HomeMy WebLinkAboutResolution No. 76970 0 RESOLUTION NO. 7697 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA INITIATING PROCEEDINGS FOR REORGANIZATION PURSUANT TO THE MUNICIPAL REORGANIZATION ACT OF 1977 -- "EASTERLY ANNEXATION DISTRICT 87" TO THE CITY OF AZUSA. WHEREAS, a resolution of application for the proposed reorganization involving annexation to the City of Azusa and Los Angeles County of certain territory, was filed by the City Council of the City of Azusa with the Executive officer of the Local Agency Formation Commission pursuant to the Municipal Organization Act of 1977 (Part 2, commencing with Section 35000, of Division 2 of Title 4 of the Government Code): and, WHEREAS, the Local Agency Formation Commission on October 10, 1984, approved the reorganization, designating the City Council of the City of Azusa as the conducting authority, and directing the Council to initiate reorganization proceedings; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. Preliminary proceedings for the reorganization of the territory described in Exhibit "A", attached hereto and incorporated herein, were commenced by resolution of application by the City Council of the City of Azusa. 2. The territory has been determined by the Local Agency Formation Commission to be uninhabited and said territory has been given the following short term designation: "Easterly Annexation District 87" to the City of Azusa. 3. The reasons for the proposed reorganization, as set fosrth in the proposal by the City Council of the City of Azusa, are: (a) the area in question is within the sphere of influence of the City of Azusa as adopted by the Local Agency Formation Commission in 1975; (b) the proposal is a logical expansion of the boundaries of the City of Azusa; (c) the property owners within the annexation area have requested this annexation. 4. The proposed reorganization was approved by the Local Agency Formation Commission on October 10, 1984, subject to the following conditions: a. A preannexation Development Agreement be approved by the City of Azusa and Monrovia Nursery Company, and b. An agreement be approved by the affected parties to ensure that Monrovia Nursery Company will not be liable for any sewer assessment so long as Monrovia Nursery does not utilize said sewer. 5. A Hearing on the proposed reorganization is set for JUNE 17, 1985 (not less than 30 days nor more than 45 days from this date(, at 7:30 P.M., in the Civic Auditorium, 213 E. Foothill Blvd., Azusa, California. 6. Any interested person desiring to make written protest against the reorganization should do so by written communication filed with the City Clerk of the City of Azusa, 213 E. Foothill Blvd., Azusa, California, not later than the hour set for hearing.
