HomeMy WebLinkAboutResolution No. 8132RESOLUTION NO. 8132 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION AT PROPERTY GENERALLY LOCATED AT 5532 NORTH CITRUS AVENUE TO CHANGE PREZONING PRIOR TO ANNEXATION FROM R -1C (SINGLE FAMILY RESIDENCE) TO C-2 (RESTRICTIVE COMMERCIAL) FOR ZONE CHANGE CASE NO. 255 THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: a. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for Zone Change Case Number Z-255, to change prezoning from R -lc to C-2, in order to construct a professional office building upon annexation to the City of Azusa, and said Initial Study and Negative Declaration were prepared in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines and the City's CEQA Procedures: b. On or about September 3, 1986, the Planning Commission of the City of Azusa certified and approved by Resolution No. 2370 the Negative Declaration of Environmental Impact for the proposed Zone Change Case Number Z-255, for the property located at 5532 North Citrus Avenue, Azusa, California; c. At its meeting of October. 6.,..1986,,..the City Council of the City of Azusa considered the proposed project and heard evidence on the proposed project in the Negative Declaration; d. Prior to approving the project, the City Counsel of the City of Azusa considered the proposed declaration, together with the Initial Study of Environmental Impact, and any comments received during the public review process; e. On the basis of this review, there is no substantial evidence from which it can be fairly argued that the project will have a significant adverse effect on the environment. SECTION 2. The City Council of the City of Azusa hereby certifies and approves the Negative Declaration for Zone Change Case Number Z-255, a copy of which Negative Declaration is attached hereto as Exhibit "A" and by this reference incorporated herein, and further determines that the Negative Declaration shall be filed with the County Clerk of the County of Los Angeles in the manner required by law. Project would involve constructing a professional office building on a parcel currently developed with a single-family residence. 8.b. Proposal is to change prezoning prior to'annexation from Rlc (Single - Family Residential) to C2 (Restricted -Commercial). 13.b. Proposed office building will generate a need for additional off-street parking, which will be provided on-site. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None required.. DETERMINATION (To be completed by the Lead Agency) onthebasis of this initial evaluation: x_ I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
