RESOLUTION NO. 7751
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A ZONE VARIANCE
(VARIANCE CASE NO. V-862, NICHOLAS GABRIEL,
810 SOUTH CITRUS AVENUE)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa does
hereby find, determine and declare that:
A. There has been filed with the Planning Department
the application of Nicholas Gabriel requesting a
variance to allow a 10 -foot front yard setback which
is less than the 15 feet required by Section 19.16.060(1)
of the Azusa Municipal Code (Variance Case No. V-862).
B. A duly noticed public hearing was held on said
application before the Planning Commission on May 22,
1985, at which time the Planning Commission adopted
Resolution 2159 denying the variance request.
C. Thereafter, a duly and timely filed appeal of the
action of the Planning Commission was submitted to the
Council and a duly -noticed public hearing on said appeal
was held before the City Council on July 1, 1985.
D. Evidence having been received at the public hearing
from the City and the applicant, the Council specifically
finds that:
(1) Strict application of the provisions of
the Zoning Title of the Azusa Municipal Code
will result in practical difficulties or un-
necessary hardships for the subject property
inconsistent with the general purposes and
intent of this title in that the subject
property would be the only one in the vicinity
to have a required 15 -foot setback.
(2) There are exceptional circumstances or
conditions applicable to the subject property
and the intended use for the development of
the subject property that do not apply
generally to other property in the same zone
in that the property is zoned for high-density
residential and yet is generally surrounded
by commercial properties fronting onto Citrus
Avenue.
(3) The granting of the variance for the
subject property will not be materially
detrimental to the public welfare or injuri-
ous to the property or improvements in the
zone or neighborhood in which the property
is located in that the conditions of approval
will eliminate concern about the reduced
setback area.
(4) The granting of the variance for the
subject property will be consistent with
the General Plan of the City in that the
General Plan designates the area as high-
density residential.
(5) In taking this action the City Council
considered the effects of the decision on
the housing needs of the region in which
the City is located and balanced those
needs against the public service needs of
the City residents and available fiscal
and environmental resources.
SECTION 2. The appeal of Zone Variance Case No. V-862
is hereby granted and Zone Variance V-862 is hereby approved
allowing the subject property to have a front yard setback of
ten (10) feet.subject to the following conditions:
A. All necessary permits shall be obtained.
B. Any and all applicable Building Department
and Fire Department requirements shall be met at
all times.
C. A revised plot plan shall be submitted to the
Department and an approved precise plan of design
application shall be obtained.
D. An approved design review application shall
be obtained.
E. At least 400 square feet of useable open space,
as defined by Section 19.16.090 of the Azusa Municipal
Code, shall be provided for each residential unit.
F. An adequate trash enclosure shall be provided
and maintained at all times. Such an enclosure
shall be fully screened from public view by means
of decorative masonry walls served by solid, full -
height gates. Said gates shall also be maintained
in good and operating repair at all times. The
storage of any and all trash other than in the
trash storage area or higher than the screened
walls around the said area is absolutely prohibited.
G. The premises shall be maintained in a clean
and acceptable condition at all times. All buildings
and walls shall be maintained in good repair at all
times. Any offensive markings shall be removed
immediately.
H. A planting list and irrigation plan shall be
submitted and approved by the Parks Division showing
the location and size of all planting areas, irriga-
tion plans and types of plants to be used.
I. Landscaping shall be adequately maintained at
all times, including, but not limited to, irriga-
tion, weeding, and/or replacement when necessary.
SECTION 3. The City Clerk shall certify the adoption
of this resolution.

I HEREBY CERTIFY that the foregoing Resolution was

regular meeting thereof, held on the 15thday of July 1985,
