MINUTES OF THE CITY COUNCIL MEETING. FEBRUARY 7, 1938. 7:30 P. M.
City Attorney: "The Auditor and I are both
agreed that the affidavits are in order and
are in accordance with the bills."
City Attorney ruled that the Council acts as
a body. No Councilman can go out and nullify
action of the Council. The Auditor realizes
that this is true. Once in a while action of
the Council does not conform with the opinion
of all. When a purchase is made and authorzed
by the Council, the only legal way to stop it
is by bringing suit or having the Council
rescind its action. No Councilman can stop a
purchase in the manner attempted. He must
bring suit to stop that action. The Council
acts as a body and'thatorder stands until the
law or Council stops it.
Councilman McIntire: "The material purchased
was signed for, the affidavits are attached,
the City Attorney and Auditor have cleared
the bills and I believe the bills should be
paid without further action or arguement."
City Attorney: "I doubt if that is the proper
way. I believe that it should talm an action
of the Council at this time to pay the bills.
A motion could be made at the appropriate
time that the bills be honored and paid. If
it fails by action;of the Council, the bills
would not be paid., If it carries, pay the
bills.
