HomeMy WebLinkAboutResolution No. 7723RESOLUTION NO. 7723 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING CERTAIN POLICE EQUIPMENT SURPLUS AND OF CERTAIN MARKET VALUE AND AUTHORIZING THE SALE OF SUCH EQUIPMENT TO POLICE AGENCIES IN MEXICO WHEREAS, the City Council of the City of Azusa finds and determines that the police equipment described in Exhibit "A", attached hereto and incorporated herein by reference, can no longer be used by the Azusa Police Department nor any other city department because of its excessive wear and obsolescence; WHEREAS, the City Council of the City of Azusa finds and determines that the said equipment has a certain limited market value or resale value as set forth on Exhibit "A" and that the quality and wear of the equipment makes it obsolete and below standards not only for the Azusa Police Department but for other police departments in the United States and California so that none of these departments would purchase it and that police agencies in Mexico need to purchase this type of equipment; WHEREAS, Government Code Section 37110 authorizes the City to expend money for promotion of the City and specifically authorizes the expenditure of funds for sister city and town affiliation programs provided that such expenditures do not exceed five (5) percent of the monies accruing to the City's general fund during the fiscal year; WHEREAS, the City Council finds and determines that the sale of the said surplus police equipment described in Exhibit "A" to police agencies in Mexico at the designated price will foster positive relationships between the citizens of the United States and Mexico and specifically between the citizens of Azusa and the citizens of the various jurisdictions in Mexico accepting the equipment and that the sale under these circumstances will also improve relationships between the Azusa Police Department and the police departments in Mexico where such good relationships are essential for solving crimes within each of the jurisdictions and thereby the sale serves an important public purpose; WHEREAS, the City Council has determined that the sale price for the equipment is the fair market value of the equipment set forth on Exhibit "A"; however, in the event such price is determined not to be the fair market value, the difference would constitute a donation justified and authorized by Government Code Section 37110 for the reasons set forth herein; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa that on the basis of the above- described findings, the City Council hereby authorizes the Chief of Police to sell the police equipment described in Exhibit "A", or portions thereof, to the State of Baja California, Mexico for use by its law enforcement agencies at the fair market value of such equipment as established and set forth on Exhibit "A".
