HomeMy WebLinkAboutResolution No. 80170 0 RESOLUTION NO.8017 A RESOLUTION OF THE CITY OF AZIISA APPROVING AN INITIAL STUDY AND FINDING AND DETERMINING THAT A SUBSEQUENT ENVIRONMENTAL IMPACT REPORT NEED NOT BE PREPARED FOR THE PROPOSED SALE OF CERTAIN REAL PROPERTY IN THE AZIISA CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT. WHEREAS, the Redevelopment Agency of the City of Azusa (the "Agency") has prepared an Initial Study of the environmental impacts of the proposed Disposition and Development Agreement (the "Agreement") by the Agency with Rogers Toyota Incorported, and WHEREAS, said Initial Study conforms to the requirements of the California Environmental Quality Act of 1970 (Public Resources Code, Section 21000 et seq.), the "Guidelines for the Implementation of the California Environmental Quality Act of 1970", as amended, adopted by the Secretary for Resources of the State of California, and the Procedures for Implementation of the California Environmental Quality Act of 1970 adopted by resolution of the Agency; and WHEREAS, the Agency has made available copies of said Initial Study for public review and comment according to and in the manner as required by law. NOW, THEREFORE, the City Council of the City of Azusa does resolve as follows: SECTION 1. The City Council hereby approves and adopts the Initial Study with respect to the proposed Agreement between the Agency and Rogers Toyota Incorporated. SECTION 2. The City Council hereby certifies that the information contained in the Initial Study and in the Final Environmental Impact Report on the project has been reviewed and considered by the members of the Ctiy Council. SECTION 3. The City Council hereby finds and determines as follows: 1). No substantial changes are proposed in the Redevelopment Project, or with respect to the circumstances under which the project is to be undertaken, which will require major revisions in the Environmental Impact Report previously adopted for the Project due to the involvement of new environmental impacts not covered in said previous Environmental Impact Report; 2). No Subsequent or Supplement to EIR is necessary or required; and 3). The proposed action will have no effect on the environment, except as identified and considered in the previous EIR. Name of Project (if applicable): Disposition and Development Agreement between the Azusa Redevelopment Agency and Rogers Toyota Incorporated. 4. Description of Project and Address: Site Size: 104,250+ Square Feet Square Footage of Structures: 12,500+ Square Feet Scheduling: Conveyance of Site Phase I on or before June 30, 1986 Conveyance of Site Phase II on or before March 26, 1987 Completion of Construction Phase I on or before February 28, 1987 Completion of Construction Phase II on or before October 9, 1987 Zoning: Freeway Service Zoning; General Plan: General Commercial 5. Identification of Environmental Setting: The subject site is located on the southwest corner of Azusa Avenue and I-210 freeway. Surrounding land uses include a fast food restaurant and a service station. Residential uses are on the west side of South San Gabriel Avenue and on the East side of Azusa Avenue. The subject property is occupied by a commercial use, Trojan Termite, and eight (8) single family residential structures. The subject site is located in a commercial area and is designated for commercial development by both the City's Zoning Ordinance and General Plan. Azusa Avenue (State Highway 39) is the principal access to the site. The characteristics of the Azusa CBD Project Area have previously been described in the Project EIR certified with the adoption of the original Redevelopment Plan on September 18, 1978. -1- 0 CITY OF AZUSA ASSESS14ENT OF ENVIRONMENTAL IMPACT REPORT INITIAL STUDY A copy of the Initial Study for Public Works projects will be available to the public in the Azusa Public Works Department. A copy of the initial study for the Planning Department projects will be in the Planning Department and the Public Library. Comments from the public on the projects may be made, in writing, to the respective department directors or at the public hearings for the projects. Project Description: II. Normal overcovering of soil for new development. No significant impacts. lg. Project EIR indicated some seismic safety risks; however, seismic safety element provides adequate mitigation measures to regulate development. 3b. Normal changes to run-off due to paving of site. 6a. Minor increase in noise due to traffic and auto repairs; site plan configu- ration will provide walls and the internalization of structures to minimize noise generation beyond the site; impacts should not exceed those assessed in project EIR and development is located in a commercial area. 7. Normal emissions of light and glare. Site plan will dictate light standards to be situated in such a fashion as to minimize glare into the neighboring residential areas. 12. Eight residential structures are to be removed. The mitigation measures are outlined in the Project EIR as well as the Housing Replacement Plan adopted for this development. 13. Potential demand for more parking might exist. On site requirements will meet zoning requirements. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: (As outlined above) DETERMINATION (To be completed by the Lead Agency) On the basis of this initial evaluation: X I find the proposed project COULD NOT have a significant effect on the environment, and a 14EGATIVE DECLARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
