A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
CONFIRMING THE ENGINEER'S REPORT DATED AUGUST 7, 1989
AND ORDERING THE LEVY AND COLLECTION OF A CITYWIDE FIRE
SUPPRESSION BENEFIT ASSESSMENT ON THE UTILITY ROLL TO
FUND FIRE SUPPRESSION SERVICES TO THE CITY
The CITY COUNCIL OF THE CITY OF AZUSA does resolve as
follows:
SECTION 1. That the City Council of the City of Azusa does
hereby find, determine and declare, as follows:
(A) That the City Council by Resolution declared its
intention to levy and collect a fire suppression benefit
assessment on the utility roll within the City to fund payment to
the Los Angeles County Fire Protection District for fire
suppression services to the City and call for the preparation of
a report pursuant to the Fire Suppression Benefit Assessment Law
(Government Code Section 50078 et seq.) (the "Act" and the
"Report") by City staff; and
(B) That City staff and the engineering firm of Kenneth I,
Mullen, Inc. have prepared the Report pursuant to the Act and
have filed such Report with the City Clerk; and
(C) That the City Clerk noticed, in the time and manner
provided in the Act, a protest hearing for this date and time on
the issues of levying and collecting assessments on the utility
roll; and
(D) That at the time and place noticed the City Council
duly conducted such protest hearing, and considered any and all
written protests against the levy and collection of assessments;
and
(E) That valid protest are less than five percent of the
total expected revenue from the assessments.
SECTION 2. That it is hereby ordered by the City Council as
follows:
(A) That the Report attached and incorporated herein by
this reference, as Exhibit "A", hereby is approved, confirmed and
adopted (as modified); a copy of the Report shall remain on file
with the City Clerk and available for public inspection; and
(B) That the assessments set out in the Report and their
manner of levy and collection are confirmed, approved and adopted
for funding the services, for the time described in the Report;
and
(C) That the levy and collection of the assessments shall
be made on the utility roll in the same manner as utilities
charges are collected by and on behalf of the City and as set out
in the Report and that such levy and collection may commence
September 1, 1989; and
(D) That the City Council does hereby levy said assessments
to cover the costs of contract fire suppression services to all
residents of the City; and
(E) That the Finance Director of the City of Azusa shall
establish a special fund entitled "City of Azusa Fire Suppression
Assessment Fund", and all assessment proceeds shall be deposited
in such fund; and all payments made from such fund shall be for
the purposes set out in the Report; and
(F) That the City staff is hereby designated, required,
empowered, authorized, instructed, directed and ordered to levy
and collect all such assessments as set out in the Report and to
perform any and all duties necessary therefor.
SECTION 3. That the City Clerk shall certify to the
adoption of this Resolution.

I HEREBY CERTIFY that the foregoing Resolution was duly
adopted by the City Council of the City of Azusa at an adjourned
regular meeting thereof held on the 31 day of August, 1989 by the
following vote of the Council:
