RESOLUTION NO. 8342
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA ESTABLISHING THE AMOUNT OF
THE OFFER TO BE MADE PURSUANT TO
GOVERNMENT CODE SECTION 7267.2 FOR
SOUTHERN CALIFORNIA EDISON'S ELECTRICAL
DISTRIBUTION FACILITIES LOCATED AT THE
800 BLOCK OF ALOSTA AVENUE, AZUSA,
CALIFORNIA
WHEREAS, the electrical distribution facilities
located at the 800 block of Alosta Avenue in Azusa, more
particularly described in Exhibit "B" which is attached
hereto and incorported herein by reference, are owned by
Southern California Edison; and
WHEREAS, the 800 block of Alosta Avenue is an area
which has been annexed to the City of Azusa; and
WHEREAS, the City of Azusa desires to acquire said
electrical distribution facilities for electrical service
purposes; and
WHEREAS, Government Code Sections 7267.1(a) and
7267.2(a), require that a fair market value be established
by an independent appraiser which serves as the basis for
determining the amount of just compensation; and
WHEREAS, the subject electrical distribution
facilities have been appraised by an independent appraiser
in a competent manner in accordance with the Code and other
applicable regulations; and
WHEREAS, the independent appraiser has established
the fair market value of the subject facilities at:
$38,243.00; and
WHEREAS, the California Administrative Code Title
25, Chapter 6, indicates that the owner of the subject
property is not obligated to accept the above mentioned
value and is entitled to present evidence as to the amount
they believe is the value of the property; and
WHEREAS, California Government Code Section
7267.1(a) requires that prior to the acquisition of property
through eminent domain the condemning entity must attempt to
acquire the property through negotiation; and
WHEREAS, California Government Code Section
7267.2(a) requires the condemning entity to establish an
amount which it believes to be just compensation therefor
and to offer to purchase the property for that amount;
NOW, THEREFORE BE IT RESOLVED, the City Council of
the City of Azusa determines the amount of just compensation
to be offered for the electrical distribution facilities at
the 800 Block of Alosta Avenue, Azusa to be the sum $38,243
and hereby authorizes the offer for the purchase of the
subject facilities to be made at the said purchase price,
