A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA INITIATING PROCEEDINGS FOR FORMATION OF ITS
CITYWIDE LANDSCAPING AND LIGHTING ASSESSMENT
DISTRICT AND THE LEVY AND COLLECTION OF ASSESSMENTS
WITHIN THAT DISTRICT FOR FY 1989-90
On July 3 , 1989, on motion of
Councilmember duly seconded by Councilmember
and carried, the City Council of the City of
Azusa (the "Council") RESOLVES AS FOLLOWS:
Section 1. The Council finds and determines:
(A) That the Council proposes to form its
Landscaping and Lighting Assessment District No. 1 (the
"Assessment District") and to levy and collect an assessment
for FY 1989-90, to be collected on the utility
bills for subscribers within the boundaries of that
Assessment District pursuant to the provisions of the
Landscaping & Lighting Assessment District Act of 1972,
Streets & Highways Code Sections 22500 et.seq., such
assessment to be known as the "community maintenance fee;"
and
(B) That the following improvements are to be
installed, constructed, maintained, administered and
serviced within such Assessment District:
city parks, median and other landscaping along city
streets with the Assessment District as well as
associated curb, gutters, drains and streets.
(C) That the proposed Assessment District has the
same boundaries as the City, as more fully described in
Exhibit "A", attached and incorporated by this reference; i
and
(D) That the Assessment District shall be known as
the City of Azusa and Landscaping and Lighting Assessment
District No. 1; and
(E) That the Board has requested that Roy
Bruckner, the City Engineer, prepare the engineer's report
as described in Street and Highways Code Sections 22565-
22574, but providing for assessment and collection based on
the utility users;

(G) That rules for providing electric service
provide for service to property owners or those with an
interest in real property including a possessory interest
based on the type of uses such as residential (both single
and multi -family), commercial (varying by size) and
industrial; and
(H) That the City provides utility service and
proposes to collect the assessments on the utility bill; and
(I) That collection on the utility bill is fairer
than tax roll collection, as approximately half of Azusa
residents are renters and such collection does not lead to
foreclosure on property for non-payment.
Section 2. Now, therefore, the Council resolves
and orders:
(A) That the above recitals are all true and
correct; and
(B) That Roy Bruckner shall prepare and file with
the Council a report as set out herein and in accordance
with Streets & Highways Code Sections 22556-22574 for the
formation of the Assessment District, the installation,
construction, maintenance, administration and service of the
improvements, and the levy of an assessment within the
Assessment District for such installation, construction,
maintenance, administration and service for Fiscal Year
1989-90, to be collected on the utility bill.
Section 3. The City Clerk shall certify to the
adoption of this Resolution and thenceforth and thereafter
the same shall be in full force and effect.

July 1989.

I HEREBY CERTIFY that the foregoing Resolution was duly

noticed regular meeting thereof, held on the 3rd day of
July , 1989, by the following vote of the Council:
