HomeMy WebLinkAboutResolution No. 86420 • RESOLUTION NO 00 8642 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REVOKING CONDITIONAL USE PERMIT NO. C-381 FOR THE PROPERTY LOCATED AT 902 NORTH AZUSA AVENUE THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: (A) Conditional Use Permit No. C-381 was approved on September 4, 1985 to permit the expansion of a nonconforming automobile service station located at 902 North Azusa Avenue ("Subject Property") in order to operate a transmission repair business. Due to the abandonment of the service station and the failure of the applicant to initiate work under the Conditional Use Permit, the Planning Commission held public hearings on the revocation of Conditional Use Permit No. C-381 on April 26, 1989 and the City Council held a duly noticed public hearing on said revocation on June 5, 1989. (B) On April 26, 1989, the Planning Commission of the City of Azusa by Resolution No. 89-34 recommended to the City Council that Conditional Use Permit No. C-381 be revoked. (C) This service station has been abandoned for a period in excess of six (6) months, as evidenced by the shut-off of electricity at the site. Section 19.60.150 provides that a Conditional Use Permit may be revoked if the use for which the permit was granted has ceased or is not being exercised. (D) Plans have been approved by the Planning Commission for a two -tenant commercial building on this site. A later request for a mini mall was denied. The service station site has not been actively used for approximately nine (9) months. (E) The site currently contains a boarded -up building, and the perimeter is surrounded with a chain link fence. Although recent efforts have been made to clean up the property, the site has languished in an unattractive state for long periods of time with rocks, weeds and debris strewn across the parcel. The abandoned service station creates an eyesore for the surrounding area. (F) At the public hearing before the City Council on June 5, 1989, neither the applicant nor his 0 • 9 • representative appeared at the hearing nor submitted any documents objecting to the revocation. SECTION 2. Based upon the findings set forth above, the City Council of the City of Azusa does hereby revoke Conditional Use Permit No. C-381 for the property located at 902 North Azusa Avenue. SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
