The City Council of the City of Azusa met in regular session at the above time and place. Present at roll call: Councilmen: Strohmeier, McIntire, Arnold, Chester, Carr, Roll call. City Attorney and City Clerk. The minutes of the last regular meeting of August 16, 1937 were read and approved as read. ' City Auditor F. M. Robinson addressed the City Auditor Council relative to the Federal Law govern- addressed the ing active and inactive Municipal accounts, Council. stating that according to Federal Law, the banks are not permitted to pay interest on active accounts. Moved by Councilman McIntire, seconded by Councilman Chester that the City Clerk be authorized and instructed to send written instructions to heads of all City Depart- ments requesting them to follow the recommendations of the City Auditor in depositing all City monies with the City Treasurer according to Article #6, Section #885 of the Municipal Corporations Act for Cities of the Sixth Class. City Clerk instruct- ed to notify heads of Departments regarding the deposit of City monies. Councilman Chester offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY RESOLUTION NO. OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, 1539 ADOPTED. LEVYING TAXES AND FIXING THE TAX RATE OF ALL PROPERTY IN SAID CITY FOR ALL MUNICIPAL PURPOSES AND TO PAY THE BONDED INDEBTEDNESS THEREOF AND INTEREST ON THE SAIL FOR THE FISCAL YEAR 1937-1938. Moved by Councilman Chester, seconded by Councilman Arnold that the Resolution be adopted as read and numbered Resolution No. 1539. Communications on the League of California Comrqunications from Municipalities Convention to be held at San the League of Jose, September 13, 14, 15 and 16, were California read and ordered placed on file. A notice from the Railroad Commission Notice from the relative to the Franchise granted by the Railroad Commission City of Azusa to the Associated Telephone read and referred Company, was read, to City Attorney. Moved by Councilman Chester, seconded by Councilman Arnold that this matter be referred to the City Attorney to report back. SEPTEXLBER 7, 1937. 7:30 P. I"T. A communication from the Los Angeles Times relative to advertising in the s Angeles* Communication read. County Fair Edition of the Times, was read. No action taken. A communication signed by Alfred Jones, County Surveyor., relative to checking of Subdivision Maps, was read. Moved by Councilman Chester, seconded by Councilman Strohmeier that the County ' Surveyor be formally designated to act for the City of Azusa in checking the map against the County Records and the general require- ments of the State Lawry and the City Engineer be authorized and instructed to sign the enclosed form. Carried by the following vote of the Council: Ayes: Councilmen: Strohmeier, McIntire, Arnold, Chester, Carr. Noes: None. Absent: None. A communication signed by Richard Graves, Executive Secretary for the League of California Municipalities, relative to the Digest of 1937 Legislation affecting Municipalities, was read. Moved and carried that the City Clerk be authorized to order a copy of the Digest, priced at $2.50 per copy, for the City Attorney. The City Clerk announced that she had received one sealed bid, submitted by the Burroughs Company, in answer to Notice Calling for sealed bids for a billing machine to be used in the Light and Water Departments. Moved by Councilman Chester, seconded by Councilman McIntire that the bid be now opened, examined and publicly declared. Moved by Councilman Chester, seconded by Councilman Strohmeier that the City Attorney be instructed to investigate the small claims court in the City of Azusa and report back at the next regular meeting of the Council. City Attorney to investigate small claims court. "Rt cq 215 MINUTES OF THE CITY COUNCIL MEETING. SEPTEMBER 7, 1937. 7:30 P. M. The City Clerk announced that she had received petitions with 44 names attached thereto protesting the re -zoning of Lot 28, Subdi- vision #2, Azusa Land and Water Company Tract from a residential zone to a heavy industrial zone. The Clerk also announced that she had received four written protests in the above mentioned matter. Moved by Councilman Strohmeier, seconded by Councilman McIntire that the petitions and written protests be accepted and placed on file. Carried by the following vote of the Council: Ayes: Councilmen: Strohmeier, McIntire, Arnold, Chester, Carr. Noes: None. Absent: None. Petitions and letter of protest on re -zoning accepted and ordered placed on file. Business men awarded City business. A communication from Richard Graves, Secretary Communication read for the League of California Municipalities and ordered placed relative to accomodations for the City on file. Council during the Convention at San Jose was read and ordered placed on file. Dr. E. D. Cook addressed the Council request- ing lights be installed in the park north of the Library. This request was referred to the Superinten- dent of Light and Water. Councilman Strohmeier offered an Ordinance entitled: AN ORDINANCE OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA AMENDING (SECTION 1-C) (SECTION 1-D) AND ;SECTION 2) OF ORDINANCE NO. 326 OF SAID CITY OF AZUSA, RELATING TO LICTi\?SING FOR THE PURPOSE OF REVENUE AND REGULATION ALL AND EACH KIND OF BUSINESS CARRIED ON IN SAID CITY AND PRESCRIBING THE PENALTY FOR VIOLATION. AN ORDINANCE OF THE CITY OF AZUSA, LOS ANGELES COUNTY, STATE OF CALIFORNIA, PROHIBITING PICKETING, LOITERING, ASSEMBLY- ING, CARRYING OR DISPLAYING SIGNS OR BANNERS OR SPEAKING IN A LOUD OR UNUSUAL TONE IN PUBLIC STREETS, ALL.F'i'S OR SIDE- WALKS IN THE CITY OF AZUSA AND PROVIDING PENALTIES FOR VIOLATIONS. to be placed upon its first reading. ' The title was then read. Moved by Councilman Chester, seconded by Councilman McIntire that the further read- ing of this Ordinance be waived. Street Superintendent, Arthur ffolfe reported to the Council that nothing had been done on the replacement of the spring board for the swimming pool. Moved by Councilman McIntire, seconded by Councilman Chester that the City Clerk be authorized and instructed to write Spaulding Brothers requesting an explanation of their apparent neglect. Carried by the following vote of the Council: Ayes: Councilmen: Strohmeier, McIntire, Arnold, Chester, Carr. Noes: None. Absent: None. ' Mayor Carr reported that Mr. E. Malone requested crossing guards for school children at the intersection of Foothill Boulevard and San Gabriel Avenue between the hours of 8 and 9 and 3 and 4; at the intersection of Soldano Avenue and Foothill Boulevard between the hours of 8 and 9 and 2 and 3; at the inter- section of Azusa Avenue and 10th Street between the hours of 8 and 9 and 2 and 3. Councilman Chester instructed the Street Superintendent to assist the Police Depart- ment in working out this problem. Mr. Kressly, Consulting Engineer, addressed the Council relative to the Pacific Electric agreement relative to the crossing on Enid Avenue. No action taken. Moved by Councilman Strohmeier, seconded by Councilman Arnold that the Council declare a thirty minute recess. At the end of this period the meeting was ' resumed. 1&. Stafford Bell appeared before the Council requesting the assurance that he will be issued a City license to operate a liquor store providing the State Board of Equalization grants him permission to sell liquor.' ORDINANCE read for the first time. Street Superinten- dent reported on spring board. City Clerk instruct- ed to write Spaulding Brothers. Crossing guards referred to Police and Street Depart- ments. Mr. Kressly addressed the Council. 30 minute recess. S. Bell addressed the Council. Mayor Carr informed Mr. Bell that the State have tried to limit the number of liquor businesses in small towns to one business for every 200 inhabitants and Azusa had already reached this average. Moved by Councilman Chester, seconded by Councilman McIntire that S. C. Bierbower be granted a thirty day leave of absence without pay, from the Police Department. Jack Pierce appeared before the Council requesting that both collectors, in the Department of Light and Water be bonded instead on one, as in the past, Moved by Councilman Arnold, seconded by Councilman McIntire that the City Clerk be instructed to request Owens-Vosburg Insurance Company to cancel the bond on Fay Streshly as of October 1, 1937 and to write a bond for I. R. Calvert for 52000, and one for S. C. Bierbower for $2000. as Collectors of Revenue in the Light and Water Depart- ments, effective September Bth. Councilman Strohmeier offered a Resolution entitled: ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPOINTING CERTAIN EMPLOYEES AND FIXING THE SALARIES OR COMPENSATION THEREOF. Moved by Councilman Strohmeier, seconded by Councilman Chester that this Resolution be adopted as read and numbered Resolution No. 1540. Moved by Councilman Chester, seconded by Councilman McIntire that Fred Williams be appointed acting Chief of Police with all responsibilities and privileges, until further action of the City Council.
