A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A ZONE VARIANCE
TO SANMUKH BHAKTA FOR PROPERTY LOCATED
AT 666 EAST FOOTHILL BOULEVARD, AZUSA,
CALIFORNIA (VARIANCE CASE NO. V-846)
WHEREAS, Sanmukh Bhakta is the owner of the Stardust
Motel located at 666 East Foothill Boulevard, Azusa, California,
and has applied for a variance to allow a reduced side yard
of zero feet instead of the required ten feet under Azusa
Municipal Code Section 19.24.060 in order to add an area to
an existing motel;
WHEREAS, said property is zoned C-2;
WHEREAS, duly noticed public hearings on the zone
variance were held by the Planning Commission of the City of
Azusa on June 20, 1984, at which time the Planning Commission
after hearing all testimony granted the variance by adopting
Resolution 2025 and imposing six conditions upon the variance;
WHEREAS, on July 9, 1984, the applicant, Mr. Bhakta,
filed a notice of appeal to the City Council of the City of Azusa
from the Planning Commission's action in adopting Resolution
No. 2025;
WHEREAS, on August 6, 1984 and on September 17, 1984
the City Council of the City of Azusa held duly -noticed public
hearings on the variance request and Mr. Bhakta's appeal;
WHEREAS, in taking this action, the City Council con-
sidered the effects of the decision on the housing needs of
the region in which the City is located and balanced those
needs against the public service needs of the City residents
and available fiscal and environmental resources;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF AZUSA AS FOLLOWS:
SECTION 1. After careful consideration of all oral
and written evidence presented at the public hearings, the
City Council finds that:
A. Strict application of the provisions of the
Zonina Title of the Azusa Municipal Code will
result in practical difficulties and unnecessary
hardships for the subject property inconsistent
with the general purposes and intent of this
title in that due to construction of the motel
and adjoining office building under the old Code,
other development in the area is currently
located on or very near property lines making
applicant unable to utilize his property as a
result of the significant blocks of land that
would be unavailable for open space, and yet
totally enclosed by buildings.
B. There are exceptional circumstances or con-
ditions applicable to the subject property and
to the intended use for development of the sub-
ject property that do not apply generally to
other property in the same zone in that due to
construction of the motel and adjoining office
buildings under the old Code, other development
in the area is currently located on or near
property lines making it impossible for this
applicant to develop and expand the motel with-
out having large blocks of unusable open space;
C. The granting of the variance for the subject
property will not be materially detrimental to
the public welfare or injurious to the property
or improvements in the zone and neighborhood
in which the property is located and that most
other properties in the area are built to the,
property line;
D. The granting of the variance for the subject
property will be consistent with the General
Plan of the City of Azusa in that the conditions
of approval require the applicant to upgrade the
subject property to meet conditions of the com-
munity design element of the General Plan and,
further, that the costs of such construction
should bring the project into accord with the
community design element of the General Plan
are reasonable and not out of line in comparison
with the construction costs for the proposed
revision of the motel;
E. This project has been found to be categori-
cally exempt under the CEQA Guidelines as a
Class 1(e) exemption;
SECTION 2. The appeal of Zone Variance Case No. V-846
is hereby denied and Zone Variance V-846 is hereby approved
subject to the following conditions:
A. The construction shall comply with the plot
plan submitted;"
B. All necessary permits shall be obtained;
C. Any and all applicable Building Department
and Fire Department requirements shall be met
at all times;
D. The applicant shall obtain a precise plan
of design permit;
E. The applicant shall upgrade the subject
property to meet the requirements of the com-
munity design element of the General Plan
which shall include elimination of multi -
gabled roof and replacement with Spanish style
parapet, repainting of building using earth
tone colors, use of brick and rough -sawn lumber
for trim, use of heavy -textured front stucco,
use of red tile and tile cap on parapet, re-
working of roof line, providing of drainage to
the rear of building, facing columns with brick
and stucco, removing the sign advertising "RCA"
TV's, removing existing chain-link fence,

removing roses and miscellaneous flowers,
installing turf, removing and trimming tall
shrubs next to the building and replantinq
with low -growing flowering shrubs, planting
annual flowers in raised planters, and
eliminating miscellaneous plants around the
interior;
F. The total number of kitchens shall not
exceed ten.
SECTION 3. The City Clerk shall certify the adoption
of this resolution.
PASSED, APPROVED AND ADOPTED this 1st day of October ,
1984.
I HEREBY CERTIFY that the foregoing Resolution was
duly adopted by the City Council of the City of Azusa, at a
regular meeting thereof, held on the 1st day of October ,
1984, by the following vote of the Council:
