The City Council of the City of Azusa met in regular session at the above time and place. Present at roll Call: Councilmen: Roll call. Dickerson,Strohmeier, McIntire, Arnold, Carr, Noes: None. Moved by Councilman Arnold, seconded by City Clerk in - Councilman McIntire that the City Clerk be strutted to sign authorized to sign a release of bond issued release on acting in favor of the City of Azusa on behalf of Chief of Police Fred E. An application for employment was presented by Frank Davies. Councilman Strohmeier offered an Ordinance entitled: ' AN ORDINANCE OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, REPEALING ORDINANCE NUMBER 324 OF SAID CITY. to be placed on its second reading. This Ordinance was then read. Moved by Councilman McIntire, seconded by Councilman Arnold that this Ordinance be adopted as read and numbered Ordinance No, 332. Councilman Strohmeier offered an Ordinance entitled: AN ORDINANCE OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, PROHIBITING THE DRINKING OF INTOXICATING LIQUOR UPON OR IN`PUBLIC STREETS, ALLEYS, SIDEWALKS, PARKS, PARKWAYS OR OTHER PUBLIC WAYS OF SAID CITY. to be placed upon its second reading. City Attorney Miller reported on an Ordinance written at the request of the County Health Department, to protect the City in case of a rabies epidemic. No action taken. Mayor Carr instructed Paul E. Smith, License Collector, to begin collection of dog licenses under the present Ordinances. Mr. C. H. Putnam -addressed the --Council relative to the beautification of the City by Spring planting. Mr. Putnam stated that he had ORDINANCE No, 332 ADOPTED. ORDINANCE No. 333 ADOPTED. Business men authorized to supply City's merchandise for month of February. City Attorney Miller reported on Ordinance to control rabies. Paul E. Smith instructed to collect dog licenses. 334 r� N 335 MINUTES OF THE CITY COUNCIL MEETING. FEBRUARY 7,_1938. 7:30 P. M. mailed out, to the citizens of Azusa, a questionnaire to ascertain their attitude toward a constructive plan for the planting of Mr. Putnam shrubs, trees, etc., and the response to this addressed the request was very gratifying. Council. The Council"instructed Mr. Putnam to contact the Planning Commission and to report back at the adjourned meeting February 14, 1938. Moved by Councilman Arnold, seconded by Councilman Dickerson that the Auditrn be author- ized to draw up a Purchase Order form in con- junction with the City Clerk, and present same to the City Council for approval. Councilman Arnold informed Auditor Robinson and the City Council that he acting in the capacity as Chairman of the Purchasing Committee, ordered work stopped on police uniforms, pur- chased from the Hirsch Uniform Company, and that his stop order was disregarded and state- ments presented for payment. F. M. Robinson stated that all he could do was accept the signed order for merchandise and approve same, in so far as there was no.minute notation cancelling the order. Councilman Strohmeier to City Attorney Miller: "Who referred the matter to you?" City Attorney: "All the invoices I had, were mentioned in my letters. It was my intention to mention them." Councilman McIntire to City Attorney: "Did you examine the affidavits attached to these papers?" Moved by Councilman Strohmeier, seconded by Councilman Arnold that this matter be referred to the Auditor to work out in connection with all invoices pertaining the The Hirsch Uniform Company and The Cameron Shirt Company. No action taken on this motion at this time. The City Attorney suggested that.the Auditor make a report now. ' Councilman Strohmeier: "Mr. Robinson, when you phoned The Hirsch Uniform Company what did they tell you regarding prices?" Mr. Robinson: "They said they only quoted wholesale prices to Dealers and,not to Cities and do not sell retail." City Attorney Miller: "The papers were sent me by the City Clerk and the Mayor requested me to take the matter up with the Companies. ' I then wrote letters to learn whether or not the law had been violated." Councilman Strohmeier to City Clerk: "Who ordered you to send papers to the City Attorney?" Mayor Carr: "I ordered her to send them." Councilman Strohmeier to City Attorney: "Are all the invoices mentioned in your letter?" City Attorney: "All the invoices I had, were mentioned in my letters. It was my intention to mention them." FEBRUARY 7, 1938. 7:30 P. M. City Attorney: "The Auditor and I are both agreed that the affidavits are in order and are in accordance with the bills." City Attorney ruled that the Council acts as a body. No Councilman can go out and nullify action of the Council. The Auditor realizes that this is true. Once in a while action of the Council does not conform with the opinion of all. When a purchase is made and authorzed by the Council, the only legal way to stop it is by bringing suit or having the Council rescind its action. No Councilman can stop a purchase in the manner attempted. He must bring suit to stop that action. The Council acts as a body and'thatorder stands until the law or Council stops it. Councilman McIntire: "The material purchased was signed for, the affidavits are attached, the City Attorney and Auditor have cleared the bills and I believe the bills should be paid without further action or arguement." City Attorney: "I doubt if that is the proper way. I believe that it should talm an action of the Council at this time to pay the bills. A motion could be made at the appropriate time that the bills be honored and paid. If it fails by action;of the Council, the bills would not be paid., If it carries, pay the bills. Councilman Arnold called attention -of the Council to a motion that had not been acted upon, namely that this matter be referred to the Auditor for checking. This motion failed'by the following vote: Ayes: Councilmen: Strohmeier, Arnold. Roes: Councilmen: Dickerson, McIntire, Carr, Absent: None. Moved by Councilman McIntire, seconded by Councilman Dickerson that the bills in question, Hirsch Uniform Company for $264.79 and Cameron Shirt Company for $88.95 be paid in view of the fact that City Attorney Miller ruled the affidavits attached thereto are in order, also that Auditor Robinson agreed,that the bills be paid. Carried by the following vote of the Council: Ayes: Councilmen: Dickerson, -McIntire,, Carr. Noes: Councilmen: Strohmeler, Arnold. Absent: None. , Moved by Councilman McIntire, seconded by Councilman Dickerson that in as muchas the Federal Bank Exchange have ruled that the City of Azusa's contract on bank deposits -does not conform to Federal Regulations,, that the -City Treasurer be instructed to meet with the Depository Bank and draft a new contract to ' be submitted for consideration. Carried by the following vote of the Council: Ayes: Councilmen: Dickerson, Strohmeier, McIntire, Arnold, Carr. Noes: None, Absent: None. Moved by Councilman Arnold, seconded by Councilman Strohmeibr that Superintendent of Light and Water, Jack Pierce, be instructed to adjust light rates on city energy with that of the Edison Company schedule, in rates. Carried by the following vote of the Council: Ayes: Councilmen: Dickerson, Strohmeier, McIntire, Arnold, Carr, Noes: None. Absent: None. Motion to refer bills to Auditor for checking failed to carry. Motion to pay bills carried. Matter of new contract between City of Azusa and Depository Bank referred to City Treasurer. Superintendent of Light and Water to adjust City energy rates. 338 339 MINUTES OF THE CITY COUNCIL MEETING. FEBRUARY 7, 1938. 7:30 P. M. Chief of Police Chester reported that he wished to order four "no left turn" signs made to assist in controlling Sunday traffic Chief of Police on the Boulevard; also that he wished to Chester's report. purchase steel files and office equipment for the Chief's Office and he also recommended that Edmund Thompson be placed on salary. Mayor Carr offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY RESOLUTION NO. ' OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, 1551 ADOPTED. APPOINTING EDMUND THOMPSON TRAFFIC POLICEMAN OF THE CITY OF AZUSA AND FIXING HIS COMPENSATION. Moved by Councilman Dickerson, seconded by Councilman McIntire that this -Resolution be adopted as read -and numbered Resolution No, 1551. Carried by the following vote of the Council: Ayes: Councilmen: Dickerson, Strohmeier, McIntire, Arnold, Carr. Noes: None, Absent: None. Mayor Carr offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RESOLUTION NO. AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPOINT- 1552 ADOPTED. ING CARL C. KIMBRELL TRAFFIC POLICEMAN OF THE CITY OF AZUSA AND FIXING HIS COMPENSATION. Moved by Councilman Arnold, seconded by Councilman Strohmeier that this Resolution be adopted as read and numbered Resolution No. 1552.
