. Residential Tenants: 1) A maximum of $4,000 over a 4 -year period or rental differential subsidy over a 4 -year period, whichever is less. In lieu of this payment, relocation benefits may include downpayment assistance on a dollar -for -dollar matching basis. The City's contribu- tion may not exceed $4,000. 2) Compensation for moving expenses - a maximum of $500 or actual expenses, whichever is less. Displacees must have occupied residences for 90 days prior to involuntary displacement. -3- Relocation Compensation for Under present law, the following relocation benefits may be available to displaced businesses: Business Owner Occupants: 1) Compensation for actual moving expenses - no maximum. 2) Compensation for loss of goodwill, determined by a fair market value appraisal. 3) Other compensation, necessary and appropriate for the owner to relocate to a comparable building. Business Tenants: 1) Compensation for actual moving expenses - no maximum. 2) Compensation for loss of goodwill, determined by a fair market value appraisal. 3) Other compensation, necessary and appropriate for the occupant to relocate to a comparable building. Other Assistance r Assistance in locating comparable replacement accommodations is provided to all displacees. Temporary displacees may be eligible for relocation benefits; determination will be made on a case-by-case basis.
