RESOLUTION NO. 8432
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA APPROVING PRECISE PLAN OF
DESIGN P-88-35 FOR PROPERTY LOCATED AT
203 NORTH ASPAN AVENUE (E.T. LEGG AND
ASSOCIATES)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. An application was duly filed by E.T.
Legg and Associates ("applicant") for a Precise
Plan of Design for the construction of a 44,730
square foot industrial complex on property located
at 203 North Aspan Avenue, City of Azusa.
B. A duly noticed public hearing on the
application for the Precise Plan of Design P-88-35
was held by the Planning Commission of the City of
Azusa on April 6, 1988, and after considering all
of the evidence submitted on the application, the
Planning Commission approved the Precise Plan by
Resolution No. 2558.
C. On April 18, 1988, a timely appeal of the
Planning Commission's action was filed by the
Community Redevelopment Agency ("Agency") of the
City of Azusa to appeal the approval of Precise
Plan of Design No. P-88-35.
D. On May 16, 1988, the City Council of the
City of Azusa held a duly noticed public hearing on
the appeal of Precise Plan of Design No. P-88-35,
at which time the Agency, the applicant, and all
others were given the opportunity to speak on the
proposed action and all written and documentary
evidence was received by the Council.
E. In taking this action, the City Council
has considered the effects of the decision on the
housing needs of the region in which the City is
located and balanced those needs against the public
service needs of the City residents and available
fiscal and environmental resources.
SECTION 2. Having considered all of the oral and
written evidence presented to it at the public hearing, the
City Council specifically finds that:
A. The proposed industrial complex is
located within the West End Redevelopment Project
Area. It consists of two, large multi -tenant
industrial buildings with parking provided between
the buildings and at the northern end of the
parcel. The Redevelopment Agency staff supported
the Planning Department's recommendation to deny
Precise Plan P-88-35 due to confusing and

inefficient interior circulation, inadequate
interior landscaping, inadequate separation of
pedestrians and vehicles, and unattractive facades
and overall aesthetics.
B. The applicant revised the Precise Plan
before submittal at the Planning Commission public
hearing held on April 6, 1988. The Planning
Commission approved Precise Plan of Design P-88-35
as revised. As revised, the Precise Plan still
contained problems relating to circulation, traffic
separation and exterior design issues. The
proposed project met minimum code requirements but
represented substandard development.
C. The Redevelopment Agency staff has met
with the applicant to review the Precise Plan of
Design. Several revisions were made to address
circulation, safety, and landscaping concerns. In
order to permit the project to be constructed as
proposed, the Agency has indicated that a
Conforming Owner Agreement will be prepared to
permit a reduction in the building setback
requirement of the M-1 Zone.
D. Pursuant to State CEQA Guidelines, a
Negative Declaration has been prepared and
reviewed, finding that the proposed project could
not have a significant effect on the environment,
and is hereby approved and adopted by the City
Council.
E. In accordance with Section 19.56.050 of
the Azusa Municipal Code, the project would not
substantially depreciate property values in the
vicinity and would not unreasonably interfere with
the use or enjoyment of property in the vicinity by
the occupants thereof, and would not adversely
affect the public peace, health, safety or general
welfare to a degree greater than that generally
permitted in said Municipal Code, provided the
conditions of approval are adhered to.
SECTION 3. Based on the findings set forth in
Section 2 of this Resolution, the City Council of the City
of Azusa hereby grants the appeal filed by the Commmunity
Redevelopment Agency and approves Precise Plan of Design P-
88-35 submitted by applicant E.T. Legg and Associates and as
revised by the Agency and the applicant, subject to the
conditions of approval attached hereto as Exhibit "A", and
subject to the Agency's approval of a Conforming Owner
Agreement with the applicant.
SECTION 4. The City Clerk shall certify the
adoption of this Resolution.

at a regular meeting thereof, held on the 6th day of
