HomeMy WebLinkAboutResolution No. 81400 0 RESOLUTION NO. 8140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR ZONE CHANGE CASE NO. Z-256, ABELARDO A. CONTRERAS, ET AL. THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for Zone Change Case No. Z-256 to allow a change of zone from CBD (Central Business District) to P (Residential and Offstreet Parking) for property located at 633 North Dalton Avenue, and said Initial Study and Negative Declaration were prepared in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines, and the City's CEQA procedures. B. On or about September 17, 1986 the Planning Commission of the City of Azusa certified and approved by Resolution No. 2389 the Negative Declaration of Environmental Impact for Zone Change Case No. Z-256 to allow a change in zone from CBD (Central Business District) to P (Residential and Offstreet Parking) in order to maintain and legalize an existing residence on the property located at 633 North Dalton Avenue, Azusa, California. C. At its meeting of November 3, 1986, the City Council of the City of Azusa considered the proposed project and heard evidence -on the proposed project and Negative Declaration. D. Prior to approving the project, the City Council of the City of Azusa considered the proposed Negative Declaration together with the Initial Study of Environmental Impact, and any comments received during the public review process. E. On the basis of this review, there is no substantial evidence that the project will have a significant adverse effect on the environment. SECTION 2. The City Council of the City of Azusa hereby certifies and approves the Negative Declaration for Zone Change Case No. Z-256, a copy of which Negative Declaration is attached hereto as Exhibit "A" and by this reference incorporated herein, and further determines that the Negative Declaration shall be filed with the County Clerk of the County of Los Angeles in the manner required by law. -1- mas/RES2500 0 SECTION 3. Property is currently zoned CBD_(Central Business District) and is developed with a single -family -residence. Proposed zone change to P (Residential and Off -Street Parking) would bring property into conformance with zoning. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None required. DETERMINATION (To be completed by the Lead Agency) On the basis of this initial evaluation: X_ I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. That said notice was posted by being securely fastened to posts poles, trees, standards, fences or walls, so it was conspicuously an easily read by passersby.
