HomeMy WebLinkAboutResolution No. 85390 0 RESOLUTION NO. 8539 A RESOLUTION OF THE CITY OF AZUSA REGARDING THE SALARIES AND BENEFITS OF ITS NON -REPRESENTED NON -CLASSIFIED EMPLOYEES OF THE HEADSTART/STATE PRE-SCHOOL PROGRAM. THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. Whereas, the City of Azusa adopted Resolution No. 8373 on the 1st day of February, 1988, approving the application for licensing under the California Department of Social Services for the Azusa Headstart/Pre-School Program; SECTION 2. Whereas, it is appropriate to formally establish salaries and benefits for employees of this program; SECTION 3. Now, therefore, be it resolved that the the City Council of the City of Azusa does hereby grant certain salaries and benefits to the employees appointed to the position classifications of the Headstart/State Pre -School Program as indicated in Exhibits A and B. SECTION 4. The City Clerk shall certify to the adoption of this resolution. AYES: COUNCILMEMBERS: AVILA, STEMRICH, NARANJO, LATTA, MOSES NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: 11N( 0 0 AZUSA HEADSTART/PRE-SCHOOL PROGRAM BENEFITS AND SALARIES (Exhibit A) FULL-TIME WORK WEER CATEGORIES FORTY (40) HOUR WORK WEEK For the following classifications, the full-time work week shall be forty (40) hours per week, eight (8) hours per day. Typist Clerk Intermediate Typist Clerk Senior Typist Clerk Assistant Teacher I Assistant Teacher II The hourly rate of pay is determined by taking the figure on the attached Exhibit B (ranges and steps), multiply by 12, divide by 52, and again divide by 40. Work Week and Timekeeping Interval Work Week The regular work week for all employees covered by this category shall be forty hours in a seven (7) day period beginning at 12:01 a.m. each Sunday and consists of five (5) days a week and eight (8) hours per day. Daily hours of work or shifts for employees within departments shall be assigned by the department head, as required to meet the needs of the department. Timekeeping Interval In compliance with FLSA, the minimum timekeeping interval shall be fifteen (15) minutes. Periods of time of seven (7) minutes or less shall be rounded down and periods of time of eight (8) minutes or more shall be rounded up. Overtime/Compensatory Time Employees shall be entitled to overtime pay or compen- satory time off for all hours worked in excess of eight (8) hours in one work day or forty (40) hours within the employee's regular work week. For the purposes of this category, holiday pay, sick leave, and other compensated time off shall count for the hours. Compensatory time may be accumulated at the appropriate rate for each hour of overtime worked to the maximum accrual rate set by federal law. Page 1 of 7 AZUSA HEADSTARPPRE-SCHOOL PROGRAM BENEFITPAND SALARIES (11-7-88) Overtime pay or compensatory time off for overtime shall be accumulated in no less than fifteen minutes per day incre- ments. When an employee works less than fifteen minutes per day of overtime, the employee shall not receive compensatory time for such overtime. In order to be entitled to any compensation for overtime hours worked, such overtime work must have been authorized by the department head or the City Administrator. Accumulated compensatory time not taken off in the pay period in which it was earned, may be carried over to a maximum of two hundred forty (240) hours (160 hours worked at time -and -one-half would equal 240 hours). THIRTY-FIVE (35) HOUR WORK WEER For the following classifications, the full-time work week is defined as 35 hours per week, seven (7) hours per day. Individuals may be appointed at either full-time or part-time status. Project Director Area Supervisor The hourly rate of pay is determined by taking the figure on the attached Exhibit B (ranges and steps), multiply by 12, divide by 52, and again divide by 35. Work Week and Timekeeping Interval Work Week The regular work week for all employees covered by this category shall be thirty-five hours in a seven (7) day period beginning at 12:01 a.m. each Sunday and consists of five (5) days a week and seven (7) hours per day. Daily hours of work or shifts for employees within departments shall be assigned by the department head, as required to meet the needs of the department. Timekeeping Interval In compliance with FLSA, the minimum timekeeping interval shall be fifteen (15) minutes. Teacher I Teacher II The hourly rate of pay is determined by taking the figure on the attached Exhibit B (ranges and steps), multiply by 12, divide by 52, and again divide by 30. Work Week and Timekeeping Interval Work Week The regular work week for all employees covered by this category shall be thirty hours (30) in a seven (7) day period beginning at 12:01 a.m. each Sunday and consists of five (5) days a week and six (6) hours per day. Daily hours of work or shifts for employees within departments shall be assigned by the department head, as required to meet the needs of the department. Timekeeping Interval In compliance with FLSA, the minimum timekeeping interval shall be fifteen (15) minutes. MISCELLANEOUS The following classification is unbenefitted part-time and shall receive a flat rate of pay of $15.00 per hour: Nurse OTHER POSITIONS Other classifications from the attached Exhibit B may be placed in one of the above categories by amendment of this resolution. BENEFITS The following benefits shall apply to persons hired for full-time employment: Retirement The City shall enroll eligible employees in the Public Employees' Retirement System (PERS) under the 112% @ 60 full formula" plan, and shall pay the entire employee's share as a benefit. Cafeteria Benefit Plan Amount of Monthly Benefit The City will maintain the Cafeteria Benefit Plan (CBP) at three hundred thirty-seven ($337) dollars per month for eligible employees. This plan may be used by the employee to pay, to the extent available, for individual or dependent health coverage, dental plan, life insurance, up to fifty percent (50%) of membership fees for a health club or similar organization, deferred compensation, or other available group insurance, or any combination of these items. The employee understands that in the event the total Page 4 of 7 AZUSA HEADSTARPPRE-SCHOOL PROGRAM BENEFITOIAND SALARIES (11-7-88) premiums and/or expense for options selected by him/her exceeds the amount of the City's contribution of three hundred thirty-seven ($337) dollars per month, the excess shall be deducted from gross wages of the employee. If eligible employees wish to maintain benefits during the months in which they are not employed (and it is anticipated they will return the next school year, arrangements may be made to make payments to the City of Azusa to continue benefits until the next season, at which time eligibility will need to be reestablished. Eliaibilit In order for an employee to be eligible for the CBP in any given month, he/she must be on payroll for fifteen days within that month. If an employee does not meet the qualifying work time, arrangements must be made with the Finance Department to reimburse the City for any benefits that have already been paid out on the employee's behalf for that month. The Finance Department will notify the employee if he/she has not worked sufficient days to qualify for the CBP. New employees will be eligible for the full CBP Plan if they begin work prior to the 16th of the month. Employees whose date of hire is on the 16th or thereafter will not be eligible for CBP for that month. Termination It is agreed that the City will not be responsible for payment of any insurance premium(s) on behalf of an employee following the month of termination. If an employee wishes to continue his or her benefits, advance payment for such premium(s) will be deducted from the CBP for the employee, or if he or she is not eligible for this plan, then the deduction shall be made from the employee's final paycheck. Sick Leave Sick Leave shall not be construed as a right which an employee may use at his or her discretion, but shall be allowed only in case of necessity or actual sickness or disability and shall accrue at the rate of one day per month, with unlimited accumulation. Bereavement Leave An employee may be permitted to take up to five (5) days of Bereavement Leave in the event of the death of a member of his or her immediate family. "Immediate family" member is herewith defined as a mother, father, brother, sister, spouse Page 5 of 7 AZUSA HEADSTARPPRE-SCHOOL PROGRAM BENEFIT91AND SALARIES (11-7-88) child, mother-in-law, father-in-law, grandparents, or relative living within the employee's household. Persons in loco parentis may also be considered under certain circumstances. Such leave shall not be charged against the employee's Sick Leave or Vacation. In addition to Bereavement Leave, an employee may request up to two (2) days of Sick Leave in the event of the death of an immediate family member. Such leave shall be charged against the employee's accrued Sick Leave balance and shall be considered in calculating his or her ability to convert the balance. Holidays Designated Holidays The employee shall receive time off with pay for the following holidays but only if the employee is paid for the workday that precedes or follows the holiday: November 11 November 24 November 25 December 26 January 2, 1989 January 16 February 13 February 20 May 29 Other Veteran's Day Thanksgiving Day Day after Thanksgiving Day Monday after Christmas Monday after New Year's Day Martin Luther King's Birthday Lincoln's Birthday Washington's Birthday Memorial Day December 19 to January 2 Winter Break March 20 to March 24 Spring Break Lay Off In the event employees are laid off from their employment, a minimum of fifteen (15) calendar days notice will be given to each affected employee. Such notice shall be in writing and signed by an appropriate management employee. Industrial Leave The City will follow the minimum requirements as per the law. Persons employed part-time in one of the above categories shall be compensated at the same scheduled hourly rate as would his or/her full-time counterpart. Page 6 of 7 AZUSA HEADSTARPPRE-SCHOOL PROGRAM BENEFITPIAND SALARIES (11-7-88) The following benefits shall apply to persons hired for part-time employment: Part-time employees who work five (5) hours a day or more shall receive the benefits listed for full-time employees pro -rated according to the number of hours they are scheduled to work on a recurring basis; e.g., if a part-time employee in a classification in the seven -hour category was budgeted or scheduled for five (5) hours per day, his/her Cafeteria Benefit Plan would be calculated by multiplying $337 by 5 and dividing by 7 (_ $241/month) Part-time persons scheduled to work less than five hours per day shall not receive the above listed benefits; but shall receive only those listed below and those required by state or federal law: Retirement Any part-time non -classified employee who works in excess of one thousand (1,000) hours in the fiscal year and who qualifies as defined by the Public Employees' Retirement System (PERS) shall have his/her contribution to the PERS paid by the City. Holiday Pay Any part-time non -classified employee who is hired to work twenty (20) or more hours each week on a consistent basis throughout the fiscal year shall be entitled to a pro -rated paid holiday not to exceed one-half day (4 hours). Holidays observed in 1988-89 shall be the following days provided the employee is on the payroll the day before the holiday or the day after: November 11 Veteran's Day November 24 Thanksgiving Day November 25 Day after Thanksgiving Day December 26 Monday after Christmas January 2, 1989 Monday after New Year's Day January 16 Martin Luther King's Birthday February 13 Lincoln's Birthday February 20 Washington's Birthday May 29 Memorial Day Overtime Pay A part-time employee shall be entitled to premium pay for all hours worked in excess of the annual level of regular weekly full-time hours established for the employee's work week category. Holiday pay shall count towards the hours required.
