A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A CONDITIONAL USE
PERMIT TO MARY M. HILL FOR USE OF THE
PROPERTY LOCATED AT 1010 EAST ALFORD STREET,
AZUSA, AS A TRAINING FACILITY FOR THE DEVEL-
OPMENTALLY DISABLED FOR EIGHT CLIENTS
(CONDITIONAL USE PERMIT NO. C-327)
WHEREAS, Section 19.08.020(5) provides that rest
homes, homes for the aged or for children may be permitted
in the R zones upon a conditional use permit; I
WHEREAS, Mary M. Hill has applied to the City for
a conditional use permit for a training facility for the
developmentally disabled to accommodate up to eight (8) adult
women;
WHEREAS, on July 18, 1984, a duly -noticed public
hearing was held before the Planning Commission of the City
of Azusa on the application for the conditional use permit
at which time and after hearing public testimony on the matter,
the Commission voted to deny the application by virtue of a
tie vote, with three votes in favor and three votes against;
WHEREAS, the matter was appealed to the City Council
by a duly -noticed and timely appeal by the applicant;
WHEREAS, on September 4, 1984, a duly -noticed public
hearing was held before the City Council of the City of Azusa
pursuant to the appeal of Mary M. Hill, at which time public
testimony, both oral and written, was presented to the City
Council on the appeal and on the request for the conditional
use permit;
WHEREAS, the City Council of the City of Azusa hereby
finds and determines that:
A. The proposed conditional use permit is consis-
tent with the General Plan in that the area is designated
low-density residential by the General Plan;
B. The public necessity, convenience, welfare and
good zoning practice justify the issuance of the condi-
tional use permit requested in that:
1. The subject property is zoned R1 -c and has
been developed with a single-family residence
which is currently utilized as a training facility
for six (6) developmentally disabled adult women
and the applicant now wishes to utilize an additional
bedroom for this purpose expanding the facility to
eight (8) clients;
2. Applicant has operated the training facility
for a number of years in this residential neighbor-
hood with no negative reaction from the surrounding
neighbors and has, in fact, become an established
part of the community;
3. Applicant's property has been found by
state officials to be acceptable for the expansion
to eight clients;
4. The California Department of Social Services
Community Care Licensing Division has confirmed that
the applicant's facility is in excess of 300 feet
from any other licensed facility and is, therefore,
in conformance with Section 1520.5 of the California
Health and Safety Code;
5. The personal supervision and guidance of the
applicant, Mary M. Hill, is responsible for the facili-
ties compatability with the surrounding single-family
residential neighborhood and is responsible for the
ability of the facility to adequately handle up to
eight clients.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF AZUSA AS FOLLOWS:
SECTION 1. The appeal of Mary M. Hill on Conditional
Use Permit No. C-327 is hereby granted.
SECTION 2. Conditional Use Permit No. C-327,
Mary M. Hill, is hereby approved subject to the following condi-
tions:
A. Construction shall comply with the plot plan
submitted;
B. All necessary permits shall be obtained;
C. Any and all applicable Building Department and
Fire Department requirements.shall be met at all times;
D. The maximum number of clients residing at the
facility shall be limited to eight;
E. The applicant shall maintain the existing two -
car garage for parking purposes only at all times;
F. Mary M. Hill shall personally supervise the
operation of the facility and the care and supervision
of the clients residing therein, and in the event that
this condition is not complied with, the conditional
use permit shall become null and void unless it is duly
amended by procedures in accordance with applicable law
to substitute some other person in place of Mrs. Hill.
SECTION 3. The City Clerk shall certify the adoption
of this resolution.
