HomeMy WebLinkAboutResolution No. 83890 0 RESOLUTION NO. 8389 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA WAIVING FORMAL BIDDING PROCEDURES AND AUTHORIZING PURCHASE OF AN ALUMINUM DOME ROOF FOR RESERVOIR NO. 1 AND MAKING NECESSARY FINDINGS REQUIRED BY THE PUBLIC CONTRACTS CODE THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1: The City Council of the City of Azusa does find, determine and declare that: A. On February 9 and February 17, 1988, two severe windstorms damaged the plastic bubble roof on Reservoir No. 1 causing it to collapse into the reservoir; B. Since then the City Water Department has had to increase the chlorination of the water in the reservoir as well as continuously chlorinate it to insure water quality. With a cover on the reservoir such efforts would not be required because the cover would keep numerous contami- nants out of the reservoir water. Additionally, the increased chlorination has caused a change in the taste of the water due to nonhazardous particles being dislodged from reservoir walls and water pipes, to residential and commercial customers; C. In addition to the water quality problems, the lack of a roof structure on the reservoir has caused substantial security and safety problems. The roof structure prevented persons from contaminating the water supply. Despite the fact that a fence is around the perimeter of the reservoir, it is now possible for people to throw objects or contaminants into the reservoir without climbing over the fence. City staff has noticed an increase in the number of persons at or near the reservoir since the roof collapsed; D. The public interest and necessity demand, therefore, the immediate expenditure of public money to safeguard life, health and property with respect to the installation of a dome roof for the reservoir. Council also finds that it would be impractical, useless or uneconomical in such circumstances to follow the bidding procedures and that the public welfare would be promoted by dispensing with them. SECTION 2: Pursuant to the authority of Section 20168 of the Public Contract Code, Chapter 2.68 of the Azusa Municipal Code, and other applicable law, the City Council hereby waives the formal bid procedures for purchase and installation of an aluminum dome roof for Water Reservoir No. 1 in an amount not to exceed $210,000, and further authorizes appro- priation of funds from the water retained earnings to fund this expenditure. • SECTION 3. This project is exempt from the provisions of the California Environmental Quality Act pursuant to the provisions'of 14 Cal.Admin.Code Section 15301 as a Class 1 categorical exemption based upon the fact that the project consists of the repair and minor alteration of an existing public structure and involves no expansion of use beyond that previously existing. The project is also exempt under the provisions of 14 Cal.Admin. Code Section 15269 as an emergency project based upon the fact that the project consists of emergency repairs to a public service facility necessary to maintain service and as a specific action necessary to prevent or mitigate an emergency. SECTION 4. The City Clerk shall certify to the adoption of this resolution.
