HomeMy WebLinkAboutResolution No. 85580 0 RESOLUTION NO. 8558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE NEGATIVE DECLARATION FOR ZONING CODE AMENDMENT 161 --SALE OF ALCOHOL IN AUTOMOBILE SERVICE STATIONS WHEREAS, an Initial Study of Environmental Impact and a Negative Declaration have been prepared for Zoning Code Amendment 161 --Sale of Alcohol in Automobile Service Stations (hereinafter "Project") in accordance with the provisions of the California Environmental Quality Act and the State CEQA Guidelines; WHEREAS, a duly -noticed public hearing was held by the Planning Commission for the City of Azusa on the 9th day of November, 1988, and the City Council of the City of Azusa on the 19th day of December, 1988, at which times evidence was heard on the proposed Project and the Negative Declaration; WHEREAS, prior to approving the Project the City Council of the City of Azusa considered the Initial Study of Environmental Impact and the Negative Declaration together with any comments received during the public review process; WHEREAS, the City Council of the City of Azusa hereby finds and determines that on the basis of the Initial Study and any comments received in the public review process, there is no substantial evidence that the Project will have a significant adverse effect upon the environment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AZUSA that the Negative Declaration for the Project, attached hereto as Exhibit "A" and by this reference incorporated herein, is hereby certified and approved and determined that this Negative Declaration shall be filed with the County Clerk of the County of Los Angeles. The City Clerk shall certify to the adoption of this Resolution. ADOPTED AND APPROVED this 3rd day of January , 1989. MAYOR . Comments from the public on the projects may be made in writing to the Community Development Director or at the public hearings on the project. PROJECT TITLE: Code Amendment No. 161 PROJECT LOCATION: Azusa, California 91702 PROJECT DESCRIPTION: Amendment to Azusa Municipal Code to permit sales of alcoholic beverages from automotible service stations with a conditional use permit for compliance with State Law PROJECT PROPONENT: City of Azusa A copy of the Initial Study, documenting reasons to support the findings that said project will not have a significant effect and containing any mitigating measures proposed to be included in the project to avoid potentially significant effects, is attached hereto for public review. An Environmental Impact Report is not required for this project. APPEALS. Any person or agency aggrieved by this decision may appeal to the Azusa City Council in compliance with all provisions for filing of such appeals. DISCUSSION OF ENVIRONMENTAL EVALUATION 13.a&b Addition of alcoholic beverage sales to existing service stations could generate additional traffic or need for parking Each case will be reviewed individually under the conditional use permit process, and parking and/or circulation modifications will be required if necessary. 14.b. Police Department is striving to increase community awareness of problems associated with drunk driving in order to reduce potential problems associated with additional alcoholic beverage sales from such locations. IV. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None Required DETERMINATION (To be completed by Lead Agency) On the basis of this initial evaluation: x I find the proposed project COULD NOT HAVE a significant effect on the environment, and a NEGATIVE DECARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
