HomeMy WebLinkAboutResolution No. 84300 • RESOLUTION NO. 8430 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING ZONE CHANGE NO. Z- 261, GENERAL PLAN AMENDMENT NO. 87-4, AND CONDITIONAL USE PERMIT NO. C-457 FOR THE PROPOSED ROCK QUARRY ON PROPERTY LOCATED AT 1850 FISH CANYON ROAD THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. An application was made by Mr. Robert G. Restivo for Zone Change Z-261, General Plan Amendment No. GPA 87-4, and Conditional Use Permit No. C-457 in connection with the proposed rock quarry to be located at 1850 Fish Canyon Road in the City of Azusa (hereafter "Project".) B. A Draft Environmental Impact Report for the Project was prepared for the zone change. Following public comment on said draft a Final Environmental Impact Report was also prepared. C. Duly noticed public hearings on the application for the Zone Change, General Plan Amendment and Conditional Use Permit were held by the Planning Commission of the City of Azusa on February 16, 1988 and March 23, 1988, and after considering all the evidence submitted on the application, the Planning Commission recommended denial of the Zone Change, the General Plan Amendment, and the Conditional Use Permit by Resolution Nos. 2544, 2545, and 2546, respectively. D. Thereafter, on May 2, 1988 and May 16, 1988, the City Council of the City of Azusa held duly noticed public hearings on the application for the Zone Change, General Plan Amendment, and Conditional Use Permit, at which time the applicant and all others were given the opportunity to speak on the proposed action and documentary evidence was received by the Council. E. In taking this action, the City Council has considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources. SECTION 2. Having considered all of the oral and written evidence including, but not limited to, the Draft Environmental Impact Report, the Final Environmental Impact Report, staff reports, and testimony from the applicant and numerous concerned citizens, presented at the public hearings, the City Council hereby denies approval of the application for Zone Change No. Z-261, General Plan 0 0 Amendment No. GPA 87-4 and Conditional Use Permit No. C-457 based on the following findings: A. The proposed project is located upon a 20 -acre site which is situated along Fish Canyon Road in the northwestern portion of Azusa. The property is zoned W (Water Conservation). The excavation of rock is prohibited in the W Zone pursuant to Azusa Municipal Code Section 19.36.020. B. The proposed project would require a zone change from W (Water Conservation) to M-2 (General Manufacturing) in order to permit rock excavation; a general plan amendment from C (Conservation) to HI (Heavy Industrial) in order to insure consistency between the General Plan and the zoning of the property; and a conditional use permit, for the operation of a rock crusher in the M-2 Zone (Municipal Code Section 19.34.030 (48) and (50). The ultimate land use, after quarrying is complete, is proposed to be industrial. C. The subject property is generally surrounded by a mixture of land uses. The San Gabriel River Channel is located to the east of the property. To the northeast and northwest are areas zoned CF (Community Facilities) that are utilized for commercial or passive recreational uses; a hiking trail leading into Fish Canyon begins on an adjacent parcel. A large single-family residential tract within the City of Duarte is situated to the southwest of the subject property. The only other M-2 zoned property in the vicinity of the subject parcel is utilized as a rock quarry at the toe of the foothills to the northeast of the site. The General Plan envisions the subject area as permanent open space with low intensity public recreation uses. D. The proposed Zone Change No. Z-261 to allow a zone change from W to M-2 should be denied because the long term projected use of the site is inconsistent with the land uses found in the Azusa General Plan and would prove to be incompatible with adjacent residential land uses. The topography of the site is not suitable for industrial development. The slope stability of the hillside during and after the proposed operations has been questioned, and could result in a dangerous condition for future uses of the site. Further, the proposed development of the property would result in significant environmental impacts affecting vegetation and wildlife, air quality, noise levels, geologic resources, truck traffic, and aesthetic concerns. E. The proposed General Plan Amendment No. GPA 87-4 to change the General Plan designation of C (Conservation) to HI (Heavy Industry) should be denied because the long-term use of the site is inconsistent with land use policies established by the City of Azusa which call for the use of the area for conservation purposes. The future uses -2- fjn/RES1850 0 0 would be incompatible with adjacent residential land uses. The topography of the site is too steep for industrial land use, requiring massive hillside cutting. Further, the proposed development of the property would result in significant environmental impacts affecting vegetation and wildlife, air quality, noise levels, geologic resources, truck traffic, and aesthetic concerns. F. The proposed Conditional Use Permit No. C-457 to allow operation of a rock quarry should be denied because the proposed quarrying operation would result in significant impacts on the area: endangered vegetation and wildlife habitat would be destroyed; substantial vehicle and dust emissions would be produced; intermittent and intrusive noise levels would be increased; potentially unstable hillside areas would be disturbed; increased truck traffic would accelerate road degradation; excavation would result in an unsightly visual hillside character; and the land use would be incompatible with established land use policy, land use designations included within the Azusa General Plan and surrounding single-family residential neighborhoods. G. The Final Environmental Impact Report prepared for the Project was presented to the City Council and the Council reviewed and considered the information contained therein. In light of the denial of the proposed Zone Change, General Plan Amendment, and Conditional Use Permit, the Council has taken no action with regard to the Final Environmental Impact Report. SECTION 3. The City Clerk shall certify the adoption of this Resolution.
