DO RESOLUTION NO. 8223 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CHANGING THE GENERAL PLAN DESIGNATION FOR PROPERTY GENERALLY LOCATED AT 840-880 SOUTH VINCENT AVENUE FROM MEDIUM-DENSITY RESIDENTIAL TO HIGH-DENSITY RESIDENTIAL AND CHANGING THE GENERAL PLAN DESIGNATION FOR PROPERTY GENERALLY LOCATED AT 620, 621, 625 AND 630 NORTH CERRITOS AVENUE FROM COMMUNITY COMMERCIAL TO HIGH-DENSITY RESIDENTIAL (GENERAL PLAN AMENDMENT NO. 87-1 ) THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that : A. There is in effect a duly-adopted General Plan for the City of Azusa which contains a land-use element designating all property within the City for certain land uses. B. This action of the City Council changing the land-use designation arises from two separate applications from property owners within the City as follows: 1. An application from Net Advantage, Inc./ Anton L. Bargaehr to change the land-use designation on property generally located at 840-880 South Vincent Avenue, City of Azusa, from medium-density residential to high- density residential; and 2 . An application from' Michael B. Brashears on behalf of himself and other owners to change the land-use designation on properties generally located at 620 , 621 , 625 and 630 North Cerritos Avenue, City of Azusa, from community commercial to high-density residen- tial. C. The change and amendment to the General Plan as described herein was duly initiated, and notice of public hearings thereon were duly given and published in accordance with applicable law. D. Public hearings thereon were duly held by the Planning Commission of the City of Azusa on January 21 , 1987, and by the City Council of the City of Azusa on March 2, 1987 and March 16, 1987 . E. On January 21, 1987 , the Planning Commission of the City of Azusa heard and considered the evidence presented to it concerning the proposed amendment at the public hearing and by its Resolution No. 2422, adopted by a vote of six in favor and none against, said vote being not less than a majority of the total members of the Commission, recommended that the City Council approve the proposed amendment. F. The City Council at its meeting of March 16, 1987 , heard and considered all of the evidence presented to it concerning the proposed amendment, including but not limited to the recommendation of the Planning Commission. G. A Negative Declaration has been approved for that portion of the General Plan Amendment relating to the property at 620 , 621, 625 and 630 North Cerritos Avenue and a Final Environmental Impact Report has been approved and certified for that portion of the General Plan Amendment relating to property at 840-880 South Vincent Avenue. H. The adoption of this amendment to the General Plan is in the interests of the public health, safety and welfare of the City of Azusa and is consistent with good zoning and planning practices. I . This amendment to the General Plan is consis- tent with the other provisions of the General Plan and all elements thereof . J. In taking this action the City Council considered the effects of the decision on the housing needs of the region in which the city is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources . SECTION 2 . The City Council of the City of Azusa, based upon the above findings , does hereby amend the General Plan of the City of Azusa, Land-Use Element , to change the land-use designation of the property located generally at 840-880 South Vincent Avenue from medium-density residential to high-density residential, and to change the land-use designation for the property generally located at 620 , 621, 625 and 630 North Cerritos Avenue from community commercial to high-density residential. Councilwoman Avila objects to and dissents from the change in the land-use designation set forth in Section 2 of this resolution for the property located at 840-880 South Vincent Avenue. SECTION 3 . The Director of Housing and Community Development shall revise the Land-Use Element of the General Plan of the City of Azusa to reflect the changes in said element approved by this resolution. SECTION 4 .
