HomeMy WebLinkAboutResolution No. 8673 RESOLUTION NO. 8673 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE AZUSA GENERAL PLAN FROM MEDIUM DENSITY RESIDENTIAL TO GENERAL COMMERCIAL FOR THE PROPERTY LOCATED AT 1171 WEST ARROW HIGHWAY AND FROM GENERAL COMMER- CIAL TO MEDIUM DENSITY RESIDENTIAL FOR THE PROPERTY LOCATED AT 1901 NORTH SAN GABRIEL CANYON ROAD AND FROM LOW DENSITY RESIDENTIAL TO MEDIUM DENSITY RESIDENTIAL FOR THE PROPERTY LOCATED AT 922-942 NORTH ANGELENO AVENUE (GENERAL PLAN AMENDMENT NO. GPA-89-1 ) THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS : SECTION 1 . The City Council of the City of Azusa does hereby find, determine and declare that : A. The General Plan Amendment which is the subject of this Resolution has been duly applied for by A.M.C . Clinical Laboratory, Inc. , for the property located at 1171 West Arrow Highway and was considered by the Planning Commission of the City of Azusa at a duly noticed public hearing held on April 26 , 1989 . An application for a General Plan Amendment was also duly filed by D&D Development Company/Johnny E. Johnson/Speckert Family Trust , and was considered by the Planning Commission at a duly noticed public hearing held on April 26 , 1989 . An application for a General Plan Amendment was also duly filed by Ella Duplesis , et al . for the properties located at 922-942 North Angeleno Avenue and was considered by the Planning Commis- sion at a duly noticed public hearing held on April 26 , 1989 . By Resolution No. 89-31 , the Planning Commission recommended that the City Council amend the land use designation for the property located at 11.71 West Arrow Highway from Medium Density Residential to General Commercial , and for the property Located at 1901 North San Gabriel Canyon Road from General Commercial to Medium Density Residential . By Resolution No . 89- 31 , the Planning Commission recommended to the City Council that the request to change the land use designation for the property located at 922-942 North Angeleno Avenue from Low Density Residential to Medium Density Residential be denied. B. On June 19 , 1989 and July 3, 1989 , the City Council of the City of Azusa held duly noticed public hearings to determine whether the land use designation for the subject properties should be amended in the General Plan as recommended by the Planning Commission . KVF e C. After public hearing and in consideration of all the oral testimony and written evidence presented at said public hearings , the City Council finds that : 1 . There is in effect a duly adopted General Plan for the City of Azusa which contains a Land Use Element designating all property within the City for certain land uses . 2 . The Arrow Highway property is located at 1171 West Arrow Highway, and legally described as : A portion of Section 3 , T15 RlOW, and as shown on a map on file with the Planning Commission. 3 . The San Gabriel Canyon property is located at 1901 North San Gabriel Canyon Road, and legally described as : Those portions of Lots 61 , 62, 74, and 75 of Subdivision #2 of Azusa Land & Water Company, in the City of Azusa, County of Los Angeles , State of California, as per Map recorded in Book 43 , Pg . 94 , of Miscellaneous Records in the Office of the County Recorder of said County and as shown on a Map on file with the Planning Commission . 4 . The North Angeleno Avenue property is located at 922-924 North Angeleno Avenue, and legally described as : Lots 14 , 15 , 16 , 17 , 18 and 19 of Block 11 , Map of Azusa . 5 . The adoption of an amendment changing the land use designation of the Arrow Highway property from Medium Density Residen- tial to General Commercial is in the interest of the public health, safety and welfare of the City and is consistent with good zoning and planning practices . The General Commer- cial Land Use designation requested is more appropriate for the development of this small parcel than a residential designation, due to its proximity to other nonresidential areas and its location on busy Arrow Highway . The change in land use designation of the subject property would be consistent with the principles of providing for orderly develop- ment contained in the Land Use Element of the General Plan. 6 . The adoption of an amendment changing the land use designation of the San Gabriel Canyon property from General Commer- cial to Medium Density Residential is in the interest of the public health, safety and welfare of the City and is consistent with good zoning and planning practices . The most appropriate long term use of the subject property is for a residential project . The proposed residential use of the property appears to be compatible with the surrounding FJN/RES3761 land uses . The moderate density would insure that the area is not overdeveloped or cause unnecessary impacts on the vicinity . Mayor Moses and Councilmember Latta abstain from participating in the vote to amend the land use designation of the San Gabriel Canyon property due to a conflict of interest . 7 . The adoption of an amendment changing the land use designation of the North Angeleno Avenue property from Low Density Residential to Medium Density Residential is in the interest of the public health, safety and welfare of the City and is consistent with good zoning and planning practices . The proposed residential designation is compatible with surrounding land uses . Councilmember Avila abstains from voting on the General Plan Amendment for the North Angeleno property due to a conflict of interest . Councilmember Latta votes against the adoption of an amend- ment changing the land use designation of the property. 8 . The amendment to the General Plan is internally consistent with the other elements of the General Plan . 9 . In taking this action, the City Council considered the effect of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources . SECTION 2 . The City Council of the City of Azusa does hereby amend the General Plan of the City of Azusa , Land Use Element , by changing the land use designation for the property located at 1171 Arrow Highway from Medium Density Residential to General Commercial , and the property located at 1901 San Gabriel Canyon Road from General Commercial to Medium Density Residential , and the property located at 922-942 North Angeleno Avenue from Low Density Residential to Medium Density Residential . Mayor Moses and Councilmember Latta abstain from participating in voting on the adoption of an amendment changing the land use designa- tion of the San Gabriel Canyon property due to a conflict of interest . Councilmember Avila abstains from participating in voting on the adoption of an amendment changing the land use designation of the North Angeleno Avenue property due to a conflict of interest . Councilmember Latta votes against the adoption of an amendment changing the land use designa- tion of the North Angeleno Avenue property. SECTION 3 . The Director of Housing and Community Development shall revise the Land Use Element of the General Plan of the City of Azusa to reflect the changes in said Element approved by this Resolution. -3- FJN/RES3761 0 0 SECTION 4 . The City Clerk shall certify to the adoption of this Resolution .
