HomeMy WebLinkAboutResolution No. 8232RESOLUTION NO. 8232 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING A VARIANCE TO SABINO GIRON FOR PROPERTY LOCATED AT 300 WEST DURANT STREET (VARIANCE CASE NO. V-928) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. There has been filed with the Planning Commission of the City of Azusa the application of Sabino Giron requesting a variance to allow waiver of the two -car garage requirement for a single-family home (Section 19.48.030(1) of the Azusa Municipal Code) for the subject property. B. The subject property is generally described as 300 West Durant Street, Azusa, California, and is legally described as Lot 36 of Tract No. 20971, Map of Azusa, and as shown on the map on file with the City Clerk. C. The application for the variance was duly initiated, and notice of public hearings thereon were duly given and published in accordance with applicable law. D. Public hearings thereon were duly held by the Planning Commission of the City of Azusa on February 18, 1987, and by the City Council of the City of Azusa on March 31, 1987. E. On February 18, 1987, the Planning Commission of the City of Azusa by Resolution No. 2434 voted to deny the variance for the subject property. F. Thereafter, the applicant duly filed a Notice of Appeal with the City Clerk within the time required by law for such appeal. G. The City Council has considered all of the information presented to it at the public hearing held on March 31, 1987. SECTION 2. The City Council of the City of Azusa, after careful consideration of the evidence presented to it, does hereby approve said Variance No. V-928 to permit waiver of the two -car garage requirement for a single-family residence on the subject property, based upon the following findings: A. Strict application of the provisions of the Zoning Title of the Azusa Municipal Code will result in practical difficulties or unnecessary hardships for the subject property inconsistent 0 with the general purposes and intent of this title in that the subject property is an irregularly- shaped lot with very limited street frontage at the end of a cul-de-sac. B. There are exceptional circumstances or condi- tions applicable to the subject property and to the intended development of the subject property that do not apply generally to other property in the same zone for the reason set forth in subparagraph A above. C. The granting of the variance for the subject property will not be materially detrimental to the public welfare or injurious to the property or improvements in the zone or neighborhood in which the property is located in that the conditions of approval will eliminate any potential effects of the variance upon the surrounding area. D. The granting of the variance for the subject property is consistent with the General Plan of the City of Azusa and each of its elements and there are no master plans applicable to the subject property. E. In taking this action the City Council considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. SECTION 3. The approval of this variance for the subject property is subject to the applicant's compliance with the following conditions of approval: A. Construction shall comply with the plot plan submitted. B. All necessary permits shall be obtained. C. Any and all applicable Building Department and Fire Department requirements shall be met at all times. D. An occupancy permit shall be obtained from the Building Department for the converted garage and any and all improvements required by the Building Department as a result of this variance shall be completed within 90 days of the date of approval of this variance. E. Any new construction shall require that a two -car garage be built pursuant to Section 19.48.031(1) of the Azusa Municipal Code, or a new variance be granted by the Planning Commission. SECTION 4. The City Council hereby finds, determines and declares that this project is categorically exempt from the requirements of a negative declaration or environmental impact report as a Class 3(a) categorical -2- 0 0 exemption under the California Environmental Quality Act and the State CEQA Guidelines. SECTION 5. The City Clerk shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 4th day of May , 1987.
