RESOLUTION NO. 7678
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA APPOINTING MRS. ALICE WILLIAMS
TO THE LIBRARY COMMISSION.
THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE
AS FOLLOWS:
SECTION 1. MRS. ALICE WILLIAMS having been appointed
to the Library Commission by the Mayor and said appointment having been
consented to by the City Council, said appointment is hereby approved and
MRS. ALICE WILLIAMS is appointed to the Library Commission for the term
expiring JUNE 30th, 1985.
SECTION 2. The City Clerk shall certify to the adoption
of this resolution and shall transmit a certified copy thereof to MRS. ALICE
WILLIAMS.
ADOPTED AND APPROVED this 18th day of March, 1985.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, CALIFORNIA, SUPPORTING AND
RECOMMENDING THE AMENDMENT OF INSURANCE CODE
SECTION 533, EVIDENCE CODE SECTION 352 AND
GOVERNMENT CODE SECTIONS 825 and 990 AS
THEY CONCERN PUNITIVE DAMAGES.
WHEREAS, plaintiffs in lawsuits instituted against public officials
and employees are increasingly seeking punitive damages knowing that because
such officers and employees are personally liable, there is greater pressure
towards settlement of the litigation even where such claims are not well
founded, and
WHEREAS, there are instances where punitive damages have been awarded
by juries against public officials and employees principally because such persons
are perceived to be unpopular defendants, and
WHEREAS, juries have awarded punitive damages against public officers
because relevant but prejudicial evidence was excluded at trial and the juries
were not apprised of all the facts and it is believed that the admission of
all relevant evidence at a trial wherein punitive damages are sought would help
prevent any unjust award of punitive damages against public employees, and
WHEREAS, it is believed that municipalities should have the authority
to either pay for or insure their employees against punitive damages, and
WHEREAS, awards of punitive damages do constitute disincentives to
qualified persons to enter or remain in the public service and is therefore
contrary to the interests of all citizens of this State.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES
HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
SECTION 1. That it does support and recommend that Insurance Code
Section 533, Evidence Code Section 352 and Government Code Sections 825 and
990 as they concern punitive damages be amended to read as follows:
INSURANCE CODE SECTION 533.
§ 533. Wilful act of insured; negligence
An insurer is not liable for a loss caused by the wilful act of the
insured; but he is not exonerated by the negligence of the insured, or
of the insured's agents or others. Nothing contained herein is intended
to Drohibit an insurer from insuring an insured and its emDlovees and
agents against a claim or judgment for exemplary or punitive damages.
EVIDENCE CODE SECTION 352.
§ 352. Discretion of court to exclude evidence. The court in its dis-
cretion may exclude evidence if its probative value is substantially outweighed
by the probability that its admission will (a) necessitate undue consumption
of time or (b) create substantial danger of undue prejudice of confusing
the issues, or of misleading the jury.
Notwithstanding the foregoing provisions of this section, the court
shall have no discretion and shall not exclude anv relevant evidence
damages or (b) seeking any damages against a peace officer for acts
performed in the course and scope of his or her employment as a peace officer.

GOVERNMENT CODE SECTION 825.
§ 825. Request for defense or defense by public entity; payment of
judgment, compromise or settlement; agreement with employee; reservation of
rights; memorandum of understanding.
If an employee or former employee of a public entity request the public
entity to defend him against any claim or action against him for an injury
arising out of an act or omission occurring within the scope of his employment
as an employee of the public entity and such request is made in writing not
less than 10 days before the day of trial, and the employee or former
employee reasonably cooperates in good faith in the defense of the claim or
action, the public entity shall pay any judgment based thereon or any
compromise or settlement of the claim or action to which the public entity
has agreed.
If the public entity conducts the defense of an employee or former
employee against any claim or action with his reasonable good faith cooperation,
the public entity shall pay any judgment based thereon or any compromise or
settlement of the claim or action to which the public entity has agreed;
but, where the public entity conducted such defense pursuant to an agreement
with the employee or former employee reserving the rights of the public
entity not to pay the judgment, compromise or settlement until it is
established that the injury arose out of an act or omission occurring within
the scope of his employment as an employee of the public entity, the public
entity is required to pay the judgment, compromise or settlement only if it
is established that the injury arose out of an act or omission occurring
in the scope of his employment as an employee of the public entity.

If the provisions of this section are in conflict with the provisions
of a memorandum of understanding reached pursuant to Chapter 12 (commencing
with Section 3560) of Division 4 of Title 1, the memorandum of understanding
shall be controlling without further legislative action, except that if
such provisions of a memorandum of understanding require the expenditure of
funds, the provisions shall not become effective unless approved by the
Legislature in the annual Budget Act.
GOVERNMENT CODE SECTION 990.
§ 990 Authority to insure generally.
Except for a liability which may be insured against pursuant to Division
4 (commending with Section 3200) of the Labor Code, a local public entity may:
(a) Insure itself against all or any part of any tort or inverse
condemnation liability.
(b) Insure any employee of the local public entity against all or any
part of his liability for injury resulting from an act or omission in the
scope of his employment.

(c) Insure, contract or provide against a claim or the expense of
defending a claim against the local public entity or its employee, whether
or not liability exists on such claim, including a claim for damages under
Section 3294 of the Civil Code or otherwise for the sake of example or by
way of punishment, where such liability arose from an act or omission in
the scope of his employment, and an insurance contract for such purpose is
valid and binding notwithstanding Section 1668 of the Civil Code, Section
533 of the Insurance Code, or any other provision of law.
(d) A hospital district may participate in a reciprocal or inter -
insurance exchange with the members of its medical staff as provided in
Section 1284 of the Insurance Code.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA APPROVING THE SPEED ZONE SURVEY
CONDUCTED BY THE STATE OF CALIFORNIA DEPART-
MENT OF TRANSPORTATION ON ROUTE 39 AND SAN
GABRIEL CANYON ROAD
WHEREAS, the City of Azusa requested a Speed Zone Survey
by the California State Department of Transportation in order to update
the previous Speed Zone Survey, in view of changes to the City Limits,
as well as concern for adequacy of speed limits for the area inclusive
of San Gabriel Canyon Road, from Sierra Madre Avenue to the Azusa City
Limits, and, San Gabriel Avenue.
WHEREAS, speed checks were taken on January 25 and 30, 1985.
Based upon their measurement results, the California State Department of
Transportation, Traffic Operations Branch, has provided the City of Azusa,
with a speed zone survey report, in which Section IV furnishes conclusions
and recommendations. The cited report is attached as an enclosure to
this resolution.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Azusa, by the adoption of this resolution, accepts the traffic
speed limits as therein specified, and directs that all necessary amendments
be made where required in order to properly amend specific city traffic
laws in accordance with the recommendations of the California Department
of Transportation.

OF AZUSA AMENDING THE JOB SPECIFICATIONS FOR
PARK MAINTENANCE CREW SUPERVISOR
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The job specifications for the classification
of Park Maintenance Crew Supervisor are hereby amended to read in
accordance with Exhibit A attached hereto and incorporated herein
by reference.
SECTION 2. This Resolution shall become effective
immediately.
SECTION 3. The City Clerk shall certify to the adoption
of this Resolution.

PARR MAINTENANCE CREW SUPERVISOR
(exhibit A)
To assume substantial responsibilities for the daily supervision of assigned park mainte-
nance personnel generally working in multiple small crews; to perform tasks requiring
specialized knowledge in horticulture or related park maintenance areas; to perform a
variety of semi -skilled and skilled gardening and turf maintenance duties in the develop-
ment, maintenance, and repair of landscaped areas, parks, playgrounds, and public facili-
ties; to operate a variety of park maintenance equipment; and to participate in the beauti-
fication of parks, playgrounds, and public facilities.
DISTINGUISHING CHARACTERISTICS
This is an advanced journey and supervisory class inthe Park Maintenance Worker class
series. Positions in this class exercise daily supervision over assigned personnel and
coordinate the work of multiple small crews. The Crew Supervisor assists the Park
Maintenance Supervisor with administration of the Park Maintenance section.
SUPERVISION RECEIVED AND EXERCISED
Direction is provided by the Park Maintenance Supervisor.
Responsibilities include functional supervision over assigned personnel.
EXAMPLES OF DUTIES -- Duties may include, but are not limited to, the following:
Supervise and coordinate the work of assigned crew personnel.
Provide training to assigned personnel.
Evaluate the maintenance needs of assigned park areas; initiate responsive actions.
Assist with the administration of the Park Maintenance section; order supplies, keep
time cards and records, prepare reports, schedule vacations, assist with employee
performance evaluations.
Respond to public inquiries and complaints.
Maintain plantings and grounds, recreation and play areas and irrigation systems.
Water, weed, trim, renovate, fertilize, and perform limited mowing of laws, shrubs, trees,
and flower beds.
Rake leaves, clean walks, fields, courts, and other facilities; load trimming on trucks.
Spade and otherwise cultivate ground around plants and shrubs, including mixing and apply-
ing fertilizers, insecticides, and herbicides.
Plant and maintain trees, flowers, and shrubs.
Pick up rubbish and paper; perform general grounds cleaning.
Perform minor routine maintenance on sprinklers and irrigation equipment.
Operate small power mowers, edgers, sprayers, and other equipment.
Drive vechicles used to transport materials, tools, and equipment as required.

Assist in moving and installing park and recreational equipment such as bleachers,
backstops, and playground equipment.
Assist and train less experienced personnel.
Respond to inquiries from the general public.
Perform building maintenance duties such as painting, light carpentry, light plumbing,
and other tasks.
Repair fences, tree stakes. playground equipment, and other parks facilities.
Prepare ground for concrete or asphalt work; assist with this work.
Control weeds.
Perform related duties as assigned.
QUALIFICATIONS
Knowledge of:
Advanced horticultural.principles and techniques.
Supervisory and training techniques.
Plant and turf pests and diseases; methods for their control and eradication.
Proper and effective use of landscape maintenance tools, equipment and materials.
General carpentry, plumbing, painting, and masonry work; concrete and asphalt work.
Mechanics of irrigation and sprinkler systems.
Proper pruning methods.
Watering, fertilizing, and spraying of plants, turf, and trees.
Purposes and uses of a variety of equipment and tools used in parks maintenance.
Safety precautions in the use and maintenance of power mowers and other equipment.
Ability to:
Supervise the work of others; provide training to new and journey level personnel.
Keep records accurately and neatly; prepare clear and concise reports; assist with
administrative duties.
Evaluate the condition and maintenance needs of assigned areas.
Operate a variety of light and heavy equipment, including mowers.
Perform a variety of building maintenance tasks including carpentry, plumbing, and
masonry.

Competently care for plants, shrubs, turf, and trees; properly water, fertilize,

Operate and repair vehicles, equipment, and power tools; repair fences, playground
equipment, and other facilities.
Perform light carpentry, plumbing, and masonry work; pour concrete and lay asphalt.
Perform specialized horticultural tasks in the maintenance and care of plants,
shrubs, turf, and trees.
Experience and Education
Any combination of experience and education that would likely provide the required
knowledge and abilities is qualifying. A typical way to obtain the knowledge and
abilities would be:
Experience: Two years of significant experience similar to the duties assigned
to a Park Maintenance Worker III.
Education: Equivalent to completion of specialized park maintenance and
training.
License or Certificate
Possession of a valid California's driver's license.

THE CITY OF AZUSA COMMENDING TONY POLI
FOR HIS SERVICES TO THE CITY
WHEREAS, ANTHONY POLI entered into City employment on October 3, 1978,
and is leaving April 18, 1985, and
WHEREAS, throughout his period of employment he has consistently
displayed the unflagging devotion to duty that remarks an
exemplary employee, and
WHEREAS, Azusa is located in a semi -arid land, where water is a resource
requiring careful and knowledgeable management. This was quietly
and efficiently provided by TONY in his capacity as Water Utility
Superintendent, a fact that perhaps caused most of the local
consumers to take the ready availability of water for granted,
not realizing all that is required to make that dependable
availability possible, and
WHEREAS, that his successor will be hard pressed to continue to maintain
the superior service provided by TONY POLI is a foregone
conclusion. It can only be hoped that he or she can enjoy the
good fortune of equalling the level of service provided by TONY.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AZUSA, to
collectively extend its commendation to
ANTHONY POLI
and to express its appreciation for a job well done; further to wish him
every success in his future.
