A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA VACATING A WATERLINE EASEMENT
IN A PORTION OF LOT 43 OF SUBDIVISION NO. 2,
AZUSA LAND & WATER COMPANY
THE CITY COUNCIL OF THE CITY OF AZUSA RESOLVES AS
FOLLOWS:
SECTION 1. The City Council does hereby find, determine,
and declare that:
A. This Resolution is adopted pursuant to the provi-
sions of Streets & Highways Code Section 8330, et seq
which provides for the summary vacation of certain
public service easements;
B. The easement to be vacated by this Resolution is
specifically described and set forth on Exhibit "A,"
which is attached hereto and incorporated herein as
though set forth in full (hereinafter referred to as
the "Easement");
C. The Easement has not been used for the purposes
for which it was dedicated or acquired for a period
of five consecutive years immediately preceding the
adoption of this Resolution;
D. There is no need for an easement for pipeline
purposes where the Easement is located.
SECTION 2. The Easement and the facilities which are
a part thereof, consisting of a water :gain and vault containing
a meter and valve, is hereby vacated, and from and after the date
this Resolution is recorded, the Easement and facilities thereon
shall no longer constitute a public service easement.
SECTION 3. In connection with the vacation of this
Easement, the City Council hereby approves the quitclaim deed
of the Easement and facilities thereon to Herman P. Hommerson,
in substantially the form set forth on Exhibit "B," attached
hereto and incorporated herein as though set forth in full, and
further authorizes the Mayor to sign said quitclaim deed on behalf
of the City.
SECTION 4. Pursuant to the provisions of Section 8336
of the Streets & Highways Code, the City Clerk shall cause a
certified copy of this Resolution of vacation, attested by the
Clerk under seal, to be recorded without acknowledgment, certi-
ficate of acknowledgment, or further proof in the Office of the
Recorder of Los Angeles County, and no fee shall be charged for
such recordation. Upon such recordation, the vacation is
complete.
PASSED, APPROVED AND ADOPTED this 6th day of May ,
1985.

I HEREBY CERTIFY that the foregoing Resolution was
duly adopted by the City Council of the City of Azusa, at a
regular meeting thereof, held on the 6th day of May ,
1985, by the following vote of the Council:

EXHIBIT "A"
An Easement of Azusa Agricultural Water Company, for
pipe lines as contained in the deed recorded in Book
9690, Page 45, Official Records of that portion of
lot 43 of Subdivision No. 2 Azusa Land and Water Company
as per map recorded in Book 43, page 94, miscellaneous
records of said County, described as follows: Beginning
at a point in the south line of Foothill Blvd., 100
feet wide, distant south thereon 89° 51 20" west
216.37 Feet from the northwest corner of lot 38 of
Tract No. 13790 as per map recorded in Book 275, pages
46 and 47 of maps, in the office of the County Recorder
of said County; thence south 0° 25' 10" east 240 feet;
thence south 89° 51' 20" west parallel with said
southerly line of Foothill Blvd., 90 feet; thence
north 0° 25' 10" west 240.00 feet to the southerly
line of Foothill Blvd., thence north 00 25' 10" west
240.00 feet to the southerly line of Foothill Blvd.,
thence north 89° 51' 20" east along the southerly line
of Foothill Blvd. 90 feet to the point of beginning.
Pipes were located on West Side of lot extending the
full 240 ft of lot length and being 10' wide.
