HomeMy WebLinkAboutResolution No. 8043RESOLUTION NO. 8043 (6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTABLISHING A BENEFIT REIMBURSEMENT AREA ON SAN GABRIEL CANYON ROAD AND APPROVING A REIMBURSEMENT AGREEMENT BETWEEN THE CITY AND THE CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. The benefit reimbursement area and reimburse- ment agreement between the City and the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter Day Saints (hereafter "Church") is established and approved pursuant to the provisions of Government Code Section 66485, et seq., Govern- ment Code Section 50140, et seq., and other appli- cable law. B. Plans for construction and installation of 1,600 feet of storm drain on North San Gabriel Canyon Road northerly of Elsworth Street in the City of Azusa, as shown on the map attached hereto as Exhibit "A" (hereafter "Storm Drain"), have been submitted to and approved by the City Engineer and are on file in the Office of the City Engineer. C. The Storm Drain has been designed with supple- mental length and capacity to accommodate storm and surface waters on and near the properties described on the Schedule of Reimbursement, Exhibit "B," which is attached hereto and incorporated herein by reference. Once dedicated to the public, the Storm Drain will benefit the properties described on Exhibit "B." D. The Storm Drain with its supplemental capacity and length is required to be installed and construct- ed by the Church and dedicated to the public as a condition of approval of its Parcel Map and Precise Plan of Design. E. The Schedule of Reimbursement for the Storm Drain project, Exhibit "B," is a fair and reason- able apportionment of the costs of the project to be reimbursed to the Church by the benefitted property owners based upon the area of said bene- fitted properties on San Gabriel Canyon Road. F. A fair rate of return on monies advanced by the Church for construction and installation of the Storm Drain is seven (7) percent per year. G. This action of the City Council implements the conditions of approval of the Parcel Map and Precise Plan of Design for which a Negative Declaration of Environmental Impact was approved. The Negative Declaration and Initial Study attached thereto (9 considered the Storm Drain project which is the subject of this Resolution and the Reimbursement Agreement and no new information or substantial changes in the Project have occurred to warrant further CEQA action. The City Council reviewed and considered this information prior to taking action on this Resolution. H. The owners of the properties described on Exhibit "B" were given reasonable notice of the time and place and the Council's consideration of this Resolution and were offered the oppor- tunity to address the Council on this issue. The Council carefully reviewed all comments received from the owners prior to adopting this Resolution. SECTION 2. The City Council of the City of Azusa hereby approves the plans and specifications on file in the Office of the City Engineer for the Storm Drain. SECTION 3. The City Council hereby approves the Schedule of Reimbursement for the benefitted properties, Exhibit "B," and orders that if and when development of said properties requires surface and storm water mitigation measures and payment of the reimbursement amount can be made a valid and enforceable condition to such development, the owners be required to pay their fair share of the Storm Drain costs as set forth on Exhibit "B." SECTION 4. The City Council hereby approves that certain agreement entitled "Storm Drain Reimbursement Agreement By and Between the City of Azusa and the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter Day Saints" and authorizes the Mayor Pro Tem to execute said agreement on behalf of the City in substantially the form attached hereto as Exhibit "C." SECTION 5. The City Clerk shall certify the adoption of this resolution. PASSED, APPROVED AND ADOPTED this 2nd day of June , 1986.
