A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA DENYING A ZONE VARIANCE (VARIANCE
CASE NO. V-920) TO GORDON A. FRANKLIN FOR
PROPERTY LOCATED AT 563 EAST ARROW HIGHWAY
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. Gordon A. Franklin filed an application
with the Planning Commission requesting a variance
to allow a reduction of parking spaces from 66
spaces required to 63 spaces (Azusa Municipal Code
Section 19.48030(2)) and a reduced unit size of 630
suqare feet instead of the required 650 square feet
(Azusa Municipal Code Section 19.16.020(2)) to
legalize a conversion of a recreation room into two
dwelling units.
B. The subject property is located at 563
East Arrow Highway, Azusa, California and is zoned
R -3(b) (multi -family residential) and is designated
High Density Residential on the General Plan.
C. The request for variance for the subject
property was duly initiated, notice of public
hearings thereon were duly given and published in
accordance with applicable law.
D. Public hearings thereon were duly held by
the Planning Commission of the City of Azusa on
October 8, 1986 and by the City Council of the City
of Azusa on December 1, 1986.
E. On October 8, 1986, the Planning
Commission of the City of Azusa by Planning
Commission Resolution No. 2392 denied the
applicant's request for a variance.
F. Thereafter, the applicant duly filed a
notice of appeal with the City Clerk within the
time specified by law.
G. The City Council has considered all of
the information presented to it at the public
hearing held on December 1, 1986.
H. In taking this action the City Council
considered the effects of the decision on the
housing needs of the region in which the City is
located and balanced those needs against the public
service needs of the City residents and available
fiscal and environmental resources.
SECTION 2. After careful consideration of the
matters presented to the City Council at the public hearing,

the City Council hereby denies the applicant's request for a
variance based upon the following findings:
A. Strict application of the provisions of
the zoning title of the Azusa Municipal Code will
not result in practical difficulties or unnecessary
hardships for the subject property inconsistent
with the general purposes and intent of the zoning
title in that the apartment complex is viable
without the additional two units and the topography
and shape of the subject property do not create
building problems for the site.
B. There are no exceptional circumstances or
conditions applicable to the subject property and
the intended use for development of the subject
property that do not apply generally to other
property in the same zone in that the other
apartment complexes are required to maintain such
spaces and the topography and shape of the subject
property do not create building problems for the
site.
C. The granting of the variance for the
subject property will be materially detrimental to
the public welfare and good zoning practice in that
the addition of the two units would add to the
density of the project and reduce effective open
space for the project.
D. Granting of the variance as requested by
the applicant will be inconsistent with the General
Plan in that it would be contrary to the
development standards relating to useable open
space, unit floor area and parking.
SECTION 3. The City Clerk shall certify the
adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 15th day of
December , 1986.
I HEREBY CERTIFY that the foregoing Resolution was
duly adopted by the City Council of the City of Azusa at a
regular meeting thereof, held on the 15th day of
December 1986, by the following vote of the
Council:

NOES: COUNCILMEMBERS NONE
