HomeMy WebLinkAboutResolution No. 7566RESOLUTION NO. 7566 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR CONDITIONAL USE PERMIT C-327 WHEREAS, an Initial Study of Environmental Impact and a Negative Declaration have been prepared for the proposed Conditional Use Permit No. C-327, Mary Hill, in accordance with the provisions of the California Environmental Quality Act and the State CEQA Guidelines; WHEREAS, a duly -noticed public hearing was held by the Planning Commission for the City of Azusa'on the 18th day of July, 1984, at which time evidence was heard on the proposed Conditional Use Permit and the Negative Declaration; WHEREAS, prior to approving the Conditional Use Permit, the City Council of the City of Azusa considered the Initial Study of Environmental Impact and the Negative Declara- tion together with any comments received during the public review process; WHEREAS, the City Council of the City of Azusa hereby finds and determines that on the basis of the Initial Study and any comments received in the public review process, there is no substantial evidence that the project will have a signifi- cant adverse effect upon the environment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AZUSA that the Negative Declaration for Conditional Use Permit No. C-327, Mary Hill, attached hereto as Exhibit "A" and by this reference incorporated herein, is hereby certified and approved and determined that this Negative Declaration shall be filed with the County Clerk of the County of Los Angeles. The City Clerk shall certify to the adoption of this Resolution. Description of Project and Address: Expansion of an existing training facility for the Developmentally Disabled from six (6) to eight (8) clients at 1010 E. Alford Street, Azusa, California 91702 5. Identification of Environmental Setting: The subject property is currently a training facility for six developmentally disabled adults located in a single-family residential neighborhood. The property is an interior lot of 6,000 square feet (approximately 100' X 601). The existing single-family building is of approximately 2100 square feet in size 'and has five bedrooms and a two -car garage. Applicant intends to utilize'the master bedroom for the purpose of adding two additional clients. -1- • CITY OF AZUSA • ASSESSMENT OF ENVIRONMENTAL IMPACT REPORT INITIAL STUDY A copy of the Initial Study for Public Works projects will be available to the public in the Azusa Public Works Department. A Copy of the initial study for the Planning Department projects will be in the Planning Department and the Public Library. Comments from the public on the projects may be made, in writing, to the respective department directors or at the public hearings for the projects. Project Description: Subject site is located at 1010 E. Alford Street and zoned Ric. The Azusa .Municipal Code does allow rest homes in the Ric (Single -Family Residential) zone with a Conditional Use Permit (Section 10.08.020(s] of the Azusa Municipal Code). According to state law (Lanterman-Petris-Short Act, Welfare and Institution Code Sections 5000 et seg), municipalities have no jurisdiction over rest homes of six or less patients. Applicant wishes to expand from six to eight clients and is therefore requesting a conditional use permit. II. DETERMINATION (To be completed by the Lead Agency) On the basis of this initial evaluation: I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL 13E PREPARED. I find the proposed project MAY have a significant effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
