RESOLUTION NO. 8002
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA GRANTING A ZONE VARIANCE
(VARIANCE CASE NO. V-880, LYLE MORITZ)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa does
hereby find, determine and declare that:
A. An application was filed by Lyle Moritz
with the Planning Commission (Variance
Case No. V-880) for the subject property
located at 235 N. Alameda Avenue in the
City of Azusa which is located in the R3C
Zone. This property is legally described
as:
The South 40 feet of Lot 4, and
all of Lot 5 of Block 68 of
Azusa Tract, Book 15, pages 93-
96.
B. The application requests a variance
allowing the waiver of: Section
19.16.006(2) regarding a side yard of
five feet; Section 19.16.070(a) regarding
a distance of twenty feet between
buildings; and Section 19.16.100
regarding lot coverage of no more than
fifty percent;
C. A duly noticed public hearing was held on
said application by the Planning Commis-
sion on February 5, 1986, and the
Planning Commission denied.the.var-iance
at that time;
D. The City Council by its own action on
February 18, 1986, appealed this
decision;
E. The City Council held a duly noticed
public hearing on said appeal on
March 17, 1986;
SECTION 2. The appeal of Zone Variance Case No. V-880
is hereby approved and Variance V-880 is hereby approved to
provide that:
A. A side yard setback of zero feet is
allowed as noted on plot plan submitted
(Section 19.16.060(2));
B. A nine foot distance between buildings is
allowed as noted on the plot plan
submitted (Section 19.16.070(a)); and

I hereby certify that the foregoing Resolution was
duly adopted by the City of Azusa, at a regular meeting
thereof held on the 15th day of April 1986, by the
following vote of the Council:

C. Lot coverage of fifty-eight percent (58%)
is allowed (Section 19.16.100).
SECTION 3. The granting of this variance is based on the
following findings of fact:
A. There are exceptional circumstances or
conditions applicable to the subject
property and to the intended use for
development of the subject property that
do not apply generally to other property
in the same zone in that:
1. the subject property is ninety (90)
feet in width composed of a 50' and
a 40' lot which is out of the
ordinary and the lots would not
support two regular developments
based on the standards of the Code.
B. The granting of the variance for the
subject property will not be materially
detrimental to the public welfare or
injurious to the property or improvements
in the zone or neighborhood in which the
property is located in that constructing
the apartment complex as proposed will
provide for a low-rise development and
enhance the aesthetics of the property.
C. The granting of the variance for the
subject property is consistent with the
General Plan of the City of Azusa and
there are no master plans applicable to
the subject property.
D. In taking this action, the City Council
considered the effects of the decision on
the housing needs of the region in which
the City is located and balanced those
needs against the public service needs of
the City residents and available fiscal
and environmental resources-..
SECTION 4. The City Council does hereby find and
declare that the variance for the subject property described
herein will not have a substantial adverse effect upon the
environment and is categorically exempt from the provisions
of the California Environmental Quality Act pursuant to
14 Cal. Admin. Code Section 15305(a).
SECTION 5. The City Clerk shall certify to the
adoption of this Resolution.
