HomeMy WebLinkAboutResolution No. 8127RESOLUTION NO. 8127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR CONDITIONAL USE PERMIT - CASE NO. C-418 THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: a. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for the proposed alteration of a nonconforming commercial property in order to operate a specialized auto parts store for the property located at 300 North Alameda Avenue, Azusa, California and said Initial Study and Negative Declaration were prepared in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines and the City's CEQA Procedures; b. On or about August 20, 1986, the Planning Commission of the City of Azusa certified and approved by Resolution No. 2356 the Negative Declaration of Environmental Impact for the proposed alteration of a nonconforming commercial property in order to operate a specialized auto parts store - Section 19.40.050 for the property located at 300 North Alameda Avenue, Azusa, California. C. At its meeting of October 6, 1986, the City Council of the City of Azusa considered the proposed project and heard evidence,,on.,.the:.proposed project and the Negative Declaration; d. Prior to approving the project, the City Council of the City of Azusa considered the proposed declaration, together with the Initial Study of Environmental Impact, and any comments received during the public review process; e. On the basis of this review, there is no substantial evidence from which it can be fairly argued that the project will have a significant adverse effect on the environment. SECTION 2. The City Council of the City of Azusa hereby certifies and approves the Negative Declaration for the proposed alteration of a nonconforming commercial property in order to operate a specialized auto parts store (Section 19.40.050) for the property located at 300 North Alameda Avenue, Azusa, California, a copy of which Negative Declaration is attached hereto as Exhibit "A" and by this reference incorporated herein, and further determines that MAS/RES5068 • 0 the Negative Declaration shall be filed with the County Clerk in the County of Los Angeles in the manner required by law. SECTION 3. The City Clerk shall certify the adoption of this resolution. PASSED, APPROVED AND ADOPTED this 3rd day of November , 1986. Subject parcel does not conform to current development standards for commercial property due to reduced setbacks and lack of off-street parking. 13.b. Minimal off-street parking currently provided on the subject parcel may cause some customers to utilize on -street parking. However, operation of proposed auto parts store on the parcel should result in only marginal increase in demand for parking. - IV. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None required. V. DETERMINATION (To be completed by the Lead Agency) on the basis of this initial evaluation: g I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
