HomeMy WebLinkAboutResolution No. 8212• RESOLUTION NO. 8212 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA OPPOSING SENATE BILL 553 THE EMINENT DOMAIN BILL WHEREAS, SB 553, introduced by Senator Russell, supported by the California Water Association and Southern California Gas Company, will substantially limit the ability of the public agencies from condemning the property of the investor-owned utility, and WHEREAS, under existing law, a public agency can condemn property by first adopting a resolution of necessity which conclusively establishes the following: 1. The project is needed for the public interest. 2. The project is planned in a manner which will be most compatible with the greatest public good and least private injury. 3. The property to be acquired is necessary for the project, and WHEREAS, if SB 553 becomes law, it will severely hamper the public agency's ability to exercise the eminent domain proceeding under the current statute. At best it would create more litigation on investor-owned utility property unless the public agency was willing to pay the asking price for the property. NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Azusa for the reasons stated above, strongly opposes enactment of Senate Bill 553; furthermore, copies of this resolution are to be distributed as follows: All members of the State Senate Judiciary Committee, Senator H.L. Richardson and Assemblyman Richard Mountjoy. ADOPTED AND APPROVED this 20th day of April, 1987.
