HomeMy WebLinkAboutResolution No. 8003RESOLUTION NO. 8003 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 328 N. AZUSA AVENUE (C-396, GREGORY ADKINS) THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Thev"City Council of the City of Azusa does hereby find, determine and declare that: A. Proceedings pursuant to the provisions of Chapter 19.60 of the Azusa Municipal Code were duly initiated for the granting of Conditional Use Permit No. C-396 to Gregory Adkins permitting the expansion of a nonconforming use pursuant to Sections 19.40.050 and 19.24.030(56) of the Azusa Municipal Code. B. A duly -noticed public hearing on the appli- cation for the conditional use permit was held by the Planning Commission of the City of Azusa on January 22, 1986, and after considering all of the evidence submitted on the application, the Planning Commission by Resolution No. 2226 approved the Conditional Use Permit subject to the following conditions. 1. Construction shall comply with the plot plan submitted. 2. All necessary permits shall be obtained. 3. Any and all applicable Building -Depart- ment and Fire Department requirements shall be met at all times. 4. Two residential units on rear of property may be maintained for one year from date of approval of subject conditional use permit. At the end of said one year period, entire property shall be brought into complete conformance with the Azusa Municipal Code and the zoning for the property. C. On January 24, 1986, a timely appeal of the Planning Commission's action was filed by applicant Gregory Adkins requesting amendments to condition number 4. D. On March 17, 1986, the City Council of the City of Azusa held a duly noticed public hearing on the application at which time the Council heard and considered all evidence presented to it. -1- 1] E. The City Council has determined that the CUP is consistent with the General Plan and is consistent with good zoning and planning practices. F. In taking this action the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. SECTION 2. The City Council has considered all of the information presented to it at the public hearing and finds that the public necessity, convenience, welfare and good zoning practice justify the approval of the appeal and of the CUP in that: A. Approval will allow use of the front building without the required off-street parking because there is no need for street parking. B. Approval will allow use of the back duplex for residential purposes until August 7, 1989, because the Azusa Municipal Code provides that this is when the amortization period is to expire. C. Council chooses not to extend the use of the back duplex for seven additional years through 1996, because the subject property lies within the Azusa Redevelopment Area, which is currently undergoing significant improvements and commercial development is expected in the area. SECTION 3. Conditional Use Permit C-396 is hereby approved subject to the following conditions: A. Construction shall comply with the plot plan submitted; B. All necessary permits shall be --obtained; C. Any and all applicable Building and Fire Department requirements shall be met at all times; D. The two residential units in the rear of the property may continue in use until August 7, 1989, until the units status as a legal non- conforming use ceases; E. On-site parking for the front commercial units shall not be required. SECTION 4. The City Council does hereby find and declare that the Conditional Use Permit for the subject property described herein will not have a substantial adverse effect upon the environment and is categorically exempt from the provisions of the California Environmental Quality Act pursuant to 14 Cal. Admin. Code Section 15301(e). SECTION 5. The City Clerk shall certify the adoption of this resolution. -2- 0 PASSED, APPROVED AND ADOPTED this 15th day of April , 1986.
