HomeMy WebLinkAboutResolution No. 84770 0 RESOLUTION NO. 8477 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ORDERING, CALLING, PROVIDING FOR, AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON NOVEMBER 8, 1988, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY ORDINANCES RELATING TO GENERAL TAXES AND AN ADVISORY MEASURE RELATING TO FIREWORKS AND CONSOLIDATING SAID ELECTION WITH THE STATE, TO BE HELD ON SAID DATE. WHEREAS, the Legislative body of the City of Azusa desires to submit to the qualified voters of said City proposed Ordinances relating to general taxes and an advisory measure relating to allowing safe and sane fireworks in the city for the Fourth of July holiday, and WHEREAS, the City Council of the City of Azusa is thereupon authorized and directed by statue to submit the Ordinances to the qualified voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That a special election to be held and the same is hereby called to be held in said City on November 8, 1988, for the purpose of submitting to the qualified voters of said City ordinances hereinafter set forth relating to general taxes and an advisory measure relating to allowing safe and sane fireworks in the city for the Fourth of July holiday. SECTION 2. The proposed Ordinances submitted to the voters shall be as set forth on Exhibit A to this Resolution. SECTION 3. That the polls for said election shall be open at 7:00 a.m. of the day of said election and shall remain open continuously from said time until 8:00 p.m. of the same day when said polls shall be closed except as provided in Section 14301 of the Elections Code of the State of California. SECTION 4. That on the ballots to be used at said special election in addition to any other matters required by law there shall be printed substantially the following: PROPOSITION NO. : SHALL ORDINANCE NO. 2373 WHICH : PROVIDES FOR ESTABLISHING A TAX: : ON OFF-SITE, MULTI-USER : HAZARDOUS WASTE FACILITIES IN : YES : AN AMOUNT SET BY RESOLUTION OF : : THE CITY COUNCIL OF UP TO TEN : PERCENT (10%) OF GROSS RECEIPTS: : BE APPROVED? NO 0 0 PROPOSITION NO. : SHALL ORDINANCE NO. 2374 WHICH : : (1) INCREASES THE TAX ON SANI- : : TARY LAND FILLS AND DISPOSAL : FACILITIES FROM TWO PERCENT : YES : (2$) TO TEN PERCENT (10%), (2) : : INCREASES THE MINIMUM TAX FROM : : $35,000 TO $100,000 PER YEAR, : AND (3) PROVIDES FOR A YEARLY NO : INCREASE OF TAX IN THE AMOUNT : OF THE PERCENTAGE INCREASE IN : THE CONSUMER PRICE INDEX BE APPROVED? PROPOSITION NO. : SHALL ORDINANCE NO. 2375 WHICH : PROVIDES FOR AN INCREASE IN : THE TRANSIENT OCCUPANCY TAX . ("HOTEL TAX") FROM SEVEN AND- YES : ONE-HALF PERCENT (7.5$) TO TEN : PERCENT (10%) BE APPROVED? NO PROPOSITION NO. SHALL ORDINANCE NO. 2376, WHICH PROVIDES (1) AN ADDITION-: AL FLAT FEE FOR CERTAIN BUSINESS LICENSES, (2) A YEARLY INCREASE IN BUSINESS YES LICENSES AND CERTAIN TAXES BASED UPON THE PERCENTAGE INCREASE OF THE CONSUMER PRICE : INDEX AND BUSINESS GROWTH, AND : NO (3) PROVIDES FOR THE DEPOSIT OF: TAXES IN THE CITY'S GENERAL FUND, BE APPROVED? PROPOSITION NO. SHALL ORDINANCE NO. 2377 WHICH ESTABLISHES AN ADMISSIONS TAX ON CERTAIN EVENTS AND PARKING IN THE SUM OF TEN PERCENT (10%) OF THE ADMISSION PRICE, BE APPROVED? - 2 - YES NO 0 PROPOSITION NO. SHALL ORDINANCE NO. 2378, WHICH PROVIDES FOR A YEARLY INCREASE OF TAXES FOR MINING, EXCAVATION, AND WOOD PROCESSING, IN THE PERCENTAGE OF THE CONSUMER PRICE INDEX, BE APPROVED? PROPOSITION NO. ADVISORY VOTE ONLY: : SHALL SAFE AND SANE FIREWORKS : BE PERMITTED WITHIN THE CITY : OF AZUSA FOR THE FOURTH OF : JULY HOLIDAY? YES NO YES NO SECTION 5. That a cross (+) placed in the voting square after the word "YES" in the manner hereinabove provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the work "NO" in the manner hereinabove provided shall be counted against the adoption of the proposition. SECTION 6. That the special election hereby called for the date hereinabove specified shall be and is hereby ordered consolidated with the special state election to be held on said date and within the City. The polling places and officers of said election for the special municipal election hereby called shall be the same as those provided for said special state election. The Board of Supervisors of Los Angeles County is hereby requested to order the consolidation of the special municipal election hereby called with said special state election and the Registrar -Recorder of Los Angeles County is hereby authorized to canvass the returns of said special municipal election and said election shall be held in all respects as if there were only one election and only one form of ballot, namely the ballots used at said general election shall be used. Said Registrar -Recorder shall certify the results of the canvass of the returns of said special municipal election to the City Council of said City and shall thereafter declare the results thereof. SECTION 7. That notice of said time and place of helding said election hereby given and the City Clerk is hereby authorized, instructed, and directed to give such further or additional notice of said election in time, form and manner as required by law. - 3 - 0 0 SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution, shall enter the same in the book of original Resolutions of said City and shall make a minute of the passage and adoption thereof in the records in the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
