HomeMy WebLinkAboutResolution No. 8014RESOLUTION NO. 8014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE TO BARRY A. COTTLE/ R. C. HOBBS DEVELOPMENT COMPANY FOR PROPERTY LOCATED AT 1151 WEST ARROW HIGHWAY (VARIANCE CASE NO. V-885) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. There has been filed with the Planning Commis- sion of the City of Azusa the application of Barry A. Cottle on behalf of R. C. Hobbs Development Company requesting a variance to construct carports instead of the required fully -enclosed garages (Section 19.48.030 (2) of the Azusa Municipal Code) and to reduce the rear yard setback to zero feet instead of the required five feet (Section 19.44.020 of the Azusa Municipal Code) for the subject property. B. The subject property is generally described as 1151 West Arrow Highway, Azusa, California, and is legally described as: The E220' of the SW 1/4 of the SW 1/4 of the SW 1/4 of Section 3, Township 1 South, Range 10 West, San Bernardino Meridian Except a strip of land 25' wide of the south side thereof for road purposes and as shown on a map on file with the City Clerk. C. The application for the variance was duly initiated, and notice of public hearings thereon were duly given and published in accordance with applicable law. D. Public hearings thereon were duly held by the Planning Commission of the City of Azusa on February 19, 1986, and by the City Council of the City of Azusa on April 15, 1986. E. On February 19, 1986, the Planning Commission of the City of Azusa by Resolution No. 2279 voted to deny the variance for the subject property. F. Thereafter, the applicant duly filed a notice of appeal with the City Clerk within the time required by law for such appeal. G. The City Council has information presented to held on April 15, 1986. considered all of the it at the public hearing SECTION 2. The City Council of the City of Azusa, after careful consideration of the evidence presented to it, does hereby approve said Variance No. V-885 based upon the following findings: 9 0 A. Strict application of the provisions of the Zoning Title of the Azusa Municipal Code will result in practical difficulties or unnecessary hardships for the subject property inconsistent with the general purposes and intent of this Title in that the site is 4.6 acres, which is considerably larger than most other properties within the zone, and due to the size of the property the variance is necessary in order to allow the addition of 31 guest parking spaces and greater open space and recreational areas which is necessitated by a project of this size that would not otherwise be required of smaller - scale projects in the zone. B. There are exceptional circumstances or condi- tions applicable to the subject property and to the intended use for development of the subject property that do not apply generally to other property in the same zone in that the size, configuration and topography of the subject site is such that enhanced guest parking spaces and open space above and beyond the requirements of smaller scale projects in the area is required and that other projects in the area allow for reduced side and rear yard setbacks and are built with carports in place of fully enclosed garages for apartment units. C. The granting of the variance for the subject property will not be materially detrimental to the public welfare or injurious to the property or improvements in the zone or neighborhood in which the property is located in that the condi- tions of approval will eliminate any potential effects of the variance upon the surrounding area and, specifically, the carports will provide adequate shelter for the vehicles while at the same time the project will provide noise and visual buffers from adjoining parcels. D. The granting of the variance for the subject property is consistent with the General Plan of the City of Azusa and each of its elements and there are no master plans applicable to the subject property. E. In taking this action the City Council con- sidered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. SECTION 3. The approval of this variance for the subject property is subject to the applicant's compliance with the follow- ing conditions of approval: A. Construction shall comply with the plot plan submitted. B. All necessary permits shall be obtained. -2- 0 P C. Any and all applicable Building Department and Fire Department requirments shall be met at all times. D. Carports and guest spaces shall be ade- quately maintained at all times. E. A precise plan of design permit and a design review permit shall be obtained from the Planning Division and such permit shall include the applicable mitigation measures from the environmental impact report. SECTION 4. The City Clerk shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 21stday of April 1986. e a,4-tf.
