RESOLUTION NO. 8283
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA GRANTING APPROVAL TO TENTATIVE TRACT
MAP NO. 45402 WITH CERTAIN CONDITIONS
THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. Lewis Homes has applied for approval of
Tentative Tract Map No. 45402;
B. On May 6, 1987, the Planning Commission held a
duly -noticed public hearing on the application of
Lewis Homes and gave all persons an opportunity to
be heard on the application;
C. Following the adoption of Resolution 2452 by
the Planning Commission granting approval to
Tentative Tract Map No. 45402, Relco Industries
filed a Notice of Appeal with the City Council of
said approval. Relco appealed on the ground that
the Tract Map should include a condition requiring
Lewis Homes to reimburse Relco for improvements
made on the property as part of Relco's previous
attempts to develop the same property as part of
Tract No. 42902.
D. The City Council held a duly -noticed public
hearing on the application and the appeal on
June 15, 1987, and July 7, 1987, and at such public
hearings gave all affected public bodies and
officials and members of the public the opportunity
to consider the application and furnish comments to
the Council.
E. The City Council has carefully reviewed and
considered all of the comments made as part of the
public review process and at the public hearing,
and all written materials made a part of the
record, including the application for Tentative
Tract No. 45402, reports of the various City
departments on Tentative Tract No. 45402, as well
as Tract No. 42902, and written and oral comments
on the project.
F. Relco Industries is not entitled to reimburse-
ment for improvements previously made on the site
as part of Tract 42902 because:
1. Relco applied for and was granted
approval of Tract 42902, a portion of which
includes the property which is currently the
subject of the application for Tract 45402.

2. The improvements for which Relco now
seeks reimbursement are sewer and drainage
facilities which were required as conditions
of approval to serve Tract 42902. None of the
improvements required for Tract 42902 serve or
are intended to serve property not within
Tract 42902. No condition of Tract 42902
required Relco to install or construct
improvements with supplemental capacity or
number for the benefit of property outside
Tract 42902. All improvements were for the
direct benefit of Tract 42902.
3. The City of Azusa has not adopted an
ordinance imposing City-wide fees on sub-
dividers for drainage or sanitary sewer
facilities pursuant to Govt. Code Section
66483. The facilities on Tract 42902 would
not have been part of any such fees because
such facilities are designed only for the
benefit of Tract 42902 and not for property
outside of the subdivision.
4. The fact that Relco phased the final maps
on Tract 42902 does not entitle it to any
reimbursement because the facilities are for
the sole benefit of Tract 42902 and not for
any other property.
5. Equity does not require reimbursement of
Relco by Lewis because Lewis has purchased the
property for Tract 45402 and has, therefore,
also purchased the improvements installed by
Relco on that site. To require reimbursement
to Relco would require Lewis to pay twice for
the same improvements.
G. Tentative Tract Map 45402 meets the require-
ments of Titles 18 and 19 of the Azusa Municipal
Code and the State Subdivision Map Act.
H. The proposed subdivision, together with the
provisions of its design and improvements, is
consistent with the General Plan of the City of
Azusa.
I. The site is physically suitable for the type
of development proposed.
J. The site is physically suitable for the
proposed density of development.
K. The design of the subdivision and the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitats.
L. The design of the subdivision and type of
improvements is not likely to cause serious public
health problems.
M. The design of the subdivision and type of
improvements will not conflict with easements

acquired by the public at large for access through
or uses of the property within the proposed
subdivison.
N. In taking this action the City Council
considered the effects of the decision on the
housing needs of the region in which the City is
located and balanced those needs against the public
service needs of the City's residents and available
fiscal and environmental resources.
SECTION 2. The appeal of Relco Industries is
hereby denied and the City Council hereby declines to impose
upon Lewis Homes the requirement for reimbursement of the
cost of improvements for Tract 42902 installed by Relco on
the basis of the findings set forth above. Tentative Tract
Map No. 45402 is hereby approved on the basis of the
findings set forth above, subject to the conditions set
forth on Exhibit "A" which is attached hereto and incorpor-
ated herein by reference as though set forth in full.
SECTION 3. The City Clerk shall certify the
adoption of this Resolution.

a. Construct any required sewers in order to connect to
existing sewage system.
b. Extend existing water system of sufficient size to
provide adequate water for domestic purposes and fire
protection for each lot of the complex. No on-site
water system will be maintained by the City of Azusa.
Developer will be responsible for sizing water meters,
and the complex shall be master metered up to a maximum
of 4 to 6 meters. 8" ductile iron water main pipe shall
be used to serve the area.
The new main shall be tied into the existing 8" water
main on Highway 39 and also on Azusa/ San Gabriel Canyon
Road at the north end of the Crystal Canyon Project. A
set of plans for this construction shall be submitted to
the mater Superintendent for his approval, prior to
construction.
C. Extend the storm drain system from MTD 1121 of Tract
44104 to conform with the master plan of drainage for
the parent Tentative Tract No. 42902. All storm drain
design shall conform to L.A. Co. Flood Control Standards
for Miscellaneous Transfer drain Requirements and shall
be submitted to the appropriate department of the
District for checking.
d. Public utility easements, as determined by the City
Engineer, and the Utility Director shall be dedicated to
the City.
e. Any and all utilities shall be placed underground.
f. A site grading plan showing proposed buildings, pad
elevations and method of disposal of all surface run-off
waters shall be submitted to the Building Department and
the City Engineer for approval.
g. San Gabriel Canyon Road and Azusa and San Gabriel Road
shall be improved including but not limited to curbs,
gutters, sidewalks, driveway aprons, street lights,
street trees, fire hydrants, and other standard
improvements as determined by the City Engineer, the
Utility Director, and/or Caltrans within the bounds of
tract/to the centerline except for fire hydrant
extensions.
h. No facilities for household gas service exist for the
development at this time. Please call Mr. Pat McGrew of
the Southern California Gas Company at (818) 307-6530
for information on costs for extending existing
facilities into the development area.
i. An adequate lighting system shall be provided and
maintained at all times for all parking areas, walkways
and enclosed areas within the development. Plans for
such a system shall be prepared and submitted to the
Light and Power Department for review and approval prior
to start of construction.
j. Police Department Requirements:
1.
Double lock key mechanisms for entry doors.
2.
Proper lighting for all enclosed
areas and
parking
facilities.
3.
Apartment numbers that can be seen
from the
walkway.
4.
An apartment complex guide at all
entries
into the
complex showing where apartment
numbers
can be
located within the facility.

5. All parking areas legally signed to include fire
access ways.
6. All aisles, passageways and recessed areas in
relation to the building complex should be
illuminated properly.
7. Necessary turning lanes are engineered and stop
signs for entry and exit areas on Azusa Avenue and
San Gabriel Canyon Road.
k. Fire Department Requirements:
1. Provide water mains, fire hydrants, and fire flows
as required by the County Forester and Fire Warden
for all land shown on the map to be recorded.
2. Provide Fire Department and city approved street
signs, and building address numbers prior to
occupancy.
3. Fire Department access shall extend to within 150
feet distance of any portion of structures to be
built.
4. The private driveways shall be indicated on the
final map as "FIRE LANES" and shall be maintained in
accordance with the Los Angeles County Fire Code.
5. All required fire hydrants shall be installed,
tested and accepted prior to construction.
Vehicular access must be provided and maintained
serviceable throughout construction.
6. The required fire flow for public fire hydrants at
this location is 2,000 gallons per minute @ 20 psi
for a duration of 2 hours, over and above maximum
daily domestic demand.
7. The realuired on-site fire flow for private on-site
hydrants is 2,500 gallons per minute at 20 psi.
Each private on-site hydrant must be capable of
flo:ainq 1,250 gallons per minute at 20 psi with any
two hydrants flowing simultaneously.
S. Fire Hydrant requirements are as follows: Install 8
Public Fire Hydrant(s). Install 2 Private On -Site
Fire Hydrant(s).
9. All hydrants shall measure 6" X 4" X 2 1/2" brass or
bronze, conforming to current AWWA standard C503 or
approved equal. All hydrants shall be installed a
minimum of 25' from a structure or protected by a
(2) two hour fire wall. Location: as per map on
file with this office.
10. All required fire hydrants shall be installed,
tested and accepted prior to construction.
Vehicular access must be provided and maintained
serviceable throughout construction.
11. Comments: Fire flow may change, based on building
plans. All hydrants shall be installed in
conformance wiht Title 20, L.A. County Government
Code or appropriate city regulations. This shall
include minimum six-inch diameter mains.
Arrangements to meet these requiremetns must be made
with the water purveyor serving the area.
1. Where plans are required for compliance with any of the
above conditions, such plans shall be prepared by a
Registered Civil engineer and submitted to the City
Engineer for approval.
M. An irrigation system for the watering of street trees
shall be provided and plans for same submitted to the
Public works Superintendent for approval.
n. All conditions attached to Conditional Use Permit Case
No. 305 shall become a part herein.

o. Permits for all on and off site construction shall be
obtained in the Community Development Department at 213
E. Foothill Boulevard.
p. All contractors and their sub contractors shall obtain a
business license form the Business License Officer in
the Community Development Department.
q. All required fees shall be paid.
r. A 10' property dedication for street purposes shall be
made on the west side of Azusa and San Gabriel Canyon
Road.
