A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA GRANTING A VARIANCE TO RELCO INDUSTRIES/LARRY
SADE AT A PROPOSED SENIOR CITIZENS COMPLEX ON
PROPERTY LOCATED AT 450 NORTH SOLDANO AVENUE
(VARIANCE CASE NO. V-889)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. There has been filed with the Planning
Commission of the City of Azusa the application of
Relco Industries/Larry Sade requesting a variance
in relation to the construction of an 168 -unit
senior citizens apartment complex on the subject
property. The following requests were made: (1) to
reduce parking to 122 spaces (252 required, Section
19.48.030[2) of the Municipal Code), (2) to
substitute open spaces and carports for garages,
(3) to reduce guest parking to 25 spaces (42
required by Municipal Code), (4) to reduce open
space to 40,000 square feet (67,200 square feet
required, Section 19.16.090 of the Municipal Code),
and (5) to reduce unit sizes to 521 and 747 square
feet for one -bedroom and two bedroom units,
respectively (650 and 800 square feet required,
Section 19.16.020[2) of the Municipal Code).
B. The subject property is generally described as
450 North Soldano Avenue, Azusa, California and is
legally described as: Lots 1-24 Inclusive, Block 49
of Azusa, Per Map recorded in Book 15, Pages 93 of
Miscellaneous Records, in the City of Azusa, County
of Los Angeles, State of California, and as shown
on a map on file with the City Clerk.
C. The application for the variance was duly
initiated, and notice of public hearings thereon
before the Planning Commission and City Council
were duly given and published in accordance with
applicable law.
D. In connection with said public hearings,
Environmental Impact Report No. 86-1 was considered
regarding the proposed variance and other City
approvals.
E. Public hearings thereon were duly held by the
Planning Commission of the City of Azusa on July 9,
1986, and by the City Council of the City of Azusa
on August 4, 1986, continued to August 18, 1986 and
September 2, 1986.
F. On July 9, 1986, the Planning Commission of
the City of Azusa by Resolution No. 2343 voted to
grant the variance for the subject property,
subject to eleven (11) conditions.

G. Thereafter, the applicants duly filed a notice
of appeal with the City Clerk within the time
required by law for such appeal, appealing the
imposition of Condition No. 11, which required
transportation to be provided to the residents of
the proposed project to shopping areas and other
appropriate locations.
H. The City Council has considered all of the
information presented to it at the public hearings
held on the variance.
SECTION 2. The City Council of the City of Azusa,
after careful consideration of the evidence presented to it,
does hereby approve said variance V-889 based upon the
following findings:
A. Strict application of the provisions of the
Zoning Title of the Azusa Municipal Code will
result in practical difficulties or unnecessary
hardships for the subject property inconsistent
with the general purposes and intent of this Title
in that the subject property is proposed for
development as senior citizens housing, which has a
distinctly different set of development standards
from other multi -family residential housing.
B. There are exceptional circumstances or
conditions applicable to the subject property and
to the intended use for development of the subject
property that do not apply generally to other
properties in the same zone in that the size,
configuration and topography of the project site is
such that less open space is required, that other
projects in the area allow for carports in place of
fully enclosed garages for apartment units, that
the use of the subject property as a senior
citizens facility will require smaller unit sizes
and less open space since seniors prefer having
less building area and open space to maintain and
since more open space is located nearby as part of
community recreation area, and that fewer parking
spaces are required since the subject property is
located proximal to amenities desired by senior
citizens and that said senior citizens will also be
able to take advantage of public transportation.
C. The granting of the variance for the subject
property will not be materially detrimental to the
public welfare or injurious to the property or
improvements in the zone or neighborhood in which
the subject property is located in that the
conditions of approval will eliminate any potential
effects of the variance upon the surrounding area
and, specifically that the Final Environmental
Impact Report for the subject property indicates
that no significant adverse impacts are
anticipated.
D. The granting of the variance for the subject
property is consistent with the General Plan of the
City of Azusa and each of its elements and there
are no master plans applicable to the subject
property.

E. In accordance with the Housing Element of the
General Plan, the City is desirous of fostering the
development of adequate and reasonably priced
housing within its jurisdiction for persons fifty-
five (55) years of age or older and is desirous of
partially meeting this need by permitting these 168
rental housing units oriented towards a market
embracing this age group. Recognizing that rental
costs to the intended class of tenants can be
substantially reduced from those generally
available by reducing the normal requirements for
parking, and cognizant that a substantial number of
people in said age bracket do not own automobiles,
City proposes to grant this variance.
Contemporaneously, the Applicants have made certain
representations to abide by the intent of this
variance in managing and operating said rental
housing units.
F. In taking this action the City Council has
considered the effects of its decision on the
housing needs of the region in which the City is
located and has balanced those needs against the
public service needs of the City's residents and
available fiscal and environmental resources.
SECTION 3. The approval of this variance for the
subject property is made subject to the applicants'
compliance with the following conditions of approval:
A. Construction shall comply with the plot plan
submitted.
B. All necessary permits shall be obtained.
C. Any and all applicable Building Department and
Fire Department requirements shall be met at all
times.
D. Applicants shall obtain an approved Precise
Plan of Design and Design Review applications for
the proposed project.
E. Exterior of all buildings shall be redesigned
in Spanish style to the satisfaction of the
Planning Division.
F. The proposed plot plan shall be rotated 180
degrees with respect to the street system to allow
better off-site circulation.
G. All on-site parking spaces shall be assigned
to.individual units within 150 feet of each space.
H. A landscaping plan shall be submitted for
approval to the Parks Division indicating location
and type of plants and irrigation system.
I. All other development standards for
apartments, including, but not limited to, trash
enclosures, driveway and parking dimensions,
setbacks and distance between buildings, shall be
met.

J. A management agreement regarding the use,
operation and maintenance of the proposed project
shall be approved by the City Council.
SECTION 4. The City Clerk shall certify the
adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 6th day of
October , 1986.
I HEREBY CERTIFY that the foregoing Resolution was
adopted by the City Council of the City of Azusa, at a
regular meeting thereof, held on the 6th day of
October , 1986, by the following vote of the Council:
