Foothill Boulevard Azusa, California 91702 RESOLUTION 8802 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA VACATING A PORTION OF THE STREETS AND ALLEYS KNOWN AS SUNSET AVENUE, ANGELENO AVENUE, SANTA FE AVENUE, AND THE ALLEY BETWEEN SAN GABRIEL AVENUE AND ANGELENO AVENUE NORTH FROM FOOTHILL BOULEVARD TO THE AT&SF RAILROAD THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa hereby finds and declares as follows: A. This vacation proceeding is being conducted pursuant to Sections 8320 through 8325 of the Streets and Highways Code. B. On January 15, 1990 the City Council adopted Resolution 8790 declaring its intention to vacate that portion of specified streets and alleys known and described in Exhibit "A" attached hereto. C. The City Clerk published Resolution Number 8790 in the manner required by Sections 8320 and 8322 of the Streets and Highways Code and posted notices of vacation in the manner required by Section 8323 of the Streets and Highways Code. D. On January 24 , 1990 the City of Azusa Planning Commission considered the proposed vacation and adopted Resolution No. 90-15 finding that the proposed vacation conforms to the adopted General Plan. E. A hearing was conducted by the City Council on the vacation described in this Resolution on February 5, 1990, at which time all evidence relating to the proposed vacation was heard and considered by the City Council . F. The City Council finds, from all the evidence submitted at the hearing, that the portions of the streets and alleys described in this Resolution are unnecessary for present or prospective public street use. G. The City Council also finds that the portion of the street described in this Resolution is not useful as non-motorized transportation facilities. H. The street vacation described in this Resolution is consistent with and in conformance with the Azusa General Plan and its elements. SECTION 2 . The City Council 's intent to vacate the subject streets and alleys is conditioned upon fulfillment of various obligations of the Disposition and Development Agreement (DDA) between the Redevelopment Agency of the City of Azusa and CoastFed Properties dated June 20, 1988 . SECTION 3 . The City Council finds that the public convenience and necessity require the relocation of various public service and public utility systems located within the streets and alleys to be vacated. The City shall cooperate with the utility companies in securing replacement easements. SECTION 4 . The City Council finds that access to the existing Crestmore Apartment Project at 451 West Foothill Boulevard must be maintained and that an easement shall be provided prior to recordation of this Resolution. SECTION 5. The City Council of the City of Azusa hereby vacates the City streets and alleys more particularly described on Exhibit "A" , which is attached hereto and incorporated herein by reference. A map showing the location of the proposed vacation is attached hereto as Exhibit "B" . SECTION 6. The City Clerk shall certify a copy of this Resolution and transmit the same to the County Recorder for recording in accordance with the terms and conditions of the Disposition and Development Agreement by and between the City of Azusa Redevelopment Agency and CoastFed Properties, dated June 20, 1988 . Upon recordation of this Resolution, the above described area shall no longer constitute a public street or alley. SECTION 7 . The City Clerk shall certify to the adoption of this Resolution.
